I paid off this debt on XX/XX/XXXX. Previous to this, they were calling all hours of the night and day ( after XXXX. ) They provided no receipt, nor confirmation of payment. When I called asking for proof of payment they were incredibly rude with me. I then requested a letter stating the debt had been paid. I was told to wait 10 business days, I did. I then called asking for the letter, I was told I'd receive in 1 - 2 days. I never received the letter or receipt. I've now called every day for the past few days. They say they'll send the documentation but they don't. They are rude and nasty with me on the phone. One accused me to using profanity ( I didn't ) then hung up on me. I need this letter, or even some sort of proof of payment in order to get financial aid for my schooling. I've made it clear how important it is. They keep hanging up on me, or tell me they'll send by the end of the day then never do. I get similar responses to emails, stating " someone will send you the letter '' then never do.

Westlake Financial Services Attn : Customer Service Account Number : # XXXX Dear XXXX XXXX XXXX I am writing in response to your recent communication regarding my account and the reporting status of the charge-off. The information provided by Westlake Financial is inaccurate and misleading, and I am demanding the immediate removal of the charge-off from my credit report due to multiple violations of consumer protection laws.
In your letter, you stated that my account was charged off on XX/XX/year>, with an outstanding balance of {$18000.00}. However, this information does not accurately reflect the status of my account, and your response is inconsistent with the information provided by the credit bureaus.
First and foremost, I would like to point out that multiple months of reporting have been omitted on my account, which constitutes a direct violation of the Fair Credit Reporting Act ( FCRA ), Section 1681s-2, which mandates that all information reported to the credit bureaus be accurate and complete. Your failure to report months of payment activity or account status undermines the integrity of the information and violates the law. I have attached documentation showing the missing months of reporting for your reference.
Additionally, the charge-off on your report does not reflect the accurate status of the debt, as it has already been removed from XXXX and XXXX. This discrepancy is not only damaging to my credit score but also misrepresents the true nature of the accounts status. I also wish to clarify that, contrary to your assertion, the debt has in fact been written off and is no longer an active liability. Under IRS Publication 4681 and relevant IRS guidelines, a 1099-C form is issued when a debt is canceled or forgiven, which is the case here. Your refusal to acknowledge this and continue to report the debt as outstanding is unlawful and further exacerbates the damage to my credit.
Under the Fair Credit Reporting Act ( FCRA ), Section 1681i, you are required to conduct a reasonable investigation of my dispute. Your response, which arrived less than 10 hours after my initial dispute, is insufficient for a thorough reinvestigation and does not meet the standards set by law for a proper review of disputed information. This rushed response violates my rights and shows a lack of due diligence in handling disputes in good faith.
Therefore, I demand the immediate removal of the inaccurate charge-off reporting from my account, as it violates both the FCRA and the Fair Debt Collection Practices Act ( FDCPA ). Specifically : A full and complete reinvestigation of this charge-off as per FCRA requirements.
Immediate removal of any inaccurate or incomplete information regarding this account from my credit report with all major credit bureaus.
Written confirmation of the changes made to my credit report, including the deletion of this inaccurate charge-off, within 15 days of receiving this letter.
Failure to comply with these demands will leave me with no option but to escalate the issue by filing complaints, the Federal Trade Commission ( FTC ), and pursuing legal action to remedy this violation of my rights and the inaccuracies affecting my creditworthiness.
Please check the attached documentation for further details on the inaccuracies, including the missing months of reporting. I look forward to your prompt and lawful response.

They said they had to hike up the amount of the vehicle because Westlake charged them a dealer fee so they made it look like I was paying XXXX for a warranty. The total to be financed ended up being almost {$18000.00}. Four days after I took ownership of the vehicle the alternator went while I was driving and I almost had an accident. The vehicle was towed to the dealer and I told them I want my money back. The dealer is refusing and Westlake says it he alternator is not a big deal. I then told Westlake I want to do a voluntary surrender and they said I have to make a payment before I can do a voluntary surrender.
I feel like Westlake and XXXX XXXX ( the dealer ) is working together and no one is taking my situation into consideration. I went to the XXXX and the dealer lied. I went to the XXXX attorney General and I was basically told too bad because the vehicle has XXXX miles.

