OSH ACT of 1970 Section (5)(a)(1): Executive Order 12196 Section 1-201(a): The head of the agency did not furnish to employees places and conditions of employment that are free from recognized hazards that are causing or are likely to cause death or serious physical harm in that the employees were exposed to struck by hazards. Location: 111 E. 48th St., New York, NY. On or about 11/7/14; a) At the worksite while pumping concrete to an upper level, employees were exposed to tipping and potential collapse of the pumping truck and multiple boom sections, when the outriggers where not fully deployed to maintain stability as required. The employer conducted the concrete pouring operation in an unsafe manner in accordance with the American Concrete Pump Association (ACPA) and/or the manufacturers specifications on how to adequately use the truck's outrigger system. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: 1. Ensure that all outriggers are fully extended in accordance with the American Concrete Pump Association (ACPA) and obtain required permits if street closure is necessary to fulfill the requirement. 2. Ensure that all employees/operators have proper training to identify hazards associated with the operation of concrete boom trucks. |
