29 CFR 1910.1001(j)(3)(i): The building owner, facility owner, or employer did not determine the presence, location, and quantity of ACM or PACM at the worksite and did not exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of asbestos-containing material (ACM) and presumed asbestos containing material (PACM): a.) Telesca Center for Justice Building at One West Main Street, Rochester - On or about 5/30/14, prior and continuing, employees of ABBA, L.P., including maintenance technicians, work in and throughout the building including the 11th floor mechanical room penthouse performing a variety of tasks including dry sweeping of floors below asbestos-containing materials; painting of the floor below asbestos-containing materials; emergency clean-up of asbestos-containing materials; and, flooring care of presumed asbestos-containing flooring. The building owner/facility owner did not determine the presence , location and quantity of ACM or PACM at the worksite and did not exercise due diligence in complying with the requirements to inform employers and employees about the presence and location of asbestos-containing materials (ACM) and presumed asbestos containing materials. b.) Union Trust Building at 19 West Main Street, Rochester - On or about 5/30/14, prior and continuing, employees of ABBA, L.P., including maintenance technicians, work in and throughout the building including the mechanical room(s) performing a variety of tasks including dry sweeping of floors below asbestos-containing materials; and, working on and around PACM/ACM materials associated with the HVAC system.
