Complaint What Happened My wife, XXXX XXXX, and I closed on our co-op on XX/XX/XXXX, with the first payment with Guaranteed Rate due on XX/XX/XXXX. In XXXX, we received notice that our loan processor was changing and payments should be directed to XXXX as of XX/XX/XXXX. We made the XXXX and XXXX payments to XXXX. Sometimes after our XXXX payment was sent, we received notice that our loan processor was once again changing, to XXXX, effective XX/XX/XXXX, but that previous payments would be credited. As yet, neither the XXXX nor the XXXX payments have transferred to XXXX XXXX. After discussing our issue with the loan servicer, we were assured that our credit wouldn't be affected and that we would not receive any additional interest, fees or penalties on our account while it was worked out on their side. However, as of yet only our XXXX payment to the new servicer has been received, which was credited to the XXXX balance. On XX/XX/XXXX, we received XXXX notices, all dated XX/XX/XXXX, threatening foreclosure due to the unpaid balances. At that time, the last email we'd received from the XXXX, XXXX XXXX, was on XX/XX/XXXX. We followed up 3 times between the XX/XX/XXXX email and our receipt of those notices on XX/XX/XXXX. As yet, we have not heard any material updates from XXXX, XXXX XXXX, or Guaranteed Rate. We will be making our XXXX payment in accordance with the terms of our agreement, but have not yet seen the amounts we paid initially for XXXX or XXXX credited to our mortgage, nor have they been credited to our own bank accounts. During this time, my wife 's credit score has dropped over XXXX points despite her being timely in all of her other covenants.

Complaint What Happened My mortgage company incorrectly sent a payment to an insurance company that does not ensure the property that they hold the mortgage for. They basically double-paid for another policy. They used a policy number and amount that correspond to a different policy. They incorrectly paid {$3300.00} out of my escrow account and now won't refund or get the money back. please see attached the policy number does not match this address.

Complaint What Happened I have refinanced our mortgage for a property I own in XXXX RI in XXXX of XXXX. The mortgage was refinanced through a company called Guaranteed Rate ( XXXX ). Our lender prior to that has been XXXX XXXX. Once the refinance went through the mortgage was immediately sold to XXXX. It took XXXX two ( 2 ) months to set up our account during which time we made two payments to Guaranteed Rate using temporary payment coupons. I can provide copies of processed checks for those payments. I can also provide a screenshot of our statements from the previous lender, XXXX, showing that those statements end in XX/XX/XXXX as well as a screenshot of our statements from the current lender, XXXX, showing that those start with the XXXX statement ( due date XX/XX/XXXX ) to demonstrate the gap during which payments were made to Guaranteed Rate. The issue is XXXX says they have no records of those two payments being remitted to them. They sent us a 1098 with 10 months worth of payments and interest because thats what theyre saying we paid. The Guaranteed Rate representatives I spoke with said it looked like the money got stuck in your system somehow which is why we have not received a 1098 from Guaranteed Rate for those payments. After a couple of months of back and forth received a 1098 from Guaranteed Rate showing the interest from the two missing payments and now a representative I spoke with says it does in fact look like the money was never remitted. Problem is I started getting a run around from every representative I spoke with after that. After over 2 month of emails and questions going unanswered they unilaterally closed my ticket with no resolution or refund and the only option they're now offering me is to start a new ticket and the process of looking into it again. To summarize XXXX is still saying they never received those payments and now we have the 1098 from Guaranteed rate for them which means that they did and the money is stuck in their system. This means that Guaranteed Rate is holding two payments in the amount of {$2100.00} each for a total of {$4200.00} I would like to get those payments refunded so I can apply them to our mortgage directly with our new lender but I am getting no feedback or responses from anyone

