Hi, This account with Caliber home loans I have had for a while. In XX/XX/XXXX we placed the account on forbearance due to covid which lasted until XX/XX/XXXX.
In XXXX I reached out to Caliber that I would like to get a loan modification which is offered to all covid forbearance clients. At that time the FRM weekly average rates were running between 3 to 3.5 %.
Caliber first they said I do not qualify for Flex modification without giving any reasonable explanation. After bunch of phone calls and speaking to supervisors and sendinge-mail they finally agreed to process my request. However, Instead of processing my request in a timely manner which is a few weeks, it took them almost 6 months to process it.
The issue is that by the time they proceed it rates were already over 5 %. This means that I will have to pay around extra 1.5-2 % ( or 9-12k ) because Caliber did not process my application in a reasonable time frame as required by law, and therfore putting an extre burden on me and family.

My name is XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX My current lender Caliber Home Loan XXXX XXXX XXXX XXXX, OH XXXX Loan number : XXXX Caliber Is refusing to return to my escrow account {$1200.00} amount that as per their Home owners Insurance Department was send to my previous Home owner insurance company XXXX XXXX XXXX XXXX XXXX of North Carolina XXXX XXXX XXXX, XXXX, XXXX, XXXX.
On XX/XX/XXXX ti cover my XX/XX/XXXX to XXXX XXXX Home owner Insurance.
Never receive de payment and my home owner insurance got cancel on XX/XX/XXXX because they never receive a payment from Caliber.
Caliber on a letter address XX/XX/XXXX to me state that since XX/XX/XXXX I did not have XXXX because I did not pay.
This payment as per never XXXX was never received .On XX/XX/XXXX was the first time for the past 5 months that Caliber called XXXX to see why this policy was cancel.
As per Caliber they used a wrong address to send the payment.
On XX/XX/XXXX I my self call a different insurance travelers to insure my home, because my previous insurance will not renew my previous policy because 5 months already pass.
For the past 45 days I repeadly call Caliber Escrow Department and Home owner Insurances department to get the {$1200.00} back in to my escrow with no success, nobody really have a resolution, false promise to be resolved in 1 week or " We will call you to follow up with you " nothing had happen except that they used the escrow money in my escrow to pay my property taxes to pay for my new Travelers XXXX {$1400.00} and these create a deficit that increase my monthly payment from {$1700.00} to {$1800.00} on XXXXMy new XXXX increase XXXX XXXX yearly and leave me a bad record with Occidental XXXX because they have me as a bad payer.
Multiples letters staying that I don't have insurance, That I have insurance or that I will have to pay {$690.00} for the months with out insurance.Caliber poor costumer service and no answers or resolution is the reason why I am complaing.
I feel this is a miss used of my escrow account and a abused of on low income costustumer because they never keep track that the insurance payment Check never was cash if they really send this to the wrong location.Also if the check never was cash why I not getting credit that amount back to my escrow account instead they want me to paying they back .This company is a scaming

I have a mortgage with Caliber Home Loans. I am the only borrower on the loan, and my ex wife is successor in interest. Caliber home loans has been stating that because my ex wife is successor in interest, that she can make the same changes to our mortgage account as I can. For example, on XX/XX/2021 they allowed her to change the homeowners insurance and never even contacted me that it had been changed. Furthermore, on the phone several months ago they indicated they would be reporting her social security number to the IRS on form 1098, even though I am the primary borrower and am liable for the mortgage, and they have been reporting my social security number to the credit bureau. It is my understanding that successor in interest is only allowed to receive copies of documents while the borrower is alive, and Caliber refuses to agree with this.

I have contacted Caliber Home Loans numerous times about this issue. I Filed Chapter XXXX And it was converted to a Chapter XXXX. On my Credit Reports, Caliber Home loans refuses to show the account as included in Bankruptcy. This is damaging my score as they are in clear Violation of the FCRA and the Bankruptcy Code. I received my Chapter XXXX discharge on XX/XX/2020. This is ridiculous that I can not move past this mortgage company.

