Notwithstanding the provisions of this subdivision, a business solely engaged in the removal of waste materials resulting from building demolition, construction, alteration or excavation shall be exempt from the licensing provisions of this subdivision where, except in regard to the principals of a business solely in either or both of the class seven or the class three category of licensees as defined in rules previously promulgated by the commissioner of consumer and worker protection pursuant to subchapter eighteen of chapter two of title twenty of this code, no principal of such applicant is a principal of a business or a former business required to be licensed pursuant to this chapter or such former subchapter eighteen. Grant of such exemption shall be made by the commission upon its review of an exemption application, which shall be in the form and contain the information prescribed by rule of the commission and shall be accompanied by a statement by the applicant describing the nature of the applicant's business and listing all principals of such business. |

Citation text line | 29 CFR 1926.1101(k)(9)(i): The employer did not institute, at no cost to employees, a training program for each employee who was likely to be exposed in excess of the permissible exposure limit (PEL) and for each employee who performed Class I through IV asbestos operations: (a) On or about March 31, 2014, on the second floor of the Sears Department Store near the stock rooms, in an area partitioned off with plastic of approximately 56 feet long by 24 feet wide, tile and mastic containing 2% Chrysotile asbestos was removed by two workers using a Terminator 2100 ei floor stripper machine without established containment. The workers had not been trained per the requirements of 1926.1101(k)(9)(iv)(A) to perform Class II work. (b) On or about March-April 2014, at the Sears Department Store on the first and second floors, for laborers, carpenters and electricians performing renovation work such as but not limited to ripping up carpets, removing and adding fixture walls, running conduit, and replacing and installing new drop ceilings in areas near asbestos containing materials such as elbows and floor tiles. |

Citation text line | 29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: (a) Worksite, east side of the building - Employees applying the stucco Exterior Insulation and Finish System (EIFS) along the east side of the commercial building, operated and worked from the JLG aerial lift, Model 450 AJ / Serial # 077220 0300038522, at a height of approximately 13' above the ground below. One employee worked without any form of fall protection and a second employee worked with a personal fall arrest system, but was not connected to the designated anchor point within the aerial lift's man basket on, or about November 22, 2013. (b) Worksite, east side of the building - Employees applying the stucco Exterior Insulation and Finish System (EIFS) along east side of the commercial building, operated and worked from the Genie aerial lift, Model S-65 / Serial # 5007, at a height of approximately 10' above the ground below, without any form of fall protection on, or about November 22, 2013. (c) Worksite, north, east and west sides of the building - An employee relocated the Genie aerial lift, Model S-40 / Serial # S-40-5445, from the east to west side of the building and operated the aerial lift at a height of approximately 7' above the ground below, without any form of fall protection on, or about November 22, 2013. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation in accordance with 29 CFR 1903.19. Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 29 CFR 1926.502(e). |