Complaint What Happened On XX/XX/XXXX I submitted my $ XXXX loan application after paying XXXX in escrow. I applied using the lender that the sponsor wanted me to apply with GuaranteedRate and have been in constant contact with the morgagte consultant in providing them with the documentation they need from me up through XXXX. On XX/XX/XXXX, I get an update from XXXX telling me that my file should be approved this week. Then on XX/XX/XXXX, XXXX tells me " So hold off on binding anything we are having a little trouble with your approval, XXXX is looking into it, and will be in touch. '' I send several emails asking what exactly the issue is but did not get a response.I talk to XXXX over the next 2 week who tells me a different issue holding up the approval : 1. Condo occupancy ( % occupancy ) 2. Confusion about the tax amount amount and asking me what the amount is 3. Telling me that I need to lower the loan amount I am applying for and also pay off my existing credit cards. Okay, call me crazy but if I need X dollars and they are offering me less than X dollars thats essentially a rejection. After finding this out, I immediately contacted my attorney to let them know and also ask XXXX to issue me a formal notice to which he refused. It is XX/XX/XXXX now, 5 days away from closing and I still have not received any formal notificiation ( approval or rejection ). If i don't get this letter, Not only do i lose my 10 % deposit i put down for the house I bought but I also purchaesd something I can't afford. I am a first time home buyer and this has caused me so much stressed over the last 3 week that I haven't been able to sleep and it is impacting my work. Help!!! I had moved to XXXX based on my agent saying this process will close within a month. It hs been over 3 months.

Complaint What Happened I currently have a mortgage for my co-op apartment in XXXX XXXX XXXX with Guaranteed Rate. My difficulty comes in trying to sell the apartment. When we close on purchase of this apartment Guaranteed Rate took possession of the original stock certificate and lease document. This is standard practice for lenders who provide financing for co-ops. Now I'm in the process of selling the apartment. Every step of the process of selling is complete - I have a contract and the buyer is clear-to-close from their lender, however, the closing is being held up on delivery of the stock and lease. The payoff attorney that Guaranteed Rate is using for this deal is the same payoff attorney my previous bank ( XXXX XXXX ) used for the sale of a previous co-op apartment that I owned. This payoff attorney is well respected and on top of sales like this. They submitted the request to Guaranteed Rate to provide the stock and lease documents on XX/XX/XXXX. The bank responded that it would take " about 4-6 weeks ''. This is already a long timeframe to work with - XXXX XXXX returned the documents for my previous sale much faster. I waited patiently and 6 weeks has come and gone. As of today it has been 8 weeks and 2 days since the original request. As I understand banks are under no obligation to return the documents in a timely manner - theres no stated deadline they have to abide by? It seems unconscionable that they can delay the sale by not acting quickly to return the documents. This delay is causing real and potential damage. The longer this delay persists the greater risk the deal is put in. I have until the end of XXXX until the contract expires, but even up until that point there is always the chance for an unlikely event to cause the entire deal to collapse. The real damage Im incurring is the cost of the loan Im still required to pay until the sale is closed. Every day I pay {$48.00} in interest to the bank, and {$51.00} to carry the maintenance and utilities for the apartment. As of the day of this complaint ( XX/XX/XXXX ) Ive paid {$1900.00} of non-principle carrying costs due entirely to Guaranteed Rates failure to return the documents needed to close on this apartment. {$920.00} of which has directly enriched Guaranteed Rate in the form of interest on my loan.

Complaint What Happened I purchased a home and the closing date was XXXX. I was given 2 temporary payment coupons to use until my account was finalized. I sent a check on XX/XX/XXXX for my XX/XX/XXXX payment. The check did not clear and my mortgage was transferred to XXXXXXXX XXXX. I was forced to make another payment to XXXXXXXX XXXX so I would not be in default. That payment was made online on XX/XX/2021. THEN the check cleared from my original lender ( Guaranteed Rate ). That payment was not forwarded to XXXXXXXX XXXX and now I am owed one months payment. I have made all payments to XXXX XXXX since then- on time. I have called Guaranteed Rate customer service over ten times. With long hold times and multiple call transfers.. I even had a conference call with XXXX and Guaranteed Rate on XXXX. The result of which was : " payment transfers can take a long time ''. I can, and will, provide all documentation and notes from ALL of my calls.

