I am seeking agency intervention and involvement into the unethical practices of Lakeview Loan Servicing , LLC and XXXX RE : my mortgage account and excessive corporate billing fees.
It is good to know that Lakeview Loan Servicing is committed to providing excellent customer service in good faith to their customers, according to Compliance Department Director, XXXX XXXX. I want to make certain that her office upholds to those professional company standards. I am requesting that her department and Lakeview/XXXX address the insufficient corporate fees and inaccurate loan amounts due on my loan account.
XXXX XXXX indicated her office was unsuccessfully, unable to reach me via phone message, which is not completely accurate. Her office made a call to me from the phone number ( XXXX ), at approximately XXXXXXXX XXXX., on XX/XX/XXXX, but never left a message. I attempted unsuccessfully returning the call to XXXX XXXX office, receiving no response. At that time, I received an email, which I responded to ( please refer to supporting document ). To date, I have not heard from XXXX XXXX office, after submitting an email to speak with someone regarding my mortgage loan payment concerns and as to why the corporate fees are excessive. The corporate fees assessed to my loan are concerning. It appears that I am being excessively billed these corporate fees in the year XXXX, since I did not file for a bankruptcy in the year XXXX. And, no XXXX XXXX, of any sort has ever come out to my primary residence, nor was I made aware of any company doing so.
After contacting the XXXX XXXX program on or about XX/XX/XXXX for a history ledger of payments submitted to Lakeview, I discovered additional payments were submitted to Lakeview Loan Servicing on XX/XX/XXXX in the amount of {$4300.00}, on my behalf ( please refer to supporting document ). The NYS HAF program informed me that Lakeview was well aware of the payments that were to be applied to my loan account prior to the date referenced above. However, I was informed by XXXX XXXX office that I would be responsible for making monthly mortgage payments starting XX/XX/XXXX. I have since received monthly billing statements with accrued late charges to be due immediately ( please refer to supporting document ). According to NYS HAF, this is not accurate.
On XX/XX/XXXX, I received a Notice of Error Acknowledgement letter from Lakeview Loan ServicingXXXX due to my complaint, which XXXX XXXX neglectfully failed to mention to your office ( please refer to supporting document ). Also, XXXXXXXX XXXX XXXX XXXX XXXX, DXXXX XXXX indicated in her response, dated in XXXX of XXXX, that there is NO ERROR substantiated on the part of XXXX identified in the handling of my account. According to their responses in this matter, XXXX XXXX and XXXX XXXX appear to lack transparency and professional integrity for their unethical actions in this matter.
On XX/XX/XXXX, I contacted Lakeview/XXXX Mitigation Department for additional assistance if possible, requesting an additional XXXX forbearance due to ongoing burdensome financial hardship, however, I have not received any feedback to date.
In closing, I am demanding transparency from my mortgage lender and their affiliates. Providing my previous bankruptcy filings due to significant financial hardships and submitting irrelevant past modification offerings, which would have significantly increased my monthly payments by 25 %, are not of good faith policy nor would it have been in my best interest to accept such a financial burdensome modification at that time. LakeviewXXXX have receive a total disbursement amount of {$40000.00} from the NYS HAF program, bringing my loan account current. However, I am currently waiting for a response to see if I am eligible for a continued XXXX forbearance.
There should be more agency oversight involved into the unethical practices of lending institutions and their violations of state and federal policies.
I am looking forward to resolving this urgent matter.

I requested a copy of my forbearance exit document on XX/XX/XXXX. They claim it was sent on XX/XX/XXXX but my bank did not receive the document. When I called on XX/XX/XXXX they first claimed it was sent to the wrong number. After being transferred to someone else to expedite a copy being resent, the agent then gave a conflicting story saying the report was originally sent correctly. I was given the run around and had to request the documentation to be resent.

I submitted a signed and notarized Loan Modification agreement with XXXX on Monday, XX/XX/XXXX at 3.125 % interest rate on a 30-year fixed FHA loan XXXX I made a full initial payment on XX/XX/XXXX. This was the first due date of my new loan. Then XXXX said they did not submit the correct paperwork to New York State for my loan modification, therefore I would have to sign and notarize another loan modification, but now at a 4.25 % interest rate since the Federal Reserve had been increasing interest rates between XXXX and XXXX. I now pay {$120.00} more each month due to no fault of my own which is {$43000.00} ( = 30 years * XXXX mos/yr * {$120.00} ) more I have to pay now over the next 30 years. On XX/XX/XXXX XXXX acknowledged that they received my 2nd set of signed and notarized documents for my Loan Modification and that it would take 30 calendar days for my account to reflect these changes. My account has still not been updated. Since they are dragging their feet to update my account, I can not make ACH automatic monthly withdrawals to pay my loan. I have had to call them each month since XXXX, my initial payment on my 2nd loan modification, to make a payment over the phone. I have called them countless times this year to speak them. Each time they assure me someone from XXXX will email me or call me to address these issues within XXXX business days. No one ever contacts me back. The whole reason I have had to do a loan modification is because I suspended my mortgage payments during the pandemic because I was laid off due to no fault of my own.

