In XXXX I emailed my loan servicer XXXX XXXX XXXXsnsc.XXXX/ XXXX representative XXXXsnscXXXX that my loan payments were not on my credit report. I was told previous servicer didnt report payment history ( not true ), I was told it took 6 months, I was told he had to put in request, I was told I had a late payment which would impact reporting ( no true ). I made a complaint to XXXX XXXX and had several communications, and no resolution other than advised to contact XXXX federal agencies.
I never received a letter of SN Setviving response to letter from XXXX XXXX as advised I would.

In XXXX after having deferred my mortgage during XXXX, my mortgage company sold my mortgage to XXXX XXXX. I was initially told when I deferred payments, that they would go to the end of the loan term and I would resume the regular monthly payments once the deferment period was over. When this happened, the mortgage company wanted everything that had been deferred up front, which is why the mortgage went to XXXX. There I have dealt with XXXX XXXX, who set me up on a payment plan to make payments towards the balance owed and continue to pay the monthly mortgage due. He told me that I would continue to get overdue notices because technically it is overdue, but to ignore those and continue to make the agreed upon monthly payments, which I have, without missing a payment since. Just this past Saturday XX/XX/XXXX, I received a letter in the mail from SNServicing attorney, stating that I {$11000.00} within the next XXXX days in order to bring my account to current, otherwise the foreclosure process will begin. This is the first communication stating this. It also states that they will not accept any payment other than the {$11000.00}. My XXXX payment, had not yet posted. Again, I have not missed a payment and have continuously paid the agreed upon amount each month. XXXX not sure why this is happening. They have also taken away my online access to view and pay on my account. I should not be dealing with any of this, and my mortgage should be current, based on the information that I was given when I originally deferred payments during the world wide pandemic. I need help and I need to get this rectified as soon as possible so as to not lose my home and have my XXXX XXXX affected any further. I am also currently unemployed and under a non-compete and have been for the past XXXX months. I have very limited income, but have still continued to make the agreed upon monthly payments.

My lender and/or mortgage loan servicer is practicing unfairly and in dad faith. I fell behind on my mortgage due to lost in income and on XX/XX/XXXX I received notice that a Foreclosure proceeding had commenced on me with a conference date of XX/XX/XXXX. I attending and expressed my reason for failing behind and concern for the excessive fees in the amount of {$5800.00} being charge above what I owed for principal, interest, tax, which at the time was {$9900.00} - {$730.00} an unapplied balance ( I pay insurance out of pocket ).
Fast forward a few conferences and a lot of conversations with the server XXXX my Modification application was determined complete as of XX/XX/XXXX. XX/XX/XXXX my loan was transferred from XXXX to SNSC. After numerous attempts to contact the new server on XX/XX/XXXX I receive an email from their attorney stating they had received my messages but are not interested in speaking to me and requesting additional documentation which was sent followed by an additional request on XX/XX/XXXX in which all documentation was finalized on XX/XX/XXXX. XX/XX/XXXX I received a letter from SNSC stating I was approved for a modification and should expect a packet in the mail, which I had 14 days to review and return by this time I was corresponding with the server by email.
XX/XX/XXXX I reached out to the asset manager in reference to the letter and was informed no such thing existed and insurance information was requested of me, which I provided. I proved to her that I had indeed received the letter.
XX/XX/XXXX I received a really brief email from another rep stating their modification terms, principal will increase from {$180000.00} to {$200000.00} interest rate will increase from 3 % to 5 % and payment will increase from {$810.00} to {$1100.00} for 480 months and requesting two good faith payments of {$810.00} before the XXXX month trial period started on XX/XX/XXXX. I made one good faith payment on XX/XX/XXXX.
XX/XX/XXXX we had a settlement conference in which the court voiced thire concern for the interest rate hike since it was above current rates and the court advised plaintiff to comply with rates currently being offered if they needed to raise the rate, it was also directed that I receive an itemized explanation of the {$10000.00} in additional fees being charged above total mortgage payments due of {$15000.00}.
XX/XX/XXXX after a few more emails I received their final Modification offer Initial Rate : 4.50 % for the first 24 months, Step rate will increase to 5.00 % after 24 months all other terms remained the same as last offer. These terms are unfair and have been provided to me via email with no follow up letter stating my rights or available options. I am hoping we can come to an affordable agreement where the final mortgage payment is affordable and hopefully the fees are not excessive.

