Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck-by hazards: On or about 12/26/12 at or near 6737 Route 394, Westfield, New York; employees were struck by a vehicle while rolling up cable at the rear of the bucket truckparked on the shoulder of the roadway and in the right of way of a state highway. a) An employee was wearing a jacket over his high-visability clothing. b) The amber warning beacon on the truck was obstructed by the trucks mechanical equipment and not visible to oncoming traffic.