Complaint What Happened Dear CFPB : I am writing to file a formal complaint against Guaranteed Rate Affinity regarding their handling of my mortgage application process for the purchase of a condominium at XXXX XXXX XXXX, XXXX, NY. The issues I have experienced relate to predatory lending practices, failure to disclose substantial fees, and the refusal to provide a decline letter, which has caused me significant financial loss. I applied for a loan with Guaranteed Rate Affinity after being declined by XXXX XXXX XXXX and XXXX. I was approved for a mortgage with an initial loan estimate of approximately {$88000.00}. However, just two days before closing, I was presented with a final loan estimate that was more than {$10000.00} higher than the initial estimate. This increase was unexpected, and I did not have sufficient funds to cover the additional amount. Upon consulting with my attorney, we realized that additional fees, including legal fees, had not been disclosed, further exacerbating the issue. I informed Guaranteed Rate Affinity of my financial situation and my inability to proceed. However, instead of declining my loan due to insufficient funds ( which would have allowed me to terminate my contract with the condo seller without penalty ), they pressured me to voluntarily withdraw my loan application. I believe this practice is unfair and caused me to forfeit 50 % of my down payment, as I was unable to secure the decline letter, which was a stipulation in the contract with the seller. I never contacted Guaranteed Rate Affinity to voluntarily withdraw from the loan application, and I would like to know what reasoning they had in asking me to withdraw, rather than reaching out to my lawyer, who should have handled such a critical decision. I feel it is predatory to pressure a borrower into withdrawing from a loan application without allowing proper time for consultation, and I believe Guaranteed Rate Affinity was well aware of the potential harm this could cause. Additionally, I find it concerning that, despite the closing being set for XX/XX/XXXX, I received a call on XX/XX/XXXX from XXXX XXXX, asking if I would like to withdraw my loan application. This call was made while my attorney was on vacation, and no efforts were made to explore all possible options. I question the timing and motives behind this call and the pressure placed on me to withdraw without representation. Moreover, I believe Guaranteed Rate Affinity engaged in predatory lending practices by suggesting that I find additional funds or sell assets to complete the purchase. I was led into a financially precarious situation without being fully informed of all the fees and potential liabilities, which I believe violates consumer protection laws. I am requesting the following actions : An investigation into the lending practices of Guaranteed Rate Affinity related to my mortgage application. A determination of whether Guaranteed Rate Affinitys failure to provide a decline letter and their pressure for me to withdraw my application constitutes a violation of federal lending laws. Compensation for the financial losses I have incurred due to these actions, including the loss of 50 % of my down payment and any associated legal fees. I have attached documentation related to my mortgage application, loan estimates, and communications with Guaranteed Rate Affinity. Complaint What Happened Our loan servicer was Guaranteed Rate ( GR ). We had missed over 90 days of payments and have been trying to set up a loan modification since XX/XX/XXXX In XX/XX/XXXX we were approved for a trial plan, with payments being made XXXX, XXXX and XXXX. We completed the HAMP trial program. However, the only documentation we received from GR was receipt and application of the funds ( not to our outstanding mortgage however ). We found out in XX/XX/XXXX that a modification was approved on XX/XX/XXXX. But before documents were sent for final execution, our loan was transferred to XXXX XXXX ( XXXX ) XXXX on XX/XX/XXXX. We reached out to XXXX on XX/XX/XXXX and they had not received any documentation at all from Guaranteed Rate. About a month later, the original mortgage in default was transferred but no documentation at all related to the modification. I have repeatedly contacted GR ( and documented ) to request that modification information be sent to XXXX since XXXX. XXXX did not receive and to date has not received any information regarding the loan modification trial or approval we went through with GR. I have contacted GR on numerous occasions requesting that they send those documents, and they still have not sent those documents. Therefore we have been accruing additional interest and have not been able to get current on our mortgage. I wrote to GR on numerous occasions requesting they look into the matter. I received a letter in XX/XX/XXXX, XX/XX/XXXX and two weeks ago ( XX/XX/XXXX ) stating that they were researching the matter. However, there has been no further information. I also sent a letter detailing how they had failed to comply with C.F.R. 1024.35 describing the events above and in particular 1 ) Failure to forward relevant documentation and information related to a pending modification 2 ) Payment Errors : About a week later I received the same form letter, to that the matter was being researched. I spoke with a Guaranteed Rate representative on XX/XX/XXXX who informed me that the plan was approved and that this should have been sent to XXXX. The amount was {$4900.00} at 4.75 %. This is nowhere near our trial plan, which was {$4100.00}. Even our original mortgage was ~ {$4500.00} at 4 % which includes taxes, insurance and PMI. Since this was an FHA loan/HAMP, the payment/interest rate should not have been significantly higher than the trial plan. Regardless, none of this information was conveyed to XXXX. After we had completed the HAMP trial program, but before documents were sent for final execution, our loan was transferred to XXXX XXXX XXXX. Plan was approved XX/XX/XXXX and transferred on XX/XX/XXXX. We reached out to XXXX on XX/XX/XXXX and they had not received any documentation at all from Guaranteed Rate. About a month later, the original late mortgage was transferred and no documentation at all related to the modification. I have repeatedly contacted GR ( and documented ) to request that modification information be sent to XXXX. As of today, XXXX XXXX at GR, via a representative informed me that documents were in preparation for modification ( XX/XX/XXXX ) when loan was transferred ( XX/XX/XXXX ). I spoke with a Guaranteed Rate representative on XX/XX/XXXX who informed me that the plan was approved and that this should have been sent to XXXX. The amount was {$4900.00} at 4.75 %. This is nowhere near our trial plan, which was {$4100.00}. Even our original mortgage was ~ {$4500.00} at 4 %. Since this was an FHA loan/HAMP, the payment should not have been significantly higher than the trial plan. Regardless, none of this information was conveyed to XXXX.