It has come to my attention that you have been engaging in unlawful reporting practices, and as a result, Westlake Financial has already been removed from two of the major credit bureausTransUnion and XXXX clear violations of consumer law, specifically the Fair Credit Reporting Act ( FCRA ) and related regulations.
I am hereby informing you that you are currently in violation of several consumer protection laws related to the reporting of inaccurate information, as well as your failure to provide me with the necessary XXXX form for the written-off debt.
***Violations of Consumer Protection Laws : *** *Inaccurate Monthly Reporting : Westlake Financial has been reporting inaccurate information every month to the credit bureaus. The repeated inaccuracies in your reportingsuch as incorrect balances, misreported payment histories, or incorrect account statusesare a clear violation of this provision. Your failure to correct these inaccuracies after they were disputed has directly led to your removal from XXXX and XXXX, and I am now demanding the same removal from XXXX.
***Failure to XXXX XXXX for XXXXritten-Off Debt : **** It is my understanding that the debt in question has been written off by Westlake Financial. Under IRS regulations, when a debt is written off, the creditor must issue a XXXX form to the borrower, as this constitutes cancellation of debt and may be considered taxable income. Your failure to provide this form is a clear violation of IRS guidelines and a further violation of consumer rights. By not issuing the XXXX, you are failing to comply with your obligations under 26 U.S. Code 6050P, which mandates that creditors issue a XXXX when a debt is canceled. This failure places me in a difficult position, as I am not receiving the required tax documentation to report the canceled debt.
***Immediate Action Required : *** Removal from Credit Reports : I demand that you immediately remove XXXX XXXX XXXX XXXX and all other credit bureaus reporting this account due to your continued violation of consumer laws regarding the accurate reporting of debt information. If you fail to do so, I will not hesitate to take further action, including filing complaints with the Consumer Financial Protection Bureau ( CFPB ), the Federal Trade Commission ( FTC ), and other relevant agencies.

As per the XXXX case XXXX, the dealership XXXX XXXX XXXX fraudulently sold myself, XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX. The bank, Westlake Services Inc/ dba Westlake Financial Services is aiding in the fraudulent activity of the dealer after being provided all necessary timely documentation. Neither of the two has paid back what was owed to me. The dealer sold the vehicle as merchantable and repair to render, when it was not, overcharged the vehicle registration fee, and signed the contract under the wrong name and license, making the contract null and void. These are the only 3 know laws that were broken by the dealer as per NYS VAT Law. I have not had a reliable method of transport for almost 2 years and would like any assistance that you can provide. I will provide a few of the necessary documents where allowed. Thank you.

Complaint from XXXX XXXX and XXXX XXXX XXXX XXXX ) Westlake Financial/CULA has held onto lease equity. This greedy money grab hurts millions of consumers pockets all over the country, and only the regulators can force change. Any system that is designed to XXXX the consumers at all cost is a broken system that requires Regulatory intervention.
XX/XX/year> Leased XXXX XXXX XXXX XXXX from XXXX XXXX XXXX XXXXXXXX XXXX, payments to XXXX XXXX every 3rd day of each month of XXXX XXXX monthly interest accrue daily. Lease Downpayment and closing cost approx. XXXX XXXX.
XX/XX/year> payment {$410.00} to XXXX for the month of XXXX XX/XX/year> We had a no-fault auto accident and the leased car was totaled.
XX/XX/year> XXXX lease new car another XXXX XXXXXXXX to XXXX XXXX. Monthly payment XXXX XXXX monthly. We have by this date paid {$410.00} ( old lease XXXX payment ) + {$360.00} ( new lease payment starting XX/XX/year> ). In addition, XXXX XXXXXXXX out of pocket + lease payments XX/XX/year> XXXX issues check to CULA {$37.00}, XXXXXXXX XXXX XXXXXXXX lease payoff {$1400.00} in lease equity. Both XXXX and CULA were made roughly 104 % whole. Between CULA and XXXX, they collected the full payoff of XXXX plus the lease equity of {$1400.00}. I asked CULA for the lease equity to offset our out of pocket XXXX XXXX to start the lease, CULA reminded us that they owned the car, therefore that {$1400.00} lease equity was theirs. Lease termination confirmed was backdated to XX/XX/year>.
The issue here that screws consumers is that if we returned the car at the end of the lease and the residual value was below the lease stipulated residual value we would need to pay the difference out of pocket. Consequently, consumers are really hurt when companies CULA are allowed to have it both ways with consumer lease transactions.
We were not at fault for the accident that totaled our leased car, but the only parties that are made 104 % whole are CULA, XXXX and XXXX XXXX. CULA grabbed the lease equity check, while XXXX was paid off. I have another complaint with the credit union regulators against XXXX as they have refused to refund us the roughly {$250.00} excess payment in lease overpayment. Change is needed. We should get the lease equity of {$1400.00} to offset our initial lease payment of XXXX XXXX
