Employee consumed water from a plastic bottle while in this room. Safety data sheets of the paints and solvent used in this room indicated that toxic chemicals are present. Some of the toxic chemicals found during the sampling event included low levels of: isocyanate compounds; n-butyl acetate; ethyl benzene; xylene; acetone; heptane; tri-methyl benzene; and toluene.

(a) On or about 07/31/2013, at establishment, for employees using hazardous chemicals while working in the mixing room, spray paint booth and other shop areas. Review of safety data sheets for raw materials being used indicated that hazardous materials including, but not limited to, acetone, heptane, toluene, n-butyl acetate, ethyl benzene, xylene and tri-methyl benzene are being used.

Citation text line 29 CFR 1910.1200(f)(5): Except as provided in paragraphs (f)(6) and (f)(7) of this section, the employer did not ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with the identity of the hazardous chemicals contained therein and appropriate hazard warnings, or alternatively, words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemicals: (a) On or about 07/31/2013, at establishment, for employees using, or in the immediate area of, unlabelled containers of hazardous chemicals. Compliance officer observed a 5-gallon, unlabelled container of acetone and approximately a 16-gallon unlabeled container of lacquer thinner. These materials are classified as flammable or combustible liquids.
