29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: a) On or about 5/05/16, on a jobsite at 5791 Hunters Creek Rd., South Wales, NY: Employees were working on a jobsite that involved the removal of a large tree. The employees on the ground were using a chain saw to cut up branches and limbs that had fallen. The employer did not provide these employees with personal protective equipment such as pants or chaps that contain pads of cut retardant material to prevent cuts to their legs. NO ABATEMENT CERTIFICATION REQUIRED |

29 CFR 1910.132(b): Where employees provided thier own protective equipment, the employer did not ensure its adequacy, including proper maintenance, and sanitation of the equipment: a) On or about 5/05/16, on a jobsite at 5791 Hunters Creek Rd., South Wales, NY: an employee engaged in a tree removal using the tree climbing method provided his own protective equipment. The employer did not inspect that equipment prior to use by the employee. The equipment was later found to have been inadequate/improperly maintained including having deficiencies such as but not limited to the following: 1. A single action hardware store type carabiner with no load rating connected the rope grab on the green climbing rope to the D ring on the saddle belt of the tree climbing employee. 2. The Buck Strap (rope) was passed through the end of a double action locking carabiner and a knot was tied in the rope to secure the connection. The knot failed. A strap that was factory connected to the carabiner without tying knots would have been the proper equipment to use. NO ABATEMENT CERTIFICATION REQUIRED |

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a) On or about 5/05/16, on a jobsite at 5791 Hunters Creek Rd., South Wales, NY: Employees were working on a jobsite that involved the removal of a large tree. An employee climbed the tree and was using a chainsaw to cut limbs off the tree. The employee was exposed to being struck in the face by wood particles being propelled from the chainsaw. Additionally, the employee could potentially be struck in the face by the kickback of the chainsaw. The employee was not provided with nor using face protection. b) On or about 5/05/16, on a jobsite at 5791 Hunters Creek Rd., South Wales, NY: Employees were working on a jobsite that involved the removal of a large tree. Employees who used chainsaws to cut up limbs that had fallen to the ground after being cut by the employee in the tree were exposed to being struck in the face by wood particles being propelled from the chainsaw. Additionally, these employees could potentially be struck in the face by the kickback of the chainsaw, and by the springback of branches under tension in the delimbing process. The employees were not provided with nor using face protection. NO ABATEMENT CERTIFICATION REQUIRED |
