Citation text line 29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: Bagel and Bun Dept. a) Bagel Dept.: An employee working on the bagel divider line was exposed to a continuous noise level of 114.0% dose or an equivalent sound level of approximately 91.1 dBA during a 472-minute sampling period. The employee noise exposure for an 8-hour time weighted average was 91.1 dBA which included zero exposure for the period of time not sampled. b) Bun Dept.: An employee working on the oven feed machine was exposed to a continuous noise level of 58.3% dose or an equivalent sound level of approximately 87.1 dBA during a 417-minute sampling period. The employee noise exposure for an 8-hour time weighted average was 87.1 dBA which included zero exposure for the period of time not sampled. The employer did not administer a continuing effective hearing conservation program which included noise monitoring, audiometric testing and training; on or about 7/17/19.
