Complaint What Happened I had a car loan with Credit Acceptance Corporation. I paid the car on time every month for years ( From XX/XX/XXXX to XX/XX/XXXX ). The car was totaled around XX/XX/XXXX. I filed an insurance claim and my insurance paid the full loan amount. The loan should have been closed XX/XX/XXXX. Instead of reporting the account as closed, Credit Acceptance Corp continued to report the account as late from XX/XX/XXXX to XX/XX/XXXX. This is completely incorrect. They have been incorrectly reporting late payments even though they were paid in full by my insurance. I have reached out to the company numerous times via mail and I have not gotten a response. I have asked for proof of this incorrect reporting and they have not sent me any proof. I have disputed this numerous times, and Credit Acceptance Corp keeps saying that it is correct even though it is not! Even there reporting does not make sense. I would like this corrected as it is ruining my credit. This account was paid in full and closed in good standing.

Complaint What Happened This creditor engaged in abusive, deceptive, and unfair practices of the FDCPA which it prohibits. According to 15 USC 1666b it is a billing error I did not receive a statement XXXX days before the late payment error. If finance charge included, there should be no late payments pursuant 15 USC 1605 ( a ) due to finance charge bring sum of all charges so I can not be penalized for something that is already paid in full.

Complaint What Happened Account was opened XX/XX/XXXX with a XXXX down payment with full coverage insurance on the vehicle. Was in an accident XX/XX/XXXX and the car was totaled. The insurance paid the car off and was supposed to clear the vehicle. It was never cleared received information from credit acceptance stating that Ive surrendered the car back to them and that I owed XXXX left on it I contacted my insurance and they stated that they would only pay the remaining balance off for what the value of the car was worth and credit acceptance denied it and requested the car be returned to them, they sold the car and still charged me that amount Ive asked for the 1099c since its stating that Im missing payments on this car after its was crashed and or voluntarily repossessed.. just seems like a big scam and its been on my credit for a long time and Ive havent had the car since XXXX. Complaint What Happened Sent a Formal Demand letter via certified mail on XX/XX/XXXX2024, I did not receive a letter back- I received an email I could not access due to it being encrypted. formally demand compensation for the significant. financial and emotional harm caused by XXXXCredit Acceptance Corporation 's ( XXXX ) unfair and deceptive practices in connection with my auto loan ( Account XXXXNumber : ( XXXX ). This. letter serves as my attempt to resolve this matter amicably without further legal or regulatory action. Grievance : 1. Predatory Lending Practice - XXXX misrepresented the actual costs associated with my loan, failing to disclose the full terms in a transparent and understandable manner. As a consumer, I had the right to be informed of all fees, interest rates, and conditions before entering into the loan agreement. This lack of clarity misled me into accepting a high-cost loan for a used vehicle. 2. Structuring Loans to Fail - The loan I received from XXXX was structured with terms that were designed to set me up for failure. The monthly payment of {$340.00}, beginning on XXXX. XXXX, 2010, was beyond what I could realistically afford over the duration of the loan. Despite my good-faith efforts to meet these terms, the financial burden was excessive, resulting in the repossession of my vehicle on XX/XX/XXXX2013. 3. Harassment through excessive phone calls and emails 4. Fraudulent Misrepresentation - The dealership engaged in deceptive practices by promising XXXX deal and switching it at the time of purchase. 5. Breach of Contract - The terms of the final agreement signed differed from what was agreed upon verbally or advertised. 6. Unconscionable Practices - The dealership charged fees or imposed terms that were excessive, unfair, or unexpected. The cost of the car ended up being far more than what was originally agreed to. 7. Violation of Consumer Protection Laws - Bait-and-switch sales tactics. The dealership misled me about the cost, financing terms, or vehicle condition. 8. Breach of Good Faith and Fair Dealing -The dealership had an obligation to act in good faith during the sales process. Using deceptive tactics to push into a more expensive vehicle or deal breaches this legal duty. 9. Financial Hardship Due to Predatory Lending - hidden fees were added after the deal 10. Emotional and Financial Damages -emotional distress, financial harm, or loss of transportation due to the dealerships deceptive practices and subsequent repossession. 11. Targeting Vulnerable Customers - XXXX appeared to specifically target vulnerable consumers, including myself, with predatory practices. These tactics took advantage of my financial situation, locking me into an unfavorable loan agreement with terms that were nearly impossible to meet.

