15 U.S.C 1681 Section 602 A states that I have right to privacy.
15 U.S.C 1681 Section 604 A Section 2 : It also states a consumer reporting agency can not furnish an account without my written instructions.
15 U.S.C 168b A Creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any reason.
Because of your inaccurate statement of my credit record, I am suffering damages including the inability to obtain credit. You have failed to comply with the law and must remove the items from my report immediately. If these late payments are not removed within 7 business days, I will have no choice but to report you to the Federal Trade Commission and advise them of your disregard for Consumer Protection laws.

Re : Dispute of 30 day late payment for fraudulent lease extension on BMW Lease To whom it may concern : I am writing to request an investigation into the fraudulent activity that occurred on my account resulting in a 30 day late payment on my credit report.
I leased a XXXX XXXX XXXX from BMW Financial for a period of 36 months ending XX/XX/XXXX.
I returned the car at the end of the lease having made every single one of the XXXX payments on time as my account was on autopay.
In the first week of XX/XX/XXXX I was notified by a credit monitoring service that my score had dropped due to a negative mark on my account. When I checked my credit reports I saw that my lease term had been changed from 36 months to 38 months and that the XXXX payment was showing a 30 day late payment.
Since there should not have been a XXXX or XXXX month I called BMW Financial Services who advised me that I had extended my lease over the phone.
I have called multiple times since and have advised them that if someone extended the lease over the phone it was certainly not me. I was eventually advised to send my dispute in writing.
On XX/XX/XXXX, I spoke to XXXX in the Lease End Department at BMW Financial, who told me that the lease was extended on XX/XX/XXXX, long after I had returned the car. He also told me that the payment of {$2300.00} for the fraudulent 2-month lease extension was made from a XXXX checking account with an account number of XXXX. This is not nor was it ever my bank account.
I assume the leasing broker or someone related to the dealer impersonated me to extend my lease for one reason or another as I have attained a copy of the odometer statement used to turn in my car which was not filled out by me, and has a fraudulent signature that is not mine.
I suggest that BMW Financial listen to the recording of the phone call when my lease was supposedly extended and compare it to other phone calls of me calling in, it will be evident that it was not my voice doing the extension.

I have been a BMW customer for over XXXX years with no late or missed payments. I was in the process of leasing my XXXX bmw and each time more expensive. This payment was agreed to be XXXX with the agreed terms that I will return the current lease and all lease end charges for that car will be negated since I am leasing a new 2021 car from them that is more expensive than the one I am returning. They agreed that this deal was fair. I signed the paperwork and I was on my way.
A few months later I get a statement for {$1000.00} dollars for the car I have returned and was told that I must pay this lease end payment. This was completely incorrect and not the deal that was made with BMW when I signed a new car lease. After multiple back and forth with them they decided to proceed with harassing me to pay this lease end payment. When I asked for paper proof of the statement they sent me a letter ( attached below ) and the amount was for {$680.00} dollars. Once again their financial services account says {$1000.00} and the paper statement from bmw financial services says {$680.00}. They are sending misinformation and providing me different amounts to pay. I am worried about my future and my credit score/report. I have always paid my bills and do pay my bills on time. I have never missed a payment to BMW financial services or any other credit card company. They are trying to XXXX my reputation as a good citizen and paying my bills. Please assist me in removing this from my report. I do not deserve this as a customer and as a citizen of this country.

My car was stolen in the first quarter of XXXX. My insurance has already compensated bmw Financial for the vehicle, and there is no remaining balance. However, the account is still showing as active with balence on it. I have reached out to the bmw financial to change the account as fully paid of and it was in good condition, but they also confirmed closed but they haven't reported the issue to the credit bureau. Also, I have change my name due to identity theft to XXXX XXXX. Please help me resolve this issue, as I am unable to obtain another loan due to this situation.

