We have a construction and mortgage loan with a private lender through XXXX XXXX XXXX. The loan matured in XXXXXXXX XXXX. In XXXX, the lender and XXXX were notified of a contract for sale of the project. They were forwarded the contract and the potential diligence period to complete the sale.
We requested a Payoff and were forward the values due. The payoff included for any interest due and the principle on both the mortgage and construction loan.
When the buyer completed its diligence on the property, we learned the lender had transferred the loan service over to FCI Lender Services during the same period.
As we prepare for closing, FCI sent us a payoff that included for almost XXXX in default charges and fees.
While we fought the charges, FCI has been non-responsive and denied their removal. This has jeopardized the entire sale. Unless we relent and pay them the XXXX immediately. This effects, not only the participants, but the tenants within the building.

Consumer Financial Protection Bureau ( CFPB ) have made efforts to streamline help provided to homeowners through mortgage servicing companies and provide enforcement of critical protections for homeowners who were affected by the XXXX economic crises. However, more needs to be done to scrutinize the activities of banks, investors, XXXX, XXXX Funds owners, Servicers and other private entities who continue to side-step existing laws put in place to help homeowners avoid foreclosure, equity theft, gentrification, and loss of generational wealth. I am writing this formal request for CFPB intervention due to the refusal of the Servicer to resolve my complaints and the predatory behavior of XXXX XXXX XXXX XXXX, its investors XXXX XXXX XXXX and its successor XXXX XXXX XXXX.
XXXX. In the period preceding the foreclosure crisis in XXXX, Lender XXXX Mortgage ( my lender at the time ) started foreclosure action and I requested loss mitigation assistance from XXXX Mortgage who negotiated a settlement offer of {$150000.00} for full and final satisfaction of the debt in XX/XX/XXXX.
XXXX. Before the payoff period expired, Investor XXXX XXXX XXXX through its XXXX XXXX XXXX XXXX XXXX intercepted this agreement/settlement offered by my lender and thereafter refused to accept payment within the time period allowed by XXXX Mortgage XXXX
XXXX. XXXX XXXX XXXX XXXX XXXX a.k.a XXXX XXXX ( owner of XXXX XXXX XXXX ) tried to substitute as plaintiff in the foreclosure action instead of XXXX Mortgage and was denied multiple times in Supreme court. XXXX XXXX subsequently withdrew their attempt to substitute in the foreclosure action and restarted a new foreclosure case under new investor ( XXXX XXXX XXXX ) in XXXX after the statute of limitations had expired.
XXXX. XXXX Dear denied XXXX XXXX XXXX for Summary Judgment with Prejudice on XX/XX/XXXX yet this investor and its Servicer XXXX XXXX XXXX XXXX continue to aggressively pursue deed -in-lieu, high pressure delay tactics, and costly litigation as a means to force me out of my home. This foreclosure matter could have been settled years ago, but XXXX XXXX XXXX XXXX and its XXXX XXXX XXXX XXXX are trying to steal the equity from my home through excessive fees, predatory delay tactics and illegal attempts to sell my home at auction.
XXXX. XXXX XXXX XXXX XXXX also refused to provide proper accounting, did not properly serve pre-foreclosure notices as required by law ( RAPL XXXX ).
Especially egregious, XXXX XXXX XXXX XXXX and XXXX XXXX XXXX are actively trying collect payment of a debt that is past the statute of limitations in violation of XXXX XXXX ( XXXX ), XXXX ( h ), CPLR XXXX ( a ) and the Foreclosure Abuse Prevention Act..