Servicer SN Servicing never sent us a loan ownership transfer notice when our mortgage was sold. The XXXX XXXX, new owner of your loan and servicer never notified us within 30 days of the effective date of the transfer. They only transferred in XX/XX/2019 with the court but filed a judgement foreclosure sale before notifying us of transfer. They never sent us notice of the new owner 's name, address and telephone number.
( and if different, the person who can resolve issues concerning your loan payments or any right to rescind the loan ), They sent information with contradicting dates of transfer, a year after the transfer apparently took place, and never advised us whether the transfer of ownership is recorded in public records.
We became collateral damage in their transfer process.
They filed with the court immediately for judgement foreclosure and sale. They are still attempting to sell our home via court, without any genuine effort to modify.

When I was paying my mortgage I kept getting wrong amounts due by months.. as a result I have been sent demand letter and the like from SN Servicing.. There is a trust XXXX XXXX XXXX XXXX in Arizona that filed a foreclosure Judgement sale on our home, claiming they own our mortgage debt.
We were advised by the prior owner of this debt, XXXX XXXX XXXX, that they sold the debt to another trust in XX/XX/2018.
In any case, we were never notified of assignment, sale, transfer of this debt.
Then the prior owner, XXXX XXXX, XXXX in XX/XX/2018, filed a foreclosure judgement sale - despite the fact that XXXX XXXX XXXX XXXX says they owned the debt in XX/XX/2018, but the court action was filed in XX/XX/2018 by XXXX XXXX?
In addition, we were in the midst of a loan modification applicantIon with the prior owners of the loan, XXXX XXXX, who chose us for their RMBS agreement, and they filed foreclosure in the midst of our application, and changed the terms of the amount within two weeks of the offer.
Also, the current " owner '' XXXX XXXX XXXX XXXX used false figures in their judgement foreclosure sale, adding on past debt already forgiven in writing by original owner XXXX.
XXXX XXXX XXXX XXXX is attempting to sell our home based on false figures, and will not proved a qualified written request of figures, and denied our most recent modifcation application, based on their false assertion that we did not supply documents, which they never requested.
We currently have a FOIA request to find out if XXXX XXXX XXXX XXXX actually owns the debt, and how and when they procured it, as their date of acquisition differs enormously from that of XXXX XXXX ' letter. In addition, we never received written notice of transfer of debt, and, as noted, XXXX XXXX filed foreclosure of Judgement and Sale, a year after they say they sold the debt? and now XXXX XXXX XXXX XXXX, who was not named as the party XXXX sold our debt to, is enforcing the foreclosure sale judgment?

I signed a land contract for deed. The deal was if defaulted, all prior funds paid, repairs made, and water, taxes, would be lost and converted to a month to month lease. This always avoids foreclosure, Did n't know it was a mortgage. After a short time. I was paying my monthly mortgage in XXXX bi monthly payments using the web portal. I have been in late status since company took over my debt. They never honored my forbearance plan I had with previous servicer stating I was in non compliance with plan arrangements. They retaliated and blocked me from using web to send payments ( XXXX web access ) I called was informed they cant reinstate payment portal until Im caught up in payments. I have been paying consistently for years and now they made it harder for me to apply my payments because of the arrears.They instructed me to call and pay over phone from now on and I no longer have no access to my billing statements even though I requested it to be mailed to when the forced changes occurred. They havent sent me any statements and I feel its all retaliatory and not right Im being treated that way.

