This Complaint is related to Case # XXXX - XXXX and XXXX - XXXX ; Loan # XXXX. My home is scheduled for foreclosure and I need the Service Provider to provide me an answer as to why they have not assessed my Loan Mitigation Application based on the updated Profit and Loss Statement ( Income ) that was submitted to them.
Here are specific details of my case.
1. RCS acknowledged they made a mistake and I appealed their decision to reject the Loan Mitigation Application within 30 days.
2. The basis of that appeal was the updated Profit and Loss Statement submitted to RCS as part of the appeal letter on XXXX XXXX, 2015. This updated Profit and Loss Statement is included in Exhibit XXXX. The average monthly net profit from the business is {$6400.00} per month ( {$38000.00} divided by 6 months ). When you add my social security income of {$1900.00}, my monthly income adds up to {$8400.00}. This is the monthly income on which RCS needs to assess my Loan Mitigation Application.
4. The way I have calculated {$8400.00} as my monthly income is exactly the same manner RCS calculated my monthly income earlier based on the preliminary Profit and Loss Statement. This preliminary calculation from RCS is included in Exhibit XXXX. Hence my {$8400.00} is my correct monthly income.
Therefore, based on the above, RCS needs to assess my Loan Mitigation Application based on the correct updated Profit and Loss Income and my Social Security Income. This amount comes to $ XXXX and not {$7800.00} as claimed by RCS.
Therefore please ask RCS to read the documents I have mailed them as part of the appeal and to evaluate my Loan Mitigation Application based on the correct monthly income of $ XXXX all the above documents were attached to this Complaint before and are in possession with RCS. They were all submitted as part of the appeal documents mailed on XXXX XXXX, 2015.

RE : Error in Evaluation of Loan Modification of Loan # XXXX am the homeowner at XXXX XXXX XXXX, XXXX XXXX, NY XXXX and RCS, the loan servicer, has made a patent error in the Loan Mitigation Application request of # XXXX by calculating the wrong monthly gross income as {$7000.00}. Because of this error RCS has rejected my Loan Mitigation Application.
I am writing to rectify the error RCS has made and am appealing the basis of RCS ' decision. It seems that RCS has used outdated income information provided to XXXX XXXX XXXX back on XXXX/XXXX/2014 instead of using my current income.
My correct current monthly income is $ XXXX. The basis of my correct income is attached.
Kindly use the above to ask RCS to correct the error in the Loan Mitigation Application and reassess loan modification request based on my correct monthly income of $ XXXX/-Thank you.

Our mortgage company, XXXX XXXX ( previously owned by XXXX XXXX ) sold our mortgage to Residential Credit Solutions in XXXX, XXXX. Our payments were roughly $ XXXX/month at 9.95 % interest. My husband lost his job in XXXX. We knew our payments were going to be impossible to maintain, so in XXXX, began the process of applying for a modification. XXXX XXXX, and then Residential, made it impossible for us to receive a modification which would make the payments more affordable by continuously delaying the process for about 18 months, then finally gave us a " Supplemental Modification. '' This did not lower the monthly payments, kept the interest rate at 9.95 % and extended our mortgage to 40 years. Since they had already begun sending us foreclosure letters, we had no choice but to accept. We contacted several government agencies and representatives, to include CFPB XXXX XXXX XXXX ( who, by the way, did not listen and were very rude ), and no one would help or listen. I am attaching several documents to support our complaint. After giving up actual living necessities and cashing in our retirement to bring everything up to date, we applied for and received a new variable rate mortgage through a XXXX 2.75 %. Of course, this interest rate will go up ; however, our current monthly mortgage payment is now a little over {$700.00}. We had to incur closing costs, legal and appraisal fees, etc., in addition to the more than {$20000.00} in interest payments over the lifetime of the " modification '' as a result of Residential 's predatory practices and other agencies ' lack of consideration towards us.

We tried on numerous occasions to secure a mortgage modification to allow us to keep our home, and Residential Credit Solutions ( RCS ) repeatedly blocked our attempts by not returning phone calls, emails, etc. We were told to submit duplicate paperwork on numerous occasions. When they finally offered a " XXXX XXXX XXXX '', we were advised that this was the only program they had looked at for us, they did not advise us of any other programs that might be available to us, and their modification did not change the monthly payment at all, thereby keeping us in an impossible plan, setting us up for failure, and virtually keeping us in the same foreclosure risk. They told us to look over the XXXX XXXX XXXX and call them back. When we did call them back, we told them we did not want to sign the agreement, we wanted to explore other options. They refused to look into a payment deferral, saying it would ruin our credit. Our credit was already ruined by virtue of their dragging this process along for 15 months. Numerous times, when we were finally able to speak to a representative, and only after they had been contacted by third parties ( including congressmen and women, and newspaper reporters, they gave us misinformation, or told us they would look into other programs and then never called back. We have voice recordings of those telephone conversations, and solid proof of our attempts to obtain information to allow us to make informed decisions. We were forced to cash in our XXXX money in order to clean up our own credit and were finally able to secure a new mortgage with a reputable banking institution, with a much lower payment and lower interest rate. However, not only is our XXXX gone now, but we incurred expenses in excess of {$23000.00} in order to mitigate our damages. This was not a modification of our existing mortgage. It was a total re-mortgage, and without benefit of Truth-in-Lending law protection.