My family had experienced a hardship. My fiance became XXXX and shortly after I had lost my job. I proactively reached out to the bank because just in case I ran into any trouble paying my loan. The bank was XXXX. XXXX placed me on a forbearance plan. I did not know that this would impact my credit. They asked me to complete paperwork for a loan modification -but before it was finalized sold my loan to XXXX XXXX . XXXX had modified my loan but sold it to XXXX XXXX. XXXX XXXX would not honor the modification and told me it was done wrong. XXXX XXXX changed the modification and increased it by an additional {$500.00} and sold my loan to FCI Lenders, LLC -/XXXX . They sent me a letter informing me that I was late on my payments. I was never late on my modifications ever and decided to discontinue my escrow account asking me to pay the principle only for XX/XX/2016 and XX/XX/2016 - the representatives name was XXXX XXXX ( XXXX ) XXXX. I explained to XXXX that my loan should be in good standing and that they can not change the terms of my loan. I also provided him with a tax bill - Anthonly informed me that FCI Lenders was sitting or holding over {$8000.00} in an account when they discontinue my escrow. I forwarded the tax bill and they have not paid it yet. I was then transfered to XXXX XXXX ( XXXX ) XXXX, I asked them to honor my loan modification and XXXX is telling me that my house is upside down and I should find another lender to give me a loan. XXXX informed me that they will take {$230000.00} for my loan. I forwarded all the bank statements showing them I have not defaulted on any payments. They will not continue my escrow and do not honor my loan modification. Why are we asked to complete all these forms and the government has a program and the banks sell your loan and then put the responsibility to show payment on the borrower and want to remodify my loan or get a new loan. FCI is a company that services mortgages and payments on real estate loans. We received an unjustified late fee in XX/XX/2022 because the automatic payment we set up from our bank account was set to an initial monthly payment amount, that based on the nature of the loan, was going to quickly increase to a new amount. This is because the loan package to purchase a house also included a renovation loan to repair the house. The terms of the loan included an increase in the monthly payment when we applied for partial payments, or draws, on the renovation loan. This increase in the monthly payment was entirely forseeable due to the terms of the loan. We set up an autopayment on the original monthly payment amount, which worked for the XX/XX/2022 payment. As soon as we applied for the first draw in XXXX, the monthly payment increased. However, the setting of FCI 's autopayment from our bank was set on the fixed initial amount, not an automatic floating amount to cover changed monthly payments. The autopayment would not take the new amount from our bank, which FCI blamed on us, making a hostile phone call and sending late payment letters. We had to call an FCI representative and pay the missed payment and a {$74.00} late charge individually, and were told we had to wait until that payment cleared before we could toggle the settings in our online account to make the monthly autopayment automatic to cover a flexible amount, rather than a fixed single account. Our belief is that FCI clearly sets loan payments this way to ensure that everyone runs into this problem, and misses a payment when their monthly loan payment increases due to the activation of draws on their renovation loan, to enable FCI to levy a late fee that is entirely their fault. The solution - FCI changing the default setting on their loan payments from fixed to automatic - is so simple and easy that it is clear that having the default payment setting on fixed is company policy to cause loan customer autopayments to fail, allowing FCI to extract a late charge- on every loan with a renovation package. We have already requested and received a refund, but we assume many other loan customers are being mistreated. Please compel the company to change their policy and enforce whatever laws they have violated.

On XX/XX/XXXX, a decision was entered in the courts of the intention of XXXX XXXX Bank to auction off my property, located at XXXX XXXX XXXX XXXX XXXX NY XXXX. Since that time we have gone through the XXXX pandemic. During this time it was an understanding that because of the financial difficulties being experienced by home owners to keep up with their mortgage payments, there would be a stop placed on forclosures. Again neither my lawyer or I was informed of a decision by XXXX XXXX 's Legal team to pursue another foreclosure and auction of the property. This decision of foreclosure was entered in the courts on XX/XX/XXXX. I received a date for sale XX/XX/XXXX. Recently I received a new letter in the mail stating a determination to sell at auction on XX/XX/XXXX, The fact of the matter is that it was never proven in court that XXXX XXXX had legal ownership of the mortgage on my property. And the court issued this decision in XXXX. The reason being the XXXX XXXX of legal acquisition of the mortgage was never proven in the court of law. XXXX XXXX could not prove how they gain ownership to the mortgage on my property.
XXXX times there was a case for foreclosure of my mortgage without my knowledge of the case filing or date of court appearance. Presently a new Loan servicing company, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX CA XXXX, has taken over the management of the mortgage loan. XXXX XXXX has stated they have had nothing to do with a foreclosing on my property even though the bank is mentioned in the case as is recorded on the notice attached to this complaint.
All of these cases are being pursued and conducted in the courts to foreclose and I am not clear of who is responsible.