BMW I took over a lease and BMW did not disclose the TAX that would be assessed. The original Lessor paid the entire tax at the start of the lease.
I took the lease over so as to save money on deposits and tax charges.
BMW advise that once I assume the vehicle I would just continue to make the monthly payments.
I received a bill for {$700.00}. BMW has yet to provide any paperwork reflecting the TAX charges. When I spoke to the BMW supervisor I advised him that I have assumed many cares in the past and have never paid the tax, When asked why BMW didnt disclose this information when signing the lease assumption? His reply was '' we didn't know how much tax would be charged ''.
With the original lease the entire breakdown of the charges including the tax was listed. One my lease assumption for it had the only mention of charges for Registration, Tax, Insurance etc. When reading the paperwork it suggests the tax on REGISTRATION.
I demanded the {$700.00} be rescinded since it was not disclosed. The BMW rep advised that if I did not pay it I would be placed in collections. I paid the {$700.00} and demanded a Supervisors call back. To date no return calls were received. When call back to check the status of the call back, The reply was no one will call since there is nothing to discuss.
Please look into the matter. If need be I have full recordings of the conversation and all paperwork.

We leased a new BMW on XX/XX/2020. Then COVID-19 happened. My husband is an XXXX and became completely consumed with responding to COVID calls around the clock at the height of the pandemic in our area. In addition, we both had to work remotely, adjust our family with XXXX kids learning remotely etc.
We had a major delay in getting all mail that was to go to my husband 's office, and mail in general. Due to this chaos of the situation, I missed payments on the BMW. Once I realized that I missed payments, I paid all in full.
Here are dates of payments : XX/XX/2020 we picked up the car from the dealership XX/XX/2020 made a payment of {$440.00} XX/XX/2020 payment made of {$1300.00} ( three payments ) XX/XX/2020 payment made of {$440.00} XX/XX/2020 autopayment made of {$440.00} XXXX after this date monthly payments have gone through automatically. ) I also found out that BMW made a report to the credit agencies right away which severely damaged our credit, making financing no longer an option. We had a loan in the works which we no longer could get.
I contacted BMW multiple times, and they stated they called us ten times to my husband 's office, which we have no record of at all. This was being monitored as part of his work so it was very concerning that they stated this. In addition, I have record of delays in the mail from when I sent a letter to BMW and it took almost a month to arrive.
As it was clear we were responding to a global pandemic, and not trying to get out of payment, I was hoping BMW would reverse the report on our credit. I sent multiple letters to BMW and later tried to access their Consumer Complaint Department. I was denied any assistance each time.
I will upload all correspondence, copy of statement from BMW, copy of statement from XXXX XXXX showing payments, photos of credit scores and documentation of delay in mail.

I requesting the help of the CFPB and the United States Government to help protect me from the fraud and criminal acts in which BMW Financial Services is manipulating the COVID-19 pandemic to charge for false and unsubstantiated fees while not meeting with me in person to inspect my vehicle, but sending a bill 100 % false claims and having their customers service representatives serve no value if standing behind fraudulent claims.
I feel completely helpless throughout this entire process. I leased a XXXX vehicle, took meticulous car of the leased vehicle, including having the XXXX dealer perform every service / maintenance, including purchasing all 4 brand new tires from the XXXX dealership during my lease on XX/XX/XXXX. As you will see per the attached documentation, I returned my lease approximately XXXX miles later, while having BMW Financial Services charging me for another 4 brand new tires ... this is simply fraud and should be considered a criminal act committed by BMW Financial Services. At the end of my lease, I was informed that I would be charged a fee if I chose to not continue leasing a XXXX vehicle. In order to avoid paying a fee, I decided to stay with XXXX to lease another vehicle ( which I did on XX/XX/XXXX ). On XX/XX/XXXX, I returned the XXXX lease ( that was due on XX/XX/XXXX ) and moved forward with a new lease for a XXXX vehicle. The lease of the new vehicle went extremely smooth and I could not be happier.
Leading up to returning the XXXX lease and on the day I returned the vehicle on XX/XX/XXXX, I was informed by BMW Financial Services that due to COVID-19 inspections could not be scheduled and that I would just need to return the vehicle to the dealer and they would conduct the inspection at a later date. As recommended by the dealership, I took pictures and video of the meticulous condition in which I returned the XXXX vehicle to the dealership.
Per the attached documents and phone calls with the BMW Financial Services, they have completely false and outlandish claims that there is {$1400.00} in glass damage, the car requires a new bumper, requires 4 new tires, windshield sensors and additional maintenance in which all totaling an amount due of {$4700.00}. Upon the CFPB receiving my attached document and pictures, you will clearly see how this is fraud. A company in the United States of America should not be able to continue doing business upon being proven guilty of such fraud. This is an outrage and blatant case of fraud during a time that the entire population feels helpless due to COVID.
I am attached pictures of the XXXX the day I returned the vehicle to the XXXX dealership. I have a video that I can also share upon aligning on how to share it with the CFPB.

