29 CFR 1910.94(a)(5)(iii): Properly fitted particulate filter respirators, commonly referred to as dust-filter respirators, may be used for short, intermittent, or occasional dust exposures such as cleanup, dumping of dust collectors, or unloading shipments of sand at a receiving point, when it is not feasible to control the dust by enclosure, exhaust ventilation, or other means. The respirators used must be approved by NIOSH under 42 CFR part 84 for protection against the specific type of dust encountered. a.) Sandblasting garage - On or about 2/25/13, Employee perform sandblasting to clean a variety of materials, including radiators, vessels, skids, etc. After sandblasting, large amounts of dust remain entrained in the air, due to lack of ventilation. Employees remove the sandblasting hood (supplied air respirator), to move equipment and materials around the garage area, such as bags of sand, sandblasted materials moved to staging area, etc. The employees do not wear any respiratory protection during this time. The employer does not ensure that the employees wear, at least, a filtering facepiece respirator for the time needed to refill the snadblaster with sand, move materials from the sandblasting area and move new materials into the sandblasting area. 29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) Du-All Facility - on or about 2/21/13, employees use a variety of chemicals, inlcuding but not limited to: Silica sand (silica); Aircraft Remover (methylene chloride); toluene; paint thinner; Epoxy coatings (HDI); isopropyl alcohol; MEK; and 1,3,5-triglycidyl Isocyanuarte-contining paint to prepare, clean and paint articles. The employer has not established, written or implemented a Hazard Communication program for the employees using these chemicals. A written program should include descriptions of how the criteria for: 1. Labeling and other forms of warning; 2. Material Safety Data Sheets AND 3. Employee information and training will be met. Additionally, a list of hazardous chemicals known to be present in the workplace must be compiled. Methods used to inform employees of the hazards associated with non-routine tasks and the informing of contractors of workplace hazard must also be addressed. 29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: Facillity - on or about 2/21/13, Employees work with silica sand (sandblasting/causes silicosis);solvents, such as MEK, paint thinner, isopropyl alcohol, toluene (flammables, affects central nervous system); paints and powder coatings (contains di-isocyanates which are sensitizers, and 1,3,5-triglycidyl isocyanurate); and, sandblast old paint that contains lead. The employer has not provided training to employees regarding the chemcials and hazardous materials to which they are exposed, through Hazard communication training. Employees shall be informed of: 1. The requirements of this section; 2. Any operations where hazardous chemicals are present; AND 3. The location and availability of the written Hazard Communication Program, list(s) of hazardous chemicals and Material Safety Data Sheets. Employee training shall include at least: 1. Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area. 2. The physical and health hazards of the chemicals in the work area. 3. The measures employees can take to protect themselves such as specific procedures, appropriate work practices, emergency procedures and personal protective equipment to be used. 4. The details of the employers Hazard Communication Program including an explanation of labeling systems, Material Safety Data Sheets and how employees can obtain and use the appropriate hazard information.
