29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means: (a) 39 Cannon Drive, Holbrook, NY (Worksite), south side of home - On, or about October 14, 2015, three employees engaged in roofing activities worked within approximately 2' of the energized split-phase electrical service connection, which extended from the utility pole to the south side of the home. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation, in accordance with 29 CFR 1903.19. |

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Worksite, north, east and west sides of home - On, or about October 13, 2015, three NL Construction employees were re-roofing the second story, low slope (4:12) roof. The employees were working, without fall protection, at a height of 18'-4" above the ground below when they worked on and near the north and east edges of the roof; and 9'-8" to the lower level (first story roof) when they worked on and near the west edge of the roof. (b) Worksite, west side of home - On, or about October 14, 2015, three employees were replacing roof sheathing on the first story, low slope (4:12) roof. The employees were working, without fall protection, at a height of 8'-8" above the ground below. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation, in accordance with 29 CFR 1903.19. |