Since XXXX of 2020 I have been trying with BMW to get a payment made on XX/XX/2020 posted to my account. I have called them numerous times and I have not gotten any results. they are still researching it. It is now XX/XX/2020.
I spoke to XXXX today in collections at BMW finance and he said that he could not locate the payment. He said my request is still open. On XX/XX/2020 I spoke with BMW Finance and was told to send a copy of the proof of payment from my bank to XXXX. I also faxed the proof of payment to BMW Finance on XXXX XXXX and spoke to XXXX who told me to fax it and it would be resolved within 48 Hours. See attached. The proof of payment shows that the check was sent by my bank on XX/XX/2020, that expected delivery would be XX/XX/2020 and that the check was cashed on XX/XX/2020. I keep being told by BMW finance that this was to be resolved with 48 Hours. That never happened.
Also on XX/XX/2020 spoke to XXXX at BMW Customer escalations and he said that there is an SR open looking into the complaint. XXXX looked again and found my faxed proof of payment but still could not confirm that the payment had been applied to my account.

We had a lease XXXX XXXX with BMW Financial Services, which we were making all our payments on time. Then the car was part of a XXXX which XXXX XXXX considered a " XXXX XXXX '' and they were paying BMW Financial for the vehicle. This was around XXXX XXXX XX/XX/XXXX time frame. I never heard back from BMW Financial from that day on. So in XX/XX/XXXX, we returned my wife 's XXXX XXXX lease to the dealership, and on XX/XX/XXXX we received our final billing of the lease which I called in the same day to pay off, after paying off my wife 's lease with XXXX, the representative asked if I was interested in paying off my other lease, I told him I did not have a lease with XXXX, that my XXXX was owned by me. He said there was a balance due for the XXXX XXXX that was totaled in the accident. I total him that XXXX XXXX paid it off, and he replied that their was still a balance for overage of mileage and lease turn in fees. I asked why no one called me, or emailed me, or sent a letter, he told me that a letter was sent out in XXXX, and I told him I never got it. I asked if it was sent certified mail or by XXXX or XXXX, in which he stated was just regular mail. I said ok, well what is the balance and paid him that day in full. I decided to pull my credit report and noticed that BMW financial reported to my credit bureaus agencies that I missed over 12 months of payments, and my account was in collections. Now how can some company report that I missed payments without sending me a bill each month? Or any type of letter of the debt I owed? XXXX is saying they sent a letter, but have zero proof of this letter being sent, no tracking nor certification of delivery. In read some credit laws, I thought New York and Florida laws stated a creditor must send their clients a bill at least quarterly of the debt owed to them. I never even got one letter but they said they did just 1 letter, plus my account was sent to collections but I never got a call, email, or letter of a collection going on.
I think BMW Financial Service has the responsibility to show their clients actual proof that they sent a bill, invoice, or letter of the debt to their customers, and not by show us a copy of the letter. There is zero proof it was mailed and zero proof that I received one. I never missed a payment in my life and now this is affecting my credit score. I tried going through credit bureaus and better business bureau and XXXX response is they sent a letter once and its a courtesy if they want to contact me about a past due balance. If that is true, then how can they report missed payments each month to the bureau.

