OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm from being struck by and/or crushed by falling steel warehouse storage racks, including materials stored on the warehouse storage racks: a) Warehouse: On or about March 9, 2023, employees engaged in warehousing work activities such as walking/working near warehouse storage racks and operating powered industrial trucks to move pallets of materials (e.g., pallets of ceramic tile, etc.) onto and off of warehouse storage racking were exposed to struck-by and crush-by hazards from warehouse storage racking that was both damaged and unanchored to the floor, and from materials stored on such warehouse storage racking. In addition to abatement certification, the employer is required to submit abatement documentation for this item. Failure to comply will result in additional penalty of $ 1,000.00 as per 29 CFR 1903.19. |

29 CFR 1910.176(a): Aisle(s) and passageway(s) were not kept clear and in good repair with no obstruction across or in aisles that could create a hazard and were permanent aisles were not appropriately marked: a) Warehouse - Accident Location (South Section of Warehouse) - near loading dock: On or about March 9, 2023, two pallets on which bags of grout were stored in the warehouse aisle and resulted in limiting the available aisle space in which a forklift truck was operating. b) Throughout the Warehouse: Permanent aisles were not marked on or about 3/9/23. For Instances a: Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19. 29 CFR 1910.176(b): Material stored in tiers was not stacked, blocked, interlocked or limited in height so that it was stable and secure against sliding and collapse: a) Warehouse Storage Racking: On or about March 9, 2023, employees working in the warehouse were exposed to being struck by materials (e.g., ceramic tiles, etc.) that were not stored in a stable and secure manner on overhead warehouse storage racking due to loose tile being stored on pallets, tile stored on broken/damaged pallets, tile stored on pallets not positioned in an stable manner (e.g., at a slant) and pallets of tile that were double-stacked. b) Warehouse at Exit Door - West-Side of Building: On or about March 9, 2023, employees working in the warehouse were exposed to being struck by long metal strips which were stored loosely and leaned against wall within 6 inches of the exit door and were not stored in a stable/secure manner. For instance a: In addition to abatement certification, the employer is required to submit abatement documentation for this item. Failure to comply will result in additional penalty of $ 1,000.00 as per 29 CFR 1903.19. Note: Instance b was documented in the inspection file as corrected during the inspection on or about 3/17/23 and therefore the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19. |