This account, according to XXXX, was opened on XX/XX/XXXX. I do not have a car, nor do I know how to drive. I never had a driver 's license, and I have no knowledge of this account. I am a victim of identity theft. The FCRA requires all credit bureaus to remove accounts that have been opened as a result of identity theft. Complaint What Happened CAC claimed to help low-income New Yorkers purchase cars, but instead, drove them straight into debt, said New York Attorney General XXXX XXXX XXXX CAC steered hardworking New Yorkers onto a path of financial ruin by tricking them into unaffordable, high-interest auto loans while cutting backroom deals with dealers to increase their own profits. These predatory actions hurt innocent people and left them with mountains of debt. I thank the CFPB for their partnership to stop this harm and protect everyday New Yorkers. I was one of the many low-income New Yorkers who needed a car and didnt have enough to buy it on my own, I was only XXXX at the time a single mother who worked at the XXXX XXXX but barely affording to live. I went to XXXX XXXX dealership barely knowing anything about getting a car or even financing a car. I looked around at a few cars and was told Credit acceptance was willing to work with me although I didnt have enough credit according to them. After looking around at a few cars which they said they approved, I was told I could only get this one specific car which was a used XXXX XXXX XXXX in my head I didnt understand so I asked why is it that they approved me for multiple cars but I was only able to get this one specific car, I was told that is what the bank chose for me. Moving forward I still was not able to get it, so I was asked to put more money down and I would need a co signer at the time I was really desperate for a car, so my father who is XXXX and on XXXX who only gets paid once a month did it, which I told the salesperson I didnt think it would be a good idea because he doesnt work, they said it didnt matter so basically said do it anyway. Now again when signing paperwork they didnt go over much more than just made us sign paperwork so I really didnt get a chance to really see what I was signing. Moving forward I did get the car with a payment of XXXX a month, which I felt was a little high because again I am a single mother. A little after I received the car Covid happened so I ended up losing my job which caused me to fall behind in payments which I did notify credit acceptance, they paused payments but then later on resumed them, I fell behind so bad my car got repossessed XX/XX/XXXX, I was still out of a job then and did let credit acceptance know, they didnt try to work with me I was only told I had to make a payment before it was sold at the auction. I tried so hard to try and make a payment to get the car released, I ended up making the payment XX/XX/XXXX and getting the car released. At the moment when I did go to pick up my car from the auction my car was damaged, so I asked what happened they told me the company who repoed the car damaged it. Moving forward I notified credit acceptance and was told they have to do an investigation between the towing company and the auction. The investigation was very handled very poorly instead of them notifying me with how far they were in the investigation I had to keep calling and checking in and seeing what was going on because my car was damaged and I didnt cause the damage. Moving forward I did call in and was notified that it was the auction who damaged and was told I had to bring the car all the way back to XXXX XXXX where the auction was to get it repaired. I did notify credit acceptance that I did not feel comfortable bringing and leaving my car with them, when I was told by them when I first picked up my car that it was never them who caused the damage. Credit acceptance notified me that it was the only option they had for me. I had the car but was still facing financial hardship, trying to keep up with payment plans but it was hard because I was out of work, my car was repossessed again in XX/XX/XXXX, I notified credit acceptance of what I was going through they still did not work with me, I was told I had to make a payment to get the car released. I gained the money to release the car in XX/XX/XXXX, upon going to the auction where my car was I discovered my car was damaged even more then what It was. I called credit acceptance and notified them and was told thats how it was when they picked it up and I said I drove the car I know how it was. So again I was stuck with damages I did not cause to the car and credit acceptance did not help. Credit Acceptance ensured its own profits by providing loans without regard to whether borrowers could afford them. I was one who could not afford but was tricked into thinking I can by credit acceptance. When borrowers default on loans, it can lead to severe consequences, including wage garnishment and an inability to borrow money in the future. A default on an auto loan can also lead to the borrower losing their means of transportation, which can cause job loss and a further spiral of damaged credit and financial distress. I am currently in repossession status again with credit acceptance and Im just very stressed because I feel like I was tricked into this whole loan as a young single mother.

Complaint What Happened I am filing this complaint against Credit Acceptance Corporation for failing to provide essential documentation related to the voluntary surrender of my vehicle. Credit Acceptance is inaccurately reporting a " Voluntary Surrender '' ( VS ) on my credit report, and despite multiple requests, they have not supplied the necessary documents to substantiate this reporting. I believe this lack of documentation violates my rights under the Fair Credit Reporting Act ( FCRA ) and possibly other consumer protection laws. Requested Documentation Not Provided : I am requesting to Credit Acceptance for the following documents, which are essential to verify the reporting and understand any remaining obligations : Original Contract : To confirm the terms and conditions of my loan agreement. Full Payment History : To verify that the payments I made were accurately recorded. Notice of Default ( if applicable ) : To verify that Credit Acceptance followed proper legal procedures in notifying me of any default. Notice of Sale : To confirm whether the vehicle was sold and the details of the sale, if applicable. Explanation of Calculation of Surplus or Deficiency : To understand the calculations used to determine any surplus or deficiency resulting from the sale of the vehicle, if it was indeed sold. Notice of Retrieval of Personal Property : To verify that I was given proper notice and an opportunity to retrieve any personal items from the vehicle before it was repossessed or sold. Consumer Rights Violations : By not providing this information, Credit Acceptance may be violating my rights under the FCRA, which mandates accurate reporting, as well as any applicable state laws governing the repossession and sale of collateral after a voluntary surrender.

Complaint What Happened I have reached out to the company Credit Acceptance several times since XXXX of 2023 that loan was not taken out with my consent and was harassed by company with 8-10 calls a day even on holidays and weekends and late night calls despite me providing a police report and FTC identity theft report company still is reporting on my credit report and will not delete. This company has continued to violate my rights and laws provided to protect consumers in the Fair Credit Reporting Act as well as local and state laws. also after researching this company and the hundreds of complaints about Credit Acceptance they should not be in business any longer.
