In XXXX & XXXX of 2020, someone tried to purchase a vehicle from multiple car companies. I notified these companies stating that I did not AUTHORIZE these INQUIRIES, nor was I applying for any auto loans do to the fact that I was just released from prison in XX/XX/2020. They stated that the inquiries would be removed. In addition, during that time DMV was closed due to the Pandemic ( COVID ), so there was no way for me to obtain a License or State ID.

Back inXX/XX/XXXX I paid off my auto loan with Carvant Financial. I asked for the lien release and they sent me a form for an automatic payment. I called them and they stated I would get the correct form. Never received it. I called in XX/XX/XXXX because my credit was still reflecting past due since XX/XX/XXXX and because I never received the release and they stated they do not report to the credit once the account is closed. They also stated the ACH form is the form for the lien release however I am not signing anything that allows them to take money from my account since the account is paid. So I tried to handle it with XX/XX/XXXXand XX/XX/XXXX by submitting a dispute. Nothing changed. I tried on XX/XX/XXXX to obtain a new car loan and the finance company stated I had to put down {$2500.00}. I asked why and they stated that according to my credit report I have a repossession from eight months ago. I stated that I have never had a repossession, as a matter of fact the previous finance company has an automatic shut down system on the vehicle so if you should not pay the loan within 30 days of your due date, they shut down your vehicle which has never happened. You see, since it looks like the last payment made was XX/XX/XXXX it looks as if I was repossessed. I called Carvant Financial and they stated they will see what they can do. Now here I sit with the previous vehicle broke and I can't get a loan because they have trashed my credit. I fixed my other issues and yet the one thing that has nothing to do with me is the one thing destroying me. Now I'm told I have to wait another 30 days from the date the issue gets resolved if it gets resolved. So I have no vehicle until then. That isn't fair to me at all. My husband is also being hurt by this because the loan was in both of our names. Please help.

His claims of identity theft and lack of permissible purpose are baseless and without merit. '' the account you are reporting is a consumer report, experiences or transactions does not include identifying information you are more than welcome to report a list of non identifying account numbers and information to whom ever without it being a consumer report but you have committed identity theft pursuant to 12 CFR 1022.3 ( h ) fraud, using the identifying information of another person without authority. i do understand Carvant Financial LLC thinks they are a Furnisher of information and states they are required to furnishing accurate information, in fact pursuant to 12 CFR 1022.41 ( c ) ( 2 ) you can not be a Furnisher because you acting as consumer reporting agency as defined pursuant to 15 U.S. Code 1681a of the FCRA, My Identifying information pursuant to 12 CFR 1022.3 ( g ) ( 1 ) which is my name social security number, government identification number date of birth, pursuant to 12 CFR 1022.3 ( g ) 3 ) my account number which is a unique electronic identification number Used To identify me the consumer specifically, in conjunction with information regarding my transactions and experiences, which would be a consumer report pursuant to 15 U.S. Code 1681a ( d ) ( 1 ) ( A ) making Carvant Financial LLC a consumer reporting agency due to the fact such information is bearing on my consumer credit worthiness, credit standing, credit capacity, character, general reputation, collected in whole or in part for the purpose of serving as a factor in establishing the consumers eligibility for credit and has a direct reflection on my credit score pursuant to 15 U.S. Code 1681g ( f ) ( 2 ) ( A ) ( i ) you have violated the GLBA requirements as a financial institution because, All privacy policies are required to be delivered pursuant to 15 U.S. Code 6803 ( a ) ( 1 ) At the time of establishing a customer relationship with a consumer, a financial institution shall provide a clear and conspicuous disclosure to such consumer, of such financial institutions policies and practices with respect to disclosing nonpublic personal information to affiliates and nonaffiliated third parties, consistent with section 6802 of this title, including the categories of information that may be disclosed ; A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless pursuant to 15 U.S. Code 6802 ( b ) ( 1 ) ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option.
