29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Worksite: Employees performing roofing work were exposed to falls of up to and including 20 ft. in that they were working without fall protection; on or about 8/16/19. b) Worksite: Employees were exposed to falls of approximately 10 ft. from an unprotected side into the basement egress well below; on or about 8/16/19. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19. KOFC Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1384496, citation number 1, item number 1 issued on 5/23/2019 and was affirmed as a final order on 5/30/2019, with respect to a worksite located at 73 Dayton Lane in Easthampton, NY 11937. |

Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19. |

29 CFR 1926.1053(b)(10): The tops of a non-self-supporting ladder were not placed with the two rails supported equally: a) Worksite, 73 Dayton Ln, East Hampton, NY 11937 - Employees were using a 28ft. WERNER aluminum extension ladder, Model No. 015282 to access the roof of the residential building approximately 15ft. above the ground. The left side rail of the ladder was approximately 6in. below the roof edge and the right side rail was approximately 6in. above the roofs edge; on or about 3/11/2019. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19. |