Complaint What Happened My mortgage company did not pay my property taxes on time. I closed on a new construction house XXXX of XXXX. My builder built XXXX identical houses on a larger lot. As we did not close on the property until the middle of the tax year, my lot was not formally split off from the original lot by the tax assessors office until XXXX tax year. This was not caught by the mortgage company during the closing process. As a result I had to continue to pay into my escrow account all year despite the mortgage company refusing to pay my first year of taxes. I then had to personally reimburse my neighbors for our shared property taxes for the original lot. In XXXX of XXXX I received documentation from the tax assessor that the lots were split for the upcoming tax year. I sent a copy of that letter by both physical mail and email so that the mortgage company had the updated information. When it came time for the school tax bill to be paid by XX/XX/XXXX, I was still receiving notices from my bank that my property had not been split from the lot. I messaged them on XX/XX/XXXX through their secure message center with the updated bill amount. When I hadn't received any response by XX/XX/XXXX, I called them directly to check the status. I was told the bill had been received and that a work order was opened to request payment of the bill. I finally received a reply through the secure message center on XX/XX/XXXX stating the property was still listed as To Be XXXX and that a bill had not been received, which was in contrast to what I was told on my last phone call. On XX/XX/XXXX, I received a notice from my city 's tax authority that my tax bill was unpaid. I mailed a physical copy of the updated bill and emailed to the customer service address given to my by my mortgage company. After another week went by, I called the company again and all that they could tell me was that there was still an open work order to request payment of my bill. They could not verify the receipt of either copy of the bill I sent through physical mail or email. They assured me that the bill " would be paid '' but could not give me any timeline on if it'd be paid in time to avoid any further penalty. I'm frustrated because I've been in communication multiple times about these tax issues over the year and a half that I've had my house. Every person I talk to seems to have no record of my previous conversations and there documentation on their side is severely lacking. I'm concerned that there is no safe way to send in documents to the company without risking them being lost in the process. They have not proved to me that they are adequately equipped to handle the finances involved with my property and I'm concerned about my finances and credit being impacted by their inability to communicate with me.

The lender asked me to put a XXXX charge on my charge card for an appraisal ... but pursuant to XXXX XXXX '' The lender will request an appraisal straight from the VA website. VA will then select an approved appraiser.. Then on XXXX XX/XX/2018, XXXX XXXX my then real estate agent sent me an email saying for me to go to my email an electronically sign a closing document.Upon reading the form I noticed that the lender was charging me the funding fee.. Pursuant to XXXX '' Veterans receiving VA Compensation for service connected XXXX do not have to pay funding fee. '' I HAVE A PERMANENT AND TOTALLY XXXX VETERAN..PLEASE NOTE THE CLOSING DOCUMENT STATED ... XXXX WAS DUE FROM THE BORROWER AT CLOSING.. BUT I WAS ONLY PRE-APPROVED FOR XXXX DOLLARS..