I've contacted Caliber loans over the past six months, in at least four phone calls to remove PMI. Each time, I was given conflicting information. Since I was unable to get an appraisal done, I ended up paying down the mortgage to under 78 % of the original value on XX/XX/XXXX. Since the inception of the loan, I've never made a late payment, usually paying several months in advance. On the day the payment was posted, I contacted Caliber to let them know that PMI should automatically be cancelled. Since then, my next payment still shows the PMI payment amount.

OnXX/XX/XXXX we submitted a package to process a short sale with Caliber Home Loans via XXXX and the interior valuation was completed the same week. the value came back at {$280000.00} and the servicer ( Caliber ) provided me a copy of it on XX/XX/XXXX.On XX/XX/XXXX we submitted an engineer report along with an explanation letter to have them review the value of the property. they basically used fully renovated properties as comparables for a property that will need a lot of work due to the major issues that require major repairs.we marketed the property on websites such as XXXX, XXXX, XXXX, etc and we were not able to get an offer on the property on the range requested by the investor.After meeting all the investor requirements i received the following message from XXXX XXXX XXXX on XX/XX/XXXX : I would like to take this opportunity to tell you about a change in policy and how this change affects this property.
As you are aware, all short sales are subject to lender approval.
This account is no longer eligible for a short sale and we will not approve a loss.
A full payoff will be required.
We appreciate how hard you have worked to help our mutual client avoid foreclosure, and do n't want you to spend any more time on a short sale that is not available.
If a full payoff is not an option, we encourage you to assist the homeowner to agree to a Deed in Lieu, rather than a short sale.
There is currently {$14000.00} incentive available for the homeowner for a completed Deed in Lieu. Attached is a Deed in Lieu application for the homeowner to complete and return to my attention at calibercares@caliberhomeloans.com or contact us at XXXX to discuss.
If the homeowner wishes to pursue retentive options to remain in the property, they may contact our SPOC department at XXXX for other alternatives.
Basically, without any warnings or notifications, the investor decided to denied the short sale option to the home owner unilaterally and we basically wasted more than 2 months complying with everything they asked for. Also, I am checking reviews from other agents and i see that this has become a common practice from this servicer. I truly believe these abusive practices have to be regulated by the federal government to stop this investor from doing more harm to the people that are currently in a hardship situation.

I believe my home was paid off after XXXX XXXX when ny husband died. No more statements and a broker search found no open mortgages. 2 /3 years later Get statements from Caliber Home Loans, never heard of them and XXXX XXXX served with papers for foreclosure. I wrote NYS DFS and contacted Caliber and Caliber did not have me on for any foreclosure bur I was getting papers from XXXX For XXXX. The week of XXXX my former attorney ( friend in community ) emails me Notice of Sale docs filed with no date but I had a XXXX done Title Analysis which suggests Fraud and said I have case and neither Caliber or XXXX or XXXX are listed anywhere. It lists XXXX XXXX XXXX which is paid off satisfied. It also states {$120000.00} from a closing in XXXX that we were told was an error and looks like it was filed and attached to our refinance. I need to halt court actions while we can prove false, fraudulent documents.

XX/XX/2018 My complaint involves the deceptive information used by XXXX XXXXXXXX XXXX XXXX XXXX XXXX at XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, New York XXXX telephone ( XXXX ) XXXX XXXX, to induce XXXX XXXXXXXX to create a mortgage.
At the time that the XXXX XXXX was creating this fraudulent mortgage I was XXXX and unemployed. I notified XXXX XXXX that it was impossible for me to continue my mortgage payments and asked him to confer with the bank, XXXX XXXXXXXX, to arrange a program that would allow the sale of the property and the settlement of the outstanding mortgage.
What was represented as a form of modification turned out to be a financial arrangement that was onerous and draconian in its cost in fees and new taxes and future interest rates.
The result is that the bank is now at the brink of foreclosure and they have issued a to the court a {>= $1,000,000}, which if executed will leave my wife and myself without any equity and we will be subject to abject poverty. Our most valuable asset will be taken from us and the bank will collect {>= $1,000,000} in fees. My wife and I will be destitute based on a mortgage that I would never have gotten based on the true facts rather than the fabrication that the XXXX XXXX used to create an application that the XXXX XXXXXXXX would accept. This was no more than a way for the bank and the mortgage broker to garner tens of thousands of dollars in fees, with no regard for the laws that demand a truthful disclosure of facts, or the negative impact on the people on the other side of their deceptive behavior.