SN Servicing has come forward a a stranger to title claiming I owe them money on a void note and mortgage that were cancelled with the original Creditor, XXXXXXXX XXXX on XX/XX/XXXX, pursuant to TILA 15 USC1635. I originally made this complaint regarding XXXX on XX/XX/XXXX.
The details : SN Servicing Corporation ( claimant ) continues to falsely claim that they are secured creditors, and claims the property, XXXX XXXX XXXX, XXXX XXXX, NY XXXX, to be encumbered by a mortgage or deed of trust that no longer legally exist. This matter is in controversy solely because the original creditor, XXXX, failed to comply with 15 U.S.C. 1635 ( b ), by filing a satisfaction of mortgage with the XXXX XXXX recorders office, after the debtor rescinded the loan, pursuant to 15 U.S.C. 1635, On XX/XX/XXXX, by sending Notice of Cancellation ( Exhibit A ). The Notice of Cancellation Pursuant to 15 U.S.C 1635 and 12 CFR 1026.23 ( d ) the mortgage that gave rise to the right of rescission, became void upon rescission, by operation of law, thus the mortgage upon which the claimant bases its claim, is void and unenforceable. Title changed the day of rescission by matter of law, as stated in the aforementioned statutes, and as per the Supreme Court of the United States case XXXX XXXX XXXX.
There is addittional newfound evidence on XX/XX/XXXX, th XXXX, that this is a fraudulent claim that is being made by XXXXXXXX XXXX XXXX The real identity for XXXXXXXX XXXX XXXX is still unknown. The current creditor is being listed as XXXX XXXX XXXX XXXX XXXX XXXXXXXX, as Trustee of the XXXX XXXX XXXX XXXX when I ran the search through the Sec government website, this Trust does not exist so there can not be a claim from a Trust that does not exist. ( Exhibit B ) SN Servicing Corporation is a Servicing Company that is out of XXXX, California, their address being : XXXX XXXX XXXX, XXXX, CA XXXX. A Servicing Company does not have any authority to foreclose. The burden of proof established by XXXX which requires that, as a condition precedent, the claimant MUST have paid value for the underlying obligation ( not the assignee of the mortgage or the endorsee of the note ). At no time has SN Servicing proved that it has paid value for the underlying obligation in its proof of claim in United States Bankruptcy Court XXXX XXXX Of New York. Due To Constitutional violations per 18 USC241 and 242 and due To Due Process of law violations per the XXXX, XXXX, XXXX AND XXXX Amendments, and per UCC Violations of 9-203 ( b ) ( 1 ), This Is A FALSE CLAIM.

FDCPA VIOLATIONS - REFERRED BY FTC SN SERVICING XXXX XXXX XXXX IS CONTACT XXXX FDCPA violations since servicing loan that it did not originate and the loan was in default at the time servicing is received, hence SN Servicing is a debt collector.
2 ) SN Servicing added in debt that was written off by prior owner. XXXX.
May not use unfair or unconscionable means to collect or attempt to collect a debt.
Collect any interest, fee, charge, or expense incidental to the principal obligation unless authorized by the original debt agreement or is otherwise permitted by law. Use any False, Deceptive or Misleading Representations to the court, and to their client, the investor, on history of the debt.
3 ) Forced Place Insurance was imposed without notice. They sent notice to address they knew was incorrect.
4 ) DENIED Covid Forbearance based on original of debt from 2008 default? And ignored our many covid related losses.
5 ) ACTION - Threaten to take any action that is not legal or intended, constant threats of litigation if we applied for COVID 19 forbearance.
6 ) ESCROW / PROPERTY TAXES - trail mod contract explicitly states the we pay them escrow for property taxes, which we do and did, and they apparently stopped paying property taxes last year, despite their constant legal threats to sell home, and their actions in court to sell it, which were deemed illegal and cancelled.
7 ) SN SERVICING TOLD US THEY DO NOT HAVE THE POOL SERVICING AGREEMENT FOR OUR DEBT, NOR DO THEY HAVE THE ORIGINAL DOCUMENTS

