Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. a) On or about 10/12/2022, at the Holiday Inn Express, located on 2200 North Goodman Street, in Rochester, New York, as Controlling Employer did not enforce the use of fall protection during a roofing project. Employer allowed subcontractor employees to "tear-off" an existing roof without fall protection exposing them to fall hazards of 39 feet above lower levels. NO ABATEMENT CERTIFICATION REQUIRED |

29 CFR 1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a) On or about 10/12/2022, at the Holiday Inn Express, located on 2200 North Goodman Street, in Rochester, New York, as the Controlling employer did not enforce the safe use of a ladder during a roofing project 39 feet above lower levels. The employer allowed subcontractor employees to use a portable ladder which did not extend 3 feet beyond the landing of the roof and exposing them to falling hazards. The employees were working left to right (i.e. south to north) from the Trafalger Entrance. The was a large gap between the triangular dormer in the corner between the north and west wings of the Trafalgar Building and the rectangular dormer just to the south of it. A plank was in place that bridged this gap. The plank was not secured, it was just laid down (across the dormers). An employee began walking across the plank from left to right (i.e. south to north). The plank was not able to support the weight of the employee, gave way, and both the employee and the plank fell approx. 18 ft. to a lower roof below. NO ABATEMENT DOCUMENTATION REQUIRED |

29 CFR 1926.502(h)(1)(iii): The safety monitor was not on the same walking/working surface and within visual sighting distance of the employee being monitored: a) On or about 10/14/16, on the Roofing Construction Site at Canterbury Woods, 705 Renaissanse Drive, Williamsville, NY: Employees were engaged in the installation of EPDM roofing material on the flat roofs of a series of high dormers along the east side of the roof, north of the main entrance of the Trafalgar Building were exposed to falls of approximately 30 foot to the ground. Among other fall protection systems permitted, the employer chose to use a safety monitoring system alone (i.e. without a warning line system). However, the employer did not comply with the all of the applicable provisions required when this type of fall protection system is used, in that the safety monitor was not on the same walking/working surface as the employees being monitored. The safety monitor was standing on the roof of a staircase that was approx. 10 ft. above the surface that the employees being monitored were working on, and up to as much as approx. 60 ft. away from those employees. NO ABATEMENT DOCUMENTATION REQUIRED |

The employee was directed by the foreman to stand on the roof of this staircase and act as a safety monitor for employees installing EPDM rubber roofing on flat dormers on the west wing of the building. There were no guardrails, parapet walls, personal fall arrest system or other fall protection system in place to protect the employee from falling. NO ABATEMENT DOCUMENTATION REQUIRED |