My complaint is against BMW of the XXXX XXXX in XXXX XXXX New York. I feel I was swindled out of my cars that I traded in to purchase another car, One was a XXXX XXXX with XXXX miles on it, and the second was a XXXX XXXX XXXX ( which was my Daughters car ) and it also had a low mileage. However, By misleading advertising and showing me copies of other cars that were going for that price .... I didnt recognize the problem until after I made the purchase and I have not been able to communicate with them. They are refusing to answer my phone calls and to set up a meeting to discuss this issue. I have the documents that show the price of the cars that I sold to them well way undervalued. They sold me a car for {$41000.00}. Yet they gave me {$14000.00} for a XXXX that was only 2 years old, and I paid almost XXXX when I purchased it for my daughter.
I was showed a false advertisement of another car that value was that amounts. Which they put off on me as if it was my car. They still have it on all mystatements as a XXXX XXXX XXXX, with over XXXX miles on it. And thats where they came up with that number. I was confused, I was rushed, I didnt read everything through because of the pressure I felt I was under. And when I went back to swap back out the deal they refused to even speak to me at that point. I felt I was scammed, swindled, information was ' mis represented t to me. Yet I feel now they are avoiding and ignoring me and refusing to discuss it. So I have tried everything to settle this matter I still have the car I wanted to back out the deal with ; the XXXX. In XXXX I was a victim of identity theft and 2 cars were taken out in my name by an unknown person/s. The vehicles were taken out by different banks in two different dealerships. When I notified both companies. BMW Financial Services a.k.a XXXX XXXX XXXX XXXX XXXX and XXXX XXXX a.k.a XXXX XXXX XXXX they did nothing to help rectify the credit reporting or clear my name. Fast forward to XX/XX/XXXX, 5 credit inquiries were done under my name without my consent by one dealership to 5 different banks. My credit score is being tarnished by all these negative credit reports and inquiries. XXXX XXXX, XXXX and XXXX all refuse to remove it from my credit report because its not up to them but to the companies running my name and information.

I received the lease end bill from BMW via certified mail. There is a {$250.00} charge for what i believe is a missing second key. This was on the initial inspection because I didnt have the spare key with me at the inspection prior to returning the vehicle. Upon returning the vehicle at the BMW dealership, i returned both keys and have a receipt which i assume was forward to BMW financial services.
I called the " End of Term Specialists '' as detailed in the letter i received certified mail on two occasions only to be put on " perma-hold ''. I was never able to speak to anyone. I then called a woman named XXXX at BMW whose number I retained from my last CFPB complaint which she finally did resolve ( she admitted BMW was at fault and resolved the matter only because of the complaint ).
XXXX could'nt get me to the appropriate department but promised that she would get them to return my call. No calls from anyone. I believe this is a common practice at BMW financial services and nothing is being done to prevent this.

Without prior notice or any communication the XXXX XXXX stop taking the Installments from my Bank. I been trying to contact with the XXXX XXXX to understand the situation but unable to contact.
On XX/XX/XXXX early morning I found my car is missing. I reported the Police as my car was stolen. And with the help of Law enforcement agency I later found my car was towed away by the Finance Company and getting ready for re-sale. The repositioning authority did not co-operate the situation. No letter or further was provided by the authority as of today.
The huge emotional, social harassment and inconvenience is not acceptable to any customer. The is against the business ethics and violating consumer right. Please help and take necessary action. This will completely ruin my credit line.

On XX/XX/2018 I traded my XXXX XXXX XXXX for a XXXX XXXX XXXX.
I had to drive from XXXX New York to XXXX New Jersey to get jerked.
I gave them my XXXX and {$13000.00} plus came back a second time just to personally deliver the title for my XXXX and still havent received anything that I was promised.
I was told I was going to receive a check for my first months payment an extra key for my vehicle two new back tire so I can pass inspection and my tile for the vehicle I am financing so I can register it.
I spoke to two sales person in person XXXX ( manager ) and XXXX. And when I call I get the runaround from the secretary XXXX and the business manager XXXX. I call every day to their DMV department and speak to XXXX which is the manager and XXXX. I shouldnt have been so stupid in the beginning but I am waiting For about a month for title that isnt being sent over basically Im paying for someone elses car. Temporary plate is expired so I cant even drive the car By the way Im XXXX so I had to switch my hair control and pay for them out of my pocket {$800.00} and I have a document for everything

I returned my mini cooper XXXX on XXXX/XXXX/XXXX and was recently contacted by MINI that upon my lease end inspection I owe a staggering amount of money. They charge a flat fee of {$750.00} for having the service light on even though I took my car in for its annual service and was only within XXXX miles of needing service. I did not even know the service was due having had gone into the digital menu to check. They charged me {$950.00} for external " hail damage '' to my car, the pictures that were provided do not clearly show the " damage ''. Since getting my yearly inspection I would think my tire tread would have been checked and replaced if not having met requirements but instead they charged me {$200.00} because my tire tread was not thick enough, even though I was significantly under my mileage requirements. I believe I am overpaying and will have a hard time affording this extra monthly bill.