Received loan modification from XXXX XXXX on XX/XX/XXXX, for payments monthly of {$1300.00}. Ive been making those monthly payments until XX/XX/XXXX. I was told in XXXX from XXXX XXXX of SN Servicing that I my payments were supposed to be going to SN servicing and not XXXX XXXX. Although I wasn't able to confirm this with XXXX ( I tried a few times to contact XXXX ), I started to send my payments to SN Servicing.
From the moment SN took over my mortgage, they claimed I was months behind on my payments, and then XXXX started with his harassments. I was making monthly payments now of {$2000.00} and XXXX claimed he never received the funds, even though the money was taken out of my account.
I now received a foreclosure notice on my primary and only home, and I don't know how to deal with this. SN has sent the foreclosure notice to my father in laws house last night at XXXX XXXX. The person showed up in my bedroom to deliver these documents. when I threw him out he cursed and threatened me.

SN Servicing Corporation is a debt collector who must maintain reasonable procedures for determining the statute of limitations applicable to a debt it is collecting and whether such statute of limitations has expired. In the State of New York, the promissory note and mortgage are contracts, and there is a six-year statute of limitations law in effect. The last payment made on the subject account according to SN Servicings internal records was XX/XX/XXXX.
SN Servicing became the servicer of the subject account on XX/XX/XXXX and XXXX XXXX XXXX XXXX XXXX as XXXX XXXX XXXX XXXX XXXX XXXX became involved via Assignment of Mortgage XX/XX/XXXX. The New York XXXX XXXX XXXX XXXX XXXX states in debt collection rule 23 NYCRR 1, Section 1.3, SN Servicing Corporation is required to inform me that the statute of limitations has expired. The Fair Debt Collection Practices Act, 15 U.S.C. section 1692, et seq strictly prohibits debt collectors from seeking payment on legally time-barred debts.
A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of a time-barred debt. Nor may a debt collector use unfair or unconscionable means to collect or attempt to collect a time-barred debt. It is also a violation of the FDCPA for a debt collector to bring or threaten to bring legal actionwhether explicitly or implicitly against a consumer to collect a time-barred debt ( 12 CFR 1006.26 ; see generally 86 Fed Reg 5766, 578182 [ describing CFPB interpretation of this rule ] ).
SN Servicing Corporation has deliberately refused for years to inform me of the disclosure or disclaimer about the statute of limitations being expired as required by the New York XXXX XXXXXXXX XXXX XXXX debt collection rule 23 NYCRR 1, Section 1.3XXXX, despite many written requests.

WE HAVE DISPUTED THIS, OVER AND OVER BUT THEY KEEP DELAYING AND WILL NOT PROVIDE CONTACT NAME AND DETAILS OF OWNER OF OUR MORTGAGE.

