I received a letter from New American Funding regarding refinancing FHA streamline for a reduce interest rate XXXX XX/XX/XXXX I contacted New American Funding and spoke with XXXX XXXX about the letter I received, he explained the FHA streamline program and said he did not have to pull my credit, he said he will run the numbers and get back to me by end of day. There was not a follow-up call from XXXX XXXX XXXX XX/XX/XXXX hours later I received a call from XXXX XXXX stating that he would provide some feedback by end of day, there was no follow-up call. On XX/XX/XXXX, I received notification from XXXX and XXXX XXXX that New American pulled my credit, completely not authorized by me. On XX/XX/XXXXXXXX I contacted New American Funding to file a compliant about XXXX XXXX, the representative asked that I contact XXXX XXXX 's supervisor XXXX XXXX. I contacted XXXX XXXX on XX/XX/XXXX and XX/XX/XXXX he never returned my calls. On XX/XX/XXXX I spoke with XXXX from the corporate office to file a complaint, I told XXXX XXXX XXXX was not authorized to pull my credit because he said it was needed to run the numbers. I also asked XXXX to pulling the phone recording as confirmation, I have not heard from XXXX.

On XX/XX/23 I requested information on a HELOC through XXXX, indicating my desired loan amount, credit score of approximately XXXX, and state of the house. This lead me to their approved partner, New American Funding, indicating that the could fulfill my request. Immediately following submitting my information, I received a phone call from their business, in which I was asked a few questions, I restated that I was looking for HELOC, the amount, my credit score of approximately XXXX, and other personal information. At this point they requested that I submit a full credit application for a hard inquiry. I had already stated both in writing and verbally that my credit score was approximately XXXX, which after the full credit inquiry, was determined to be accurate by averaging the 3 bureaus. However at that point, they stated they would not be able to provide a HELOC as my score was lower than the allowed minimum of XXXX for that financial product, but they were able to provide me with a refinance for my mortgage. At several points I had confirmed not only that my credit score, but also that I was not interested in a refinance, only a HELOC. This constitutes several counts of fraud to obtain my personal and financial information under false pretenses.

Company waited 51 days after credit pull and 4 days before closing to deny me access to my credit which prevented me from closing on my home. They stated the denial reasons as a foreclosure or mortgage obligation, none of which is listed on my credit report. They also state " other criteria '' and " investor guidelines '' in their denial letter and email correspondence, which are not valid criteria in a consumer credit transaction and are discriminatory. I have also indorsed many documents, given securities, and given access to my estate, and I have not been compensated for my security instruments or my equity in this transaction. In their unfair and deceptive tactics, New American Funding has : 1. Denied me credit based on " other criteria '' and investor guidelines which constitutes discrimination. [ See XXXX-New American Funding Email XXXX and [ See XXXX-New American Funding Email XXXXXXXX ] 2. Denied me based on evidence I have not seen and evidence not on my credit report.
XXXX. Refused me access to the full report which took away my right to dispute any inaccurate information. [ See XXXXNew American Funding Email XXXXXXXX ] XXXX. Committed securities fraud by taking in a security loan against my personal property and not compensating me. They are also masking themselves as creditors in order to strip me of my status as principal and my entitlement to the proceeds funded by the consumer/commercial paper.
5. Not giving full disclosure on whether loan number XXXX and XXXX listed on the denial letter and other documents are active loans or loans that were denied. [ See XXXX-New American Funding Email XXXXXXXX ] XXXX. Refused to answer whether any funding has been received, moved, or transacted on behalf of the principal XXXX XXXX.
7. Pressured me to commit identity theft in order to provide proof of their claim.

I have given permission on XX/XX/2021 to this company ( New American Funding ) to pull my credit for a pre approval to buy a house. And my credit was pulled the same day for this purpose.
My credit was pulled on XX/XX/2021 without my permission for the second time. When asked why the rep stated they have done a mistake on the first time.
My complain is about the second credit pull.
I did not authorize a second credit pull and their mistake will impact me when I'm closing on a house within this month and also in the long run also. ( second credit pull was outside the 14day window for this purpose and simply un authorized ) I have respectfully asked the loan consultant to remove the second credit pull to correct their own mistake. They have refused to do so. ( asked twice via email ) Also I have not received any type of pre approval from the first credit pull even though I have provided all docs they have asked

There seems to be an error on my consumer report furnished by XXXX XXXX XXXX XXXX And New American funding. On my consumer report, there is a late payment and Fraudulent items on my credit report which is causing me damage to me as a consumer and limiting my ability to extend credit. I allege that ( company name ) is willfully and knowingly furnishing inaccurate information and defaming my character as a form of extortion. According to 15 U.S. Code, A creditor may not treat a payment on a credit card account under an open-end consumer credit plan late for any purpose. According to 12 CFR Appendix B to Part 1022 I never received any the model notices stating that any negative information would be furnished to my consumer report. Why is this inaccurate information being reported when I have never received notice of the information and congress has stated there shouldnt be any late payments? Is ( companys name ) attempting to cause some form of harassment to me and violate my right as a consumer purposely? I was never given a reasonable way to opt or limit sharing my creditworthiness according to their privacy policy. Payment defined under 15 U.S Code 78m Payment is define as commercial development of oil, natural gas, or minerals therefore what form of payment has ( companys name ) has been excepting for the last years of under the United States Code it is define as commercial development of oil, natural gas, or minerals?
Is there a yield of the investment on the account due to me? Has the true nature and fitness of the agreement been provided to me? The inaccurate, false and fraudulent information being furnished on my personal consumer report needs to be corrected immediately as it is causing damage and defaming my character. I am demanding a response within an appropriate time of 5 business days to answer each concern I have raised in this complaint or I allege that there is a due yield of investment that has been misapplied as a billing error and shall be Returned back to me.
