29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: a) On or about 8/19/14, outside, in the area between the back (south) side of the Victorinox and Coach Mens stores at the Fashion Outlets of Niagara Falls, 1900 Military Rd., Niagara Falls, NY: A Louisville extension ladder was placed on the ground and spanned a 6 ft. deep excavation. A 44 inch long piece of one quarter inch plywood was laid across the siderails of the ladder at the east end of the extension ladder. An unopened 4 ft. Werner stepladder was set on the piece of plywood with the top of the stepladder inclined and laid against and inside the bottom of an open electrical box mounted on the wall of the building. An employee was standing on the 2nd rung of the stepladder pulling wires, and was exposed to an 8 ft. fall into the excavation below. The extension ladder and the stepladder were not designed to be used for these purposes. NO ABATEMENT CERTIFICATION REQUIRED |
