29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a.) Facility - on or about 2/10/14, approximatley 6 temporary employees were using methyl ethyl ketone (MEK) to remove ink from packaging. The employer had not provided effective information and training to the employees on the hazardous chemcails in their work area at the time of their inital assignement and when ever a new hazard that the employees had not been preoviously trained about was introduced into their work area. b.) Facility - On or about 3/20/14, approximately 4 temporary employees work performing cleaning and sanitation work within the facility. These employees can use chemicals such as , but not limited to: Windex (contains 2-Butoxyethanol); Easy Paks ( sodium carbonate and citric acid/irritants), and EnviroGuard (irritant). The employer had not provided effective information and training to the employees on the hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area. c.) Facility - On or about 3/20/14, approximately 3 temporary employees drive propane-propelled powered industrial trucks. Handling propane can cause frostbite and incomplete products of combustion contain carbon monoxide. The employer had not provided effective information and training to the employees on the hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area ABATEMENT CERTIFICATION REQUIRED |

29 CFR 1910.1200(h)(3): The employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv): a) Facility - On or about 3/20/14, temporary employees work on the sanitation shifts cleaning production lines, equipment, and the facility; collecting and disposing of garbage; and, providing janitorial services for the warehouse. The employees work with cleaning chemicals, such as but not limited to Windex (contains ammonia), Easy Paks (sodium carbonate and citric acid/eye irritant) and Enviroguard (irritant skin and eyes). The employer has not provided Hazard Communication training for the temporary employees who work with chemicals, which includes: b.) Facility - On or about 3/20/14, temporary employees operate propane-driven, powered industrial trucks. The employees can have exposure to liquid propane during the transfer of tanks, and carbon monoxide as a product of combustion. 1) Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.); 2) The physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area; 3) The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; and, 4) The details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information. Facility - On or about 3/20/14, the employer uses at least two temporary agencies to supply up to 120 employees during high seasonal work. The employer does not record injuries and/or illnesses for these temporary employees obtained from a temporary help service, employee leasing service, or personnel supply service, and were supervised by the employer on a day to day basis. The OSHA 300 log for the year 2012 did not contain the following injuries/illnesses sustained by temporary employees working at the facility: 1. On 4/23/12, a temporary employee sustained a hernia, requiring medical treatment. The employer did not record the injury on their OSHA 300 log. 2. On 6/26/12, a temporary employee sustained lacerations on the back of head and right forehead and had stitches placed. The employer did not record the injury on their OSHA 300 log. 3. On 7/12/12, a temporary employees sustained a burn to the L hand and lost 3 days and was restricted for 19 days. the employer did not record the injury on their OSHA 300 log. 4. On 10/6/12, a temporary employee sustained a low back strains resulting in 180 lost days and 51 restricted days. the employer did not record the injury on their OSHA 300 log. The OSHA 300 log for the year 2013 did not contain the following injuries /illness sustained by temporary employees working at the facility: 5. On or about 1/16/13, a temporary employee sustained a strained back which resulted in 5 days away from work. The employer did not record the injury on their OSHA 300 log. 6. On 2/11/13, a temporary employee sustained strains to the R arm, neck and back and lost 141 days and was restricted for 139 days. The employer did not record the injury on their OSHA 300 log. 7. On 4/3/13, a temporary employee sustained a right clavicle fracture and lost 180 days and was restricted for 155 days. The employer did not recor dthe injury on theri OSHA 300 log. 8. On or about 4/26/13, a temporary employee sustained a strained back which resulted in 8 days away from work. The employer did not record the injury on their OSHA 300 log. 9. On 5/1/13, a temporary employee sustained a right forearm strain resulting in 3 lost days. The employer did not record the injury oin theri OSHA 300 log, 10.