I am writing to bring to your attention a matter of grave concern regarding a potential violation of Regulation X by SNSC SERVICING CORP. I represent the homeowners XXXX and XXXX XXXX in the aforementioned case as the short sale negotiator. It has come to our attention that a foreclosure auction has been scheduled for XXXX XXXX despite the fact that a short sale review was currently in process and acknowledged by SNSC SERVICING CORP. In my communication with the servicer back on XX/XX/year> I was advised that the short sale file would be reviewed and I was given a list of documents to be submitted for the review. After we received an offer on the property I submitted the contracts and HUD on XXXX XXXX. I was asked for an explanation of certain figures on the HUD by the SNSC representative ( XXXX XXXX ). I advised her that we were only waiting for the full title report to come back so we can have the exact tax figures to put on the HUD. All the while that these negotiations and communications were ongoing SNSC was planning the foreclosure auction and continued the court case and failed to inform their Bank Attorney ( XXXX XXXX XXXX ) that they are in negotiations and to place a hold on the case. Instead they took it upon themselves to clearly violate Section 1024.41 of Regulation X. As you can see from the emails communications attached, the fact they were in negotiations on the short sale request is not in doubt. What is baffling is the fact that they were being lied to and led to believe that there were actual negotiations when in all essence SNSC had planned all along to auction the home and not act in good faith.
1. XX/XX/year> my 3rd party authorization emailed to SNSC with Acknowledgement of receipt by XXXX XXXX XXXX XXXX. XXXX XXXX XXXX advised what was needed for short sale review 3. XX/XX/year> Short Sale documents submitted ( contracts, HUD, MLS ( Listing agreement ) 4. XX/XX/XXXX SNSC indicated that the short sale offer was going to be submitted 5. XX/XX/XXXX short sale rejected by investor as per XXXX XXXX 6. XX/XX/XXXX Advised by XXXX XXXX that I could appeal to her supervisor XXXX XXXX 7. XX/XX/XXXX Appeal email sent to XXXX XXXX who acknowledge receipt and that she would reach out to the investor for a 2nd review.
8. XX/XX/XXXX XXXX XXXX advised that investor is staying with the denial.
9. XX/XX/XXXX NOTICE OF SALE is uploaded by court to the STATE UNIFIED COURT 10.XXXX XXXX homeowners call me to tell me that they received in the mail a NOTICE OF SALE and were actually in shock All events above documented via emails attached to this complaint. From XXXX XXXX to XXXX XXXX we were actively engaged in a short sale review at the same time SNSC and their attorneys were still filing motions and judgments of foreclosure and sale submitted on XX/XX/year>.
As you can see from the above chain of documented events SNSC was in clear violation of Regulation X dual Track Foreclosure laws in that they were secretly scheduling the auction of this properly all the while giving us false and misleading information as if they were in fact negotiating with us in good faith. I would ask the court to impose severe sanctions against this servicer as a means to deter them from this illegal act to other homeowners. To not impose heavy sanctions upon SNSC would give them free rein to continue with this illegal act and to steal homeowners homes with no recourse. I would also ask for your honor to also order them to conduct a meaningful short sale review and to actually submit documents to the investor.
The offer that was submitted to the SNSC was rejected and the SNSC agent indicated that they wanted an amount that was in excess of fair market value. The agent from SNSC indicated that they do not go by appraised value. The submitted offer was only $ XXXX under the attached independent appraisal report. After the rejection on XX/XX/year> we offered to come up in price the extra $ XXXX to give them full market value to match the independent appraisal report. Again XXXX XXXX advised that the offer would still be rejected without ever going back to the investor with that new higher offer amount.
We have been processing this short sale in excess of the 30 or 35 days prior to the sale as required under dual track foreclosure laws.
Regulation X, implemented by the Consumer Financial Protection Bureau ( CFPB ) pursuant to the Real Estate Settlement Procedure Act ( RESPA ), governs the handling of mortgage servicing, including loss mitigation and foreclosure proceedings. It establishes certain rights and responsibilities for both borrowers and servicers, with the objective of promoting fair and transparent practices in the mortgage industry. RESPA supersedes state law via the Supremacy Clause of the United States.
Section 1024.41 of Regulation X specifically addresses the procedures and requirements for evaluating and responding to borrowers loss mitigation applications. It stipulates that once a complete application is received, the servicer must acknowledge the receipt in writing within five business days. Furthermore, the servicer is required to exercise reasonable diligence in obtaining all necessary documents and evaluating the application for a loss mitigation option. During this review process, foreclosure proceedings, including the scheduling of an auction date must be stayed.
These actions by SNSC SERVICING is the textbook scenario why Dual Track Foreclosure laws were enacted. To stop banks from selling a homeowners home while at the same time reviewing them for work out options.
The failure to cancel the auction and to complete the short sale review directly contradicts the spirit and intent of Regulation X, which aims to provide homeowners with a fair opportunity to explore loss mitigation options before facing the dire consequences of a foreclosure auction.
I write this letter in a good faith attempt to have the foreclosure auction date removed and for the short sale to be reviewed again in a fair and amicable manner
