29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: Location - 53 Stevens Avenue, Suite 1, Mt. Vernon, NY 10550 a) On or about April 18, 2022 the employer did not develop and implement a written respiratory protection program. The employer provided and required employees including, but not limited to, dental assistants to wear respirators throughout their shifts while potentially exposed to suspected and/or confirmed COVID-19 positive patients. Note: Because abatement of this violation is already documented in the casefile, the employer need not submit certification nor documentation of abatement of this violation as normally required by 29 CFR 1903.19. |

29 CFR 1910.134(f)(2): Employee(s) using a tight-fitting facepiece respirator were not annually fit tested while performing aerosol-generating procedures. Location: 153 Stevens Ave, Suite 1, Mt. Vernon, NY 10550 a) On or about April 18, 2022, the employer did not provide an annual fit test to employees including, but not limited to dental assistants, who are provided and required to wear an N95 respirator. The employees are required to wear N95 respirators to protect against the SARS-CoV-2 virus while performing aerosol-generating tasks including, but not limited to high evacuation suctioning. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item, failure to comply will result in an additional penalty of $1,000.00 as per 29 CFR 1903.19. |
