Citation text line 29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary. a) On or about 10/21/13, in front of the Dollar Tree store at the Southgate Plaza, 952 Union Rd., West Seneca, NY: Masonry type fabricated frame scaffolding, two sections high, was erected so that employees could apply plaster to the exterior front of the canopy. The platform in two seperate areas on the top level of the scaffolding consisted of three wooden 2x12 OSHA planks, leaving a gap of approx. 24 inches between the uprights of the 60 inch wide scaffold. One employee applying plaster, and another employee walking back & forth on the top level of the scaffold were exposed to a fall of approx. 13 ft. off the frontside (north side) of the scaffold platform because the scaffold was not fully planked between the uprights. b) On or about 10/21/13, in front of the Dollar Tree store at the Southgate Plaza, 952 Union Rd., West Seneca, NY: Masonry type fabricated frame scaffolding, two sections high, was erected so that employees could apply plaster to the exterior front of the canopy. The platform in two seperate areas on the lower level of the scaffolding consisted of one wooden 2x12 OSHA plank, leaving a gap of approx. 48 inches between the uprights of the 60 inch wide scaffold. One employee applying plaster while standing on that single plank was exposed to a fall of 6 ft. 8 in. off the frontside (north side) of the scaffold platform because the scaffold was not fully planked between the uprights. Citation text line 29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. a) On or about 10/21/13, in front of the Dollar Tree store at the Southgate Plaza, 952 Union Rd., West Seneca, NY: Masonry type fabricated frame scaffolding, two sections high, was erected so that employees could apply plaster to the exterior front of the canopy. Employees were exposed to a potential fall of up to 13 ft. while accessing the first & second levels of the scaffold by climbing the end frames of the scaffold. The end frames were not designed & constructed for use as ladder rungs. No ladder or other safe access was provided. NO ABATEMENT CERTIFICATION REQUIRED

Two seperate areas on the top level of the scaffolding lacked guardrails. One employee applying plaster, and another employee walking back & forth on the top level of the scaffold were exposed to a fall of approx. 13 ft. off the frontside (north side) of the scaffold platform because no guardrails or other fall protection system was installed to protect the employees. NO ABATEMENT CERTIFICATION REQUIRED
