29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. (a) 493 Sagaponack Road, Bridgehampton, NY (Worksite), west side of residential home - On or about August 7, 2015, employees accessed the ladder jack scaffold using the same aluminum extension ladders that were supporting the work platform on the outboard side of the scaffold. This means of access required the employees to climb around the ladder jack brackets and aluminum plank in order to reach the working level of the scaffold. This exposed the employees who ascended and descended the scaffold in this manner to fall hazards, which ranged between 3' and 13'-6" to the ground below. Note: The employer is required to submit abatement certification for this violation, in accordance with 29 CFR 1903.19. |

29 CFR 1926.451(f)(15): Ladders were used on scaffolds to increase the working level height of employees: without satisfying the criteria of subparagraphs (i) - (iv) of this paragraph. (a) Worksite, west side of residential home - On, or about August 7, 2015, an employee increased the working height of the ladder jack scaffold by pacing a fiberglass stepladder on the work platform and leaning it against the side of the home. This exposed both employees who were working from the scaffold to fall hazards, which ranged between 13'-6" and 17'-6" to the ground below. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation, in accordance with 29 CFR 1903.19. |

(a) Worksite, west side of home - On, or about August 7, 2015, two employees worked from a ladder jack scaffold, which had visible deficiencies such as, but not limited to the lack of a safe means of access; a step ladder was used on the scaffold platform to increase the working height; and the lack of fall protection when the employees worked at heights ranging between 10' and17'-6" above the ground below. The employer did not ensure each employee received the requisite training that would have enabled them to recognize the hazards; or in the procedures to control or minimize the hazards associated with ladder jack scaffolds. The scaffold was erected without a safe means of access to the working level, a stepladder was placed on the working level to increase the working height, and the working level was positioned between 13'-6" and 17'-6" above the ground, which would have required the employees to use a personal fall arrest system.
