Citation text line OSH ACT of 1970 Section (5)(a)(1): : The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crush injuries. On or about April 24, 2015 Location: 219 East 44th Street, New York, NY a) Employees were working next to the Haib 377 E5 Hipro Knuckle Boom Crane when maintenance was being done and an energy control program was not implemented to control the release of stored energy. As the maintenance was being completed the boom pinned an employee to the cab of the crane. Among other feasible and useful methods to correct the hazard: In accordance with the ANSI A10.44 section 3.1 The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. Or In the Alternative: 29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.
