29 CFR 1910.133(a)(1): Protective eye equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment: a) Facility - On or about 10/27/15, employees work with KG Silver Sparkle Plus (corrosive); Klear Guard Rampage Plus (corrosive); KG Value Guard Delimer (corrosive); KG Sunburst (corrosive); KG-Quat-7 (corrosive); KG Grime Gone (corrosive); KG Fry-Mate (corrosive) to clean the facility; kitchen and dishware. Employees dilute the chemicals for use, either through a automatic system, or by introducing them into a container and manually diluting; remove and replace gallon containers of corrosive dishwashing-related chemicals; spray diluted sanitizers and cleaning chemicals onto surfaces for cleaning. The employer did not require protective eye equipment where there was a reasonable probability of injury that could be prevented by such equipment. ABATEMENT CERTIFICATION REQUIRED |

Employees dilute the chemicals for use, either through an automated system, or by introducing them into a container and manually diluting; removing and replacing gallon containers of corrosive chemicals ; and, spraying diluted cleaning chemicals. 29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a.) Facility - On or about 10/27/15, employees use chemicals such as: KG Silver Sparkle Plus (corrosive); Klear Guard Rampage Plus (corrosive); KG Value Guard Delimer (corrosive); KG Sunburst (corrosive); KG-Quat-7 (corrosive); KG Grime Gone (corrosive); KG Fry-Mate (corrosive) to clean the facility; kitchen and dishware. The employer has not developed, implemented and/or maintained at the workplace a written hazard communication program which describes how the requirements of the standard will be met. A written program should include description of how the criteria will be met for: 1.) Labeling and other forms of warning; 2.) Safety Data Sheets (SDS) 3.) Employee information and training Additionally, a list of hazardous chemicals known to be present in the workplace must be compiled. Methods used to inform employees of hazards associated with non-routine tasks and the informing of contractors of workplace hazards must also be addressed. The written program must be made available upon request. ABATEMENT CERTIFICATION REQUIRED |

Facility - On or about 10/27/15, employees work with chemicals such as: KG Silver Sparkle Plus (corrosive); Klear Guard Rampage Plus (corrosive); KG Value Guard Delimer (corrosive); KG Sunburst (corrosive); KG-Quat-7 (corrosive); KG Grime Gone (corrosive); KG Fry-Mate (corrosive) to clean the facility; kitchen and dishware. The employer has not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and when ever a new hazard that the employees had not been previously trained about was introduced into their work area. Employees shall be informed of: 1. The requirements of this section; 2. Any operations where hazardous chemicals are present, And; 3. The location and availability of the written Hazard Communication Program, list(s) of hazardous chemicals and Safety data Sheets (SDS Employee training shall include at least: 1. Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area. 2. The physical and health hazards of the chemicals in the work area; 3. The measures employees can take to protect themselves such as specific procedures, appropriate work practices, emergency procedures and personal protective equipment; 4. The details of the employer's Hazard Communication program including an explanation of labeling systems, Safety Data Sheets and how employees can obtain and use the appropriate hazard information.