I am elderly person that is trying to keep his home, I have tried numerous times to submit a loan modification package, but my mortgage servicer Caliber Home Loans underwriter has made my process impossible. Hiding behind guidelines just to delay my loan modification review. I provided a fully package back on XX/XX/XXXX, then my servicer stated that they need 30 days to review, I was supposed to received an answer on XX/XX/XXXX, but instead the underwriter requested pay stubs for someone that has nothing to do with my mortgage since I provided a quit claim deed. But the underwriter never looked at this. By requesting this he or she was able to go on with the holidays. By the time they figured out that what he or she requested was not needed, 30 more days passed by and I was falling deeper in debts since they are adding all type of fees on top of my mortgage. I went to court again on XX/XX/XXXX and a day before my settlement conference, they underwriter stated that my pay stubs were fraudulent and requested more pay stubs. I went to court with my most recent pay stubs and provided them to the court. The bank attorney did not want to take the pay stubs, but instead to fax them or email them to Caliber Home Loans. I sent my pay stubs to Caliber Home Loans, they told me that it will take 5 to 7 days before these information shows up on their system. By the time they looked at my pay stubs, all my previous documents expired, now I have resubmit a whole new package and I am sinking in debt, now I owed {$61000.00} and requested help 3 months after I failed behind. I can not get a good faith review of my loan modification application and I am caught in this horrible vicious cycle. I am seeking your help, I can not lose my home, it is everything that I have. 1 ) My husband and I fell behind with mortgage payment, XX/XX/XXXX. Matters became worse, XX/XX/XXXX, when my husband suffered from XXXX and XXXX ( Medical care - XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, NY XXXX, XXXX ) and was forced to stop working. Although, we are pursuing my husband 's XXXX ( payments ), we have fallen further behind. To date, XXXX XXXX. has never provide us with a monthly mortgage statement. We have requested several times for a statement.
2 ) We attempted to settle past due amount {$3000.00} ( account # XXXX )XX/XX/XXXX. Mortgage company ( Caliber Home Loans , Inc., XXXX XXXX XXXX, XXXX XXXX, OK XXXX ) refused our letter / offer to settle. The subject mortgage company, XX/XX/XXXX, pursuing foreclosure via their legal representation ; XXXX XXXX XXXX , XXXX, XXXX XXXX XXXX XXXX XXXX, XXXX, NY XXXX ( phone # XXXX ) 3 ) We have reviewed our situation with local Legal Aid Society of XXXX XXXX XXXX , XXXX., XXXX XXXX XXXX, XXXX, NY XXXX. ( phone # XXXX XXXX contact XXXX XXXX XXXX, XXXX. ) 4 ) Our hope and request is we to save our home ( value - {$130000.00} - estimated, loan balance - {$30000.00} - estimated. My husband 's employment contract was revised at the end of XX/XX/XXXX. He was worried that his job was being eliminated, so he notified our mortgage loan servicer, Caliber Home Loans ( trustee for XXXX XXXX XXXX XXXX ) of hardship and asked for Loss mitigation application info. He made mortgage payments until the end of XX/XX/XXXX at which point he lost his job. The XX/XX/XXXX., and XX/XX/XXXX. payments that he made were not credited to our mortgage. My husband was told not to pay anymore payments until loss mitigation was submitted. One payment was returned to us and there is a partial payment still sitting in our account that was never applied. Loss mitigation paperwork was promised on the numerous times my husband called requesting it, but never received despite the promises. Caliber Home Loans lied to us. On XX/XX/XXXX, we were served in person with a foreclosure summons. We did not receive a 90 day pre-foreclosure letter by certified or registered mail. We did not receive housing counselor information either. We contacted the NYS Attorney General 's office and eventually was referred to XXXX XXXX XXXX, a law firm that is representing us in the foreclosure case. We are currently in the settlement conference phase. My husband is now gainfully employed and prepared to resume payments, but Caliber has adjourned twice already.