I had another company contact me in XX/XX/XXXX FCI lending they said they owned my second mortgage and they was going to take my home .. I told them I was going to file criminal charges. They disappeared. My dad and my little cousin like a brother to me passed in. XXXX. I was trying to get a loan for XXXX XXXX and it was denied the entire problem started then now we are dealing with Coronavirus 19 .. I loss wages before this .. I have a small child. And now theyre trying to take my home and my income was just getting better.

XXXX XXXX foreclosed on my property, they were granted foreclosure due to my attorney XXXX XXXX. in XXXX NY neglected to perfect a response for 10 months.
I entered into a modification agreement with XXXX XXXX whom XXXX transferred the foreclosure summary to.
I honored the agreement and have made 7 payments on time. there was {$2.00} shortfall on one payment due to bank error on a check for {$2500.00}. FCI lender services over charged my account {$160.00} for that. Also, if FCI Lender services had the proper licensing from servicing my mortgage from 2015.
I have yet to receive a executed Modification agreement or removal of lis pends on my home..
Further a QWR was requested over 30 days ago, I have yet to receive proper information

I am writing to inform you of fraudulent activity that I have encountered involving a mortgage company called XXXX. XXXX XXXX XXXX XXXX. I suspect that the company is engaged in mortgage fraud and the sale of negative amortization loans.
I have experienced firsthand the repercussions of their deceit and unlawful practices. After applying for a mortgage with the company, I was sold a negative amortization loan without my knowledge. This loan had the principal balance go up with every month of payment. After a few months, I realized that I was paying almost double the principal balance as compared to when I initially signed up for the loan. This is illegal and unethical, and I hope your office will take decisive action against this company. I understand mortgage fraud and the sale of negative amortization.
My primary mortgage company XXXX ( Current servicing mortgage : FCI LENDER SERVICES, I.N.C., ) started on XX/XX/XXXX and foreclosed action against us. We defended our case and were dismissed a few times, and the final dismissal was in XX/XX/2017. I hired XXXX XXXX XXXX XXXX XXXX XXXX, MD XXXX XXXX. Owner to continue defending our case. They have done many processes, including mortgage paid-off, Collect Recovery money, has done forensics, and so on. Please keep in mind XXXX XXXX, XXXX, The Law Offices of XXXX XXXX, XXXX. is helping us with foreclose defense.
Our main goal is for a mortgage that is free & clear ; we want to hold a clean deed & title. XXXX & XXXX XXXX advises that XXXX ( Current servicing mortgage : FCI LENDER SERVICES, XXXX, ) has withdrawn {$1.00} XXXX in insurance money against our house, which was another fraud.
Beside Mortgage fraud, FCI LENDER SERVICES, I.N.C. The current mortgage violates the rules and keeps denying our request to pay Property taxes & home Insurance from the escrow account. To pay via escrow funds my home insurance & property taxes, as our home has suffered significant damage due to XXXX XXXX. Our entire house, backyard, front yard, attic, cellar, and 2nd floor have been damaged, totaling $ XXXX. I had to take out a loan and use my credit card to cover living expenses since the hurricane, and I am now left with no funds to cover all the costs associated with home repairs, insurance, and property taxes. Previously all prior mortgage & servicing companies paid home insurance & property taxes out of the escrow account.
See enclosed all of my documents submitted to the XXXX XXXX XXXX and see paid checks to the contractors. Unfortunately, XXXX denied our case ; XXXX XXXX XXXX paid a fraction of the cost we lost from ours totaling {$900000.00} in damages.
I have children and elderly family members living with me who have been adversely affected by this disaster. Currently, I am working part-time and looking for a full-time job as a Creative XXXX and Senior Graphic Designer for the past two years ( educated with XXXX XXXXXXXX. & XXXX. Degrees and Trained ). Thus, I have been asking MORTGAGE COMPANY : FCI LENDER SERVICES, I.N.C., to assist us in this challenging time by providing the necessary funds via escrow for our home insurance and taxes. I understand this is not an unusual request, but the circumstances are such that I am desperate for help. The current mortgage violates the rules and keeps denying our request. Please take proper legal action, and I hope you will resolve these issues as soon as possible.

XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, CA XXXX / XXXX XXXX XXXX at XXXX XXXX XXXX XXXX, XXXX TX XXXX are using illegal and Fraudulent tactics/actions to collect a debt amount that is not owed.
In XXXX XXXX XXXX, we had a 15 yr. loan @ 13 % with XXXXXXXX XXXX XXXX XXXX XXXX XXXX, & XXXX and the maturity of the loan was XXXX XXXX, XXXX.
Each of the before mentioned finance companies ALL were frankly taken over by XXXX
After falling behind on taxes, it was made good in a court action, to which back taxes were brought current in a chapter XXXX proceeding. In the repayment plan, XXXX XXXX XXXX. also collected over {$17000.00}, {$12000.00}, and over {$5000.00} in lump sums, in addition to my monthly payments of {$2000.00}.
Now that everything was current, while in court, the Trustee also approved the Payoff Application that I made to XXXX, while we were in Court XXXX agreed. Only it was a Ploy/stalling tactic to move out of the " Eyes '' of the law. After court, XXXX resumed taking monthly payments, but XXXX NEVER resumed sending the official " Statements '' as required by Law.
None of the Lump sum totals Mentioned above are reflected on our loan account from XXXX, after I requested a summary of my account with them.
In XXXX, I paid an undertaking of {$10000.00} to XXXX XXXX XXXX office. Now, this lump sum, I was told by XXXX XXXX XXXX office that this Lump sum was going to be applied to the Balloon payment becoming due XX/XX/XXXX.
Again, the facts relating to ALL the Lumps sums paid were hidden and NEVER applied to my account. Even with the breakdown of specific fees relating to attorney fees and related court cost, none of my lump sum payments are posted on my account.
I have ordered the bank records and the chapter XXXX & XXXX records. Subsequently, XXXX record does not reflect payments made through the Chapters either.
In XXXX, XXXX transferred us while officially in the midst of a Modification. IT is worth mentioning again, XXXX continued to accept monthly payments, but a XXXX Workout Specialist verbally said they didn't know what to do with my account because after XXXX XXXX, XXXX they were not obligated to send out " Monthly Statements. '' I was confused by this because I felt I should know how the money that I continued to send, was going to be applied. In XXXX XXXX, I was sent notice of an upcoming transfer to XXXX XXXX.
XXXX XXXX, never sent any documentation of any to our residence. Nor did XXXX continue with the Modification application.
In a matter of 8 months, XXXX transferred the Debt to FCI Servicing with notice. Ever since then, No one has given us an documentation that reflects an accurate record to include ALL of the above amounts paid.
Moreover, Its like a Con-job/SCAM more than anything! I have been finically harmed and deceived, plus subjected to harassment!
XXXX XXXX XXXX has never provided me with servicing. In fact, Section 5 of RESPA ( 12 U.S.C.S ) 2605 gives the consumer rights.
Given the laws on the books to protect consumers, it is my legal right to submit as truth and fact, that I was never given any proper/official Not of Transfer as required by law.
XXXX XXXX XXXX, XXXX XXXX, and XXXX XXXX intentionally violated the law and must STILL be held to accountable to the Law according to Section 6 of RESPA.
Further, the law provides for damages and cost for individuals where Servicers are shown to have violated the requirements of this section according to transfer Practices and Requirements.
Please note, XXXX XXXX XXXX has never sent any documentation reflecting ANY of the above payments previously made to XXXX.
It is my firm belief and testimony that XXXX has never correctly applied money paid to their representing attorney XXXX XXXX XXXX XXXX, and further the additional monies paid thereafter up until XXXX, and in XXXX, we prepaid our property taxes.
Now, our property taxes are once again delinquent. Plus, we are experiencing roof leaks from the serve weather and our heating unit is in need of immediate replacement.
Since all the repairs are costly, We are stuck between a rock and hard spot because we need a home equity loan to address all the repairs needed that's also long over due.
