29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: a) On or about 10/16/18, on the roof of a house at 1849 Hopkins Rd., Getzville, NY: Employees engaged in roofing work on a low slope roof were exposed to falls of approx. 10 to 18 ft. No fall protection system was being used. Pitch of the roof was approx. 4 in 12 on the front roof, and 2 in 12 on the back low roof. NO ABATEMENT CERTIFICATION REQUIRED |

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) On or about 10/16/18, on the roofing jobsite of a house at 1849 Hopkins Rd., Getzville, NY: The siderails of the extension ladder located at the right-front side on the house, and used to access the roof from the ground, only extended approx. 20 inches above the roof. b) On or about 10/16/18, on the roofing jobsite of a house at 1849 Hopkins Rd., Getzville, NY: The siderails of the extension ladder located at the left-back side on the house, and used to access the back lower roof from the ground, only extended approx. 20 inches above the roof. NO ABATEMENT DOCUMENTATION REQUIRED D Allen & Sons Contracting, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1064902, citation number 1, item number 2, and was affirmed as a final order on 06/22/2015, with respect to a workplace located at 2775 Union Road, Cheektowaga, NY 14217. |
