29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used for access: a.) Site: 35-15 19th Avenue, Astoria, NY 11105. On or about July 21, 2023, employees transporting cinder blocks and cement mixture to a supported frame scaffold and employees laying bricks did not have a mean of access or egress to the scaffold. The working level was approximately 12 feet from the ground level. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19. |
