29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. (a) 2084 Smith Street, Merrick, NY (Worksite), residential home, west side - An employee was cutting and removing the existing roof sheathing along the western side of the second story roof. The employee was using a DeWalt circular saw, without any form of eye protection on, or about March 10, 2014. (b) Worksite, residential home, east side - An employee was installing and fastening new roof sheathing along the eastern side of the second story roof. The employee was using a Bostitch pneumatic nail gun, firing 28 degree wire weld framing nails, without any form of eye protection on, or about March 10, 2014. Note: Abatement for this violation was previously documented; therefore, the employer is not required to submit abatement certification or documentation for this violation in accordance with 29 CFR 1903.19. |

The employee was working at heights ranging between 19.1' (19'-2") and 22.7' (22'-9") above the ground below, without fall protection on, or about March 10, 2014. (b) Worksite, residential home, east side - An employee was installing new sheathing and fascia along the eastern edge of the second story roof, which was a 4:12 pitched roof. The employee was working at a height of 21.9' (21'-11") above the ground below, without fall protection on, or about March 10, 2014. 29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) Worksite, residential home, west side - An employee was removing the existing shingles and roof sheathing along the western edge of the low pitched, 4:12, second story roof. The employee was working at heights ranging between 19.1' (19'-2") and 22.7' (22'-9") above the ground below, without fall protection. The employees did not recognize the fall hazards; were unaware of the procedures to minimize them; and were not provided with fall protection training on, or about March 10, 2014. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation in accordance with 29 CFR 1903.19. |
