29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) On or about 10/05/16, in a trench/excavation in front of 260 George Urban Blvd., Cheektowaga, NY : An employee engaged in a sewer line repair was working in a trench that was 9 ft. 4 in. deep and was not wearing a hardhat. The employee was in the south end of the trench crouching down and holding a vertical hose. There were loose stones, large clumps of soil, shovels, and other tools that could fall into the trench and strike him. NO ABATEMENT CERTIFICATION REQUIRED |

29 CFR 1926.652(a)(1): 29 CFR 1926.652(a)(1) Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) On or about 10/05/16, in a trench/excavation in front of 260 George Urban Blvd., Cheektowaga, NY: Two employees were working in a trench/excavation where a break in a lateral sewer line was being repaired. The trench was approx. 5 ft. 2 in. wide x 10 ft. 8 in. long x 9 ft. 4 in. deep. The east and west banks of the trench were almost vertical. At the south end, the road was undermined.The employees were not protected from a cave-in hazard by an adequate protective system. NO ABATEMENT DOCUMENTATION REQUIRED |

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about 10/05/16, in a trench/excavation in front of 260 George Urban Blvd., Cheektowaga, NY : Two employees engaged in a sewer line repair were working in a trench that was 9 ft. 4 in. deep without any cave-in protection. The employees were not trained to recognize potential hazards on this type of jobsite, including but not limited to cave-in hazards, proper access to excavations, spoil pile hazards, the need for personal protective equipment such as but not limited to hard hats, traffic control/work zone safety, and the applicable OSHA regulations to control or eliminate these hazards. 29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder: a) On or about 10/05/16, in a trench/excavation in front of 260 George Urban Blvd., Cheektowaga, NY: Two employees were working in a trench/excavation where a break in a lateral sewer line was being repaired. The trench was approx. 5 ft. 2 in. wide x 10 ft. 8 in. long x 9 ft. 4 in. deep. A portable ladder was placed in the trench on the east side, and the employees used this ladder to access and exit the trench. The siderails of the ladder were only 9.75 inches above the top of the trench, and it could not be extended higher because of the length of the ladder. However, the ladder was not secured at the top, and a grasping device such as a grabrail was not provided to assist employees in mounting and dismounting the ladder. Additionally, the ladder was defective in that the second rung from the top was missing. NO ABATEMENT CERTIFICATION REQUIRED |
