29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: Location: Throughout the 11th Floor The Riverside Premier Rehabilitation & Healing Center 150 Riverside Drive, New York, NY 10024. On April 23, 2020 and there after, employees worked in a medical environment that required the use of respirator and were exposed to COVID-19. The employer did not complete medical evaluations for the use of the respirators. Employees working as housekeepers, Certified Nursing Assistants, Licensed Practical Nurses and aides were required to wear N95 filtering facepiece respirators when entering the rooms of COVID-19 positive patients or patients under investigation for COVID-19 infection. The employer did not provide these employees with a medical evaluation prior to their initial use of the N95 respirator. |

The employer provided N95 respirator protection. a) Employees working as Certified Nursing Assistants, Licensed Practical Nurses, and aides were required to wear N95 filtering facepiece respirators when providing direct care to COVID-19 positive patients or patients under investigation for COVID-19 infection. The employer did not ensure these employees were fit tested prior to their initial use of the N95 respirator. b) Employees working as housekeepers were required to wear N95 filtering facepiece respirators when entering and cleaning the rooms of COVID-19 positive patients or patients under investigation for COVID-19 infection. The employer did not ensure these employees were fit tested prior to their initial use of the N95 respirator. |
