Citation text line 29 CFR 1926.652(a)(1): Each employee in an excavation were not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) Hearthstone Village Site - New York State Route 59 and Augusta Avenue, Monsey, NY - North Side of Excavation for Building A: Employees were exposed to a potential cave-in when positioning posts next to the bottom of an unprotected excavation wall which ranged from approximately 27 feet to 37 feet in height and were not protected by an adequate protective system designed in accordance with paragraph (b) or (c) of this section; on or about 3/15/16 to 3/16/16. b) New York State Route 59 and Augusta Avenue, Monsey, NY - Upper Level along the North West Side of Excavation for Building A: Employees were exposed to a potential cave-in when placing snow fencing and metal stake(s) next to the bottom of an unprotected excavation wall which was approximately 12 feet in height and were not protected by an adequate protective system designed in accordance with paragraph (b) or (c) of this section; on or about 3/15/16.