ON XX/XX/XXXX MY CLIENT, XXXX RECEIVED A LETTER STATING THAT CALIBER HOME LOANS HAD TAKEN OVER HER MORTGAGE FROM XXXX AFTER HAVING ALREADY GIVEN A FULL HAMP APPLICATION TO XXXX.
ON XX/XX/XXXX WE HAD TO SUBMIT ANOTHER HAMP APPLICATION TO CALIBER UPLOADED TO THEIR WEBSITE. FROM XX/XX/XXXX WE UPLOADED ALL THE DOCUMENTS REQUESTED FROM ALL THE SPOC REPS.
THEN ON XX/XX/XXXX CALIBER WITHOUT ANY PRIOR NOTICE, CANCELLED AND DE-ACTIVATED OUR ACCESS TO THEIR WEBSITE TO UPLOAD ANY MORE HAMP DOCS. THUS, WE WERE UNABLE TO KNOW WHAT DOCUMENTS WERE ALREADY PROVIDED TO CALIBER AND ON WHAT DATES THEY WERE UPLOADED AS THE WEBSITE HAD ENABLED US TO DO. THIS SLOWED DOWN OUR HAMP APPLICATION SUBMISSIONS TREMENDOUSLY.
AFTER CONFRONTING CALIBER WITH THIS EXTREMELY PREJUDICIAL ACT AGAINST XXXX THE SPOCS FINALLY GAVE US THE EMAIL XXXX TO SUBMIT MORE DOCUMENTS.
UNFORTUNATELY, WE CAN NOT TELL WHAT DOCS. WERE ALREADY PROVIDED AND ON WHAT DATES. THEY CLAIM THEY DE-ACTIVATED US DUE TO A PENDING FORECLOSURE SALE WHICH THEY SCHEDULED FOR XX/XX/XXXX, WHILE OUR HAMP APPLICATION WAS STILL PENDING.
THEN FINALLY ON XXXX, THE SPOC XXXX INFORMED US THAT CALIBER HAD RECEIVED ALL NECESSARY DOCUMENTS AND WOULD SUBMIT THE ENTIRE HAMP APPLICATION AND DOCUMENTS TO THEIR UNDERWRITER. HE THEN STATED THAT WE WOULD HAVE TO WAIT ABOUT 30 DAYS FOR A RESPONSE.
THEN ON XX/XX/XXXX, OUR LAW OFFICE CALLED TO GET AN UPDATE AND CALIBER STATED THAT THEY NEEDED MORE DOCUMENTS AND THAT THEY HAD CLOSED OUR HAMP APPLICATION BACK ON XX/XX/XXXX.
ON XX/XX/XXXX WE EMAILED THOSE DOCUMENTS. XXXX, THE SPOC SAID TO CALL BACK IN 1 WEEK FOR AN UPDATE.
THEN ON XX/XX/XXXX WHEN WE CALLED BACK, XXXX ANOTHER SPOC IN XXXX. STATED WE NEED EVEN MORE DOCUMENTS.
CALIBER HAS NEVER CALLED OR EMAILED OR FAXED OR WRITTEN ANYTIME TO REQUEST MORE DOCUMENTS. WE ONLY KNOW AFTER WE CALL THEM. THIS IS DUE TO THE HARDSHIP CAUSED BY THE ACCESS DE-ACTIVATION OF THE WEBSITE TO UPLOAD AND REVIEW DOCUMENTS.
THUS, WE ARE FILING THIS COMPLAINT TO THE XXXX DFS TO COMMENCE AN INVESTIGATION INTO CALIBER 'S FRAUDULENT AND BAD-FAITH PRACTICES WITH HOME-OWNERS IN XXXX. IM VERY SURE THEY HAVE ACTED FRAUDULENTLY AND IN BAD-FAITH WITH MANY OTHER HOME-OWNERS IN XXXX IN ORDER TO FORECLOSE ON THEIR PROPERTY AND MAKE A PROFIT WHEN SELLING THEIR HOMES. WE ALSO FILED A COMPLAINT WITH THE XXXX DEPT. OF FINANCIAL SERVICES.
PLEASE ACT EXPEDITIOUSLY IN THIS MATTER AS WE ARE ALSO TAKING THIS TO OUR US SENATORS AND REPS. IN CONGRESS FOR AN INVESTIGATION.
