Citation text line 29 CFR 1926.501(a)(2): The employer did not determine if the walking/working surfaces on which its employees were to work had the strength and structural integrity to support employees safely: a) On or about 10/31/19 inside a building at 290 Main St., Buffalo, NY: Employees were hand carrying rolls of Firestone APP 180 Bitumin roofing material weighing 107 pounds each from the passenger elevator exit on the 10th floor to and through the front stairway entrance door and then up one flight of stairs and across the landing to the entrance door to the flight of stairs leading to the roof. An employee had set one roll on the slate landing just before the section of the stairway leading to the roof, then left to get another roll. Shortly thereafter, a different employee walked onto the landing and set another roll down by the first roll. The slate broke and shattered, and the employee and one of the rolls fell through the opening. The slate and roll continued falling, smashing through the 9th floor landing and coming to rest on the 8th floor landing below. The employee was able to grab onto something at the 9th floor landing and was pulled to safety by another employee. The employer did not determine if the stairway and landings had the strength and structural integrity to support employees safely while engaged in this material handling task. b) On or about 10/31/19 inside a building at 290 Main St., Buffalo, NY: Rolls of Firestone APP 180 Bitumin roofing material weighing 107 pounds each were unloaded from a truck and brought inside the building. Employees used the passenger elevator to get the rolls up to the 10th floor. The employer did not determine if the passenger elevator had the strength and structural integrity to support employees safely while transporting this freight in the elevator. NO ABATEMENT CERTIFICATION REQUIRED