This is my second complaint regarding XXXX. The first one was closed out as they responded, however, this remains on-going as they have not RESOVED the matter. I have been attempting to remodify my loan since XXXX 2021. In the early part of the year I was told a number of times I needed to sign a Power of Attorney. This was clearly untrue as I am of sound mind. Eventually this was resolved and I was sent a second set of documents. On XX/XX/XXXX I spoke to a woman named XXXX on the phone. She stated that the last two times paperwork had been sent to me that they had not received Partial Claim/Promissary Note paperwork back, indicating this was the issue. I informed her that this document had never been sent to me and I had copies of all the documents as proof. I informed her that I had every intention of signing this paperwork, wanted it immediately, as I have wanted this resolved since XXXX, 2021. On XX/XX/XXXX she stated new paperwork was being sent out. OnXX/XX/21I still had not received this paperwork and spoke to someone name " T ''. He informed me that the paperwork had again not been ordered or sent. He claimed it would be sent that day. At that time I requested to speak to a supervisor. I spoke to XXXX XXXX who told me he would now be my " case manager, '' and would be handling the resolution of my case. He emailed me and told me I could email him anytime to check the status of my case. XXXX XXXX stopped responding to my emailed after I contacted him twice. Please take note that the customer service reps do not provide their full names and it is impossible to speak to the same person twice. I have contacted customer service through the email portal on loan care and receive a ticket and no follow up is given. I find it difficult to believe your bank is unaware of their poor service as after investigating this, there are reports of this all over the internet. I have included the second and last email response on XX/XX/XXXX, from XXXX below. I was told by XXXX that a mobile notary would be coming to my home with paperwork on XX/XX/21. When I called over a week later, it had not even been sent out until XX/XX/21. I received a call yesterday telling me the paperwork was sent out and asking if I was going to be sending it back. I informed the rep. I did not receive the paperwork! She confirmed the notation regarding the notary and was uncertain if it had actually had been sent out to them yet and said it had to be escalated, yet again, which would take 3-5 days, AGAIN! Nobody ever has an answer, including so called supervisors. As a reminder, this has been on-going since XXXX/21.

The company holds my payments after they receive it they take days/weeks to cash the check and apply it to my account. ( this happens every month ) The company charges fees with no explanation.
The company claims that I have missed payments and that I am late however I have the documentation to prove that I have made all my payments.
When I call the company and ask questions about payments and fees I do not get straight answer When I call the company, I am put on hold for long lengths of time and then I get transferred you to another agent. This has happened every time I have called.
I do not have all the dates and times that I have corresponded with the company but it has been many times over the past few years after my loan was transferred to them.
They post that my payments have been late since day one, Would like to know how they came up with that calculation.
They send letters to my house stating I owe money and they can possibly foreclose.

I have requested the loan servicer, Lakeview Loan Servicing LLC ( XXXX ), to establish the escrow account so that my monthly payments would include the property taxes and insurance. I have brought this attention to them multiple times via the phone and the email, and yet they have not responded to me. My first payment is XX/XX/2021 and every time I called them they keep on pushing back the date of completion for this loan escrow analysis. I have submitted multiple tickets with them on the same matter, ticket numbers are XXXX, XXXX, XXXX, and XXXX. The first time was submitted on XX/XX/2021, more than 2 weeks ago. There was system generated confirmation from XXXX confirming the receipt. I also attempted to email the servicer via their email at XXXX, and have not gotten a response as well. In fact, I spoke with the customer service supervisor, XXXX at XXXX, and I was promised this would be done.
As of today, XX/XX/2021 I have not receiving any correspondence from the company regarding the changing in my monthly payment due to my request for the escrow account even though all the paperwork was submitted.

I am in dire need of urgent assistance with my mortgage Lender, Lakeview Loan Servicing , LLC, C/O : XXXX. I recently received my current monthly statement that shows my monthly payment has doubled. I have not fallen behind on my mortgage payments. I also noticed on the invoice statement, that I have incurred asserted attorney fees in the amount of {$480.00}. I contacted customer service, which advised me to pay the fees to avoid going into default on my loan. To date, I have made all of my payments in a timely fashion, ( excluding legal public holidays, Saturdays, and Sundays ). My payments are normally mailed at the end of each month.
I am asserting that the Service Lender charged this fee ( {$480.00} ) without a reasonable basis to do so, therefore ; I am requesting supporting documentation from the Service Lender, regarding their deceitful asserted impermissible fees that they have financially imposed on me. According to the Real Estate Settlement Procedures Act ( " RESPA '' ), an institution lacks a reasonable basis to impose fees that are not bona fide, such as ( i ) late fee for a payment that was not late, ( ii ) a charge for a service that a service provider did not actually provide, ( iii ) a default management fee for borrowers who are not delinquent, or ( iV ) a charge for forced-placed insurance that is not permitted by 12 CFR 1024.37 ( 12 CFR Part 1024, Supp. I., Comment 1024.35 ( b ) -2 ). I received information from Lakeview Loan Servicing , LLC on or about XX/XX/2019 indicating that " Recoverable Corporate Advance Fees were paid with Servicer funds, but are to be recovered by the borrower ''. This appears to be a deceptive predatory practice by the Servicer with no supporting documentation of rule.
My modification contract with Lakeview Loan Servicing , LLC does not specify any recovery corporate advanced fees involved in my repayment of the loan. So, why am I being charged this fee?

Submission of each email has generated 3 separate acknowledgement emails advising that XXXX received my emails and would respond shortly. To date, NO RESPONSE HAS BEEN RECEIVED for ANY of these emails! Multiple calls have been placed to XXXX to follow up. Each time I have been instructed to submit another email. I have a government-backed FHA loan and believe that I have been unlawfully denied a XXXX Forbearance and/or Modification from my loan servicer, Lakeview Loan Servicing , LLC XXXX XXXX XXXX XXXX XXXX
I have serious fraud concerns regarding my mortgage servicer, Lakeview Loan Servicing , LLC., and how they have continued to bill me for past due late charges and additional unpaid fees in the amount of {$3800.00}, while the Homeowners Assistance Fund Program have been negotiating with their Loss Mitigation Department XXXX determining the amount of XXXX XXXX XXXX funds needed to satisfy my mortgage arrears and late fees. I feel these additional charges and fees in the amount of {$3800.00} are bogus and inaccurate. After contacting my mortgage servicer and the XXXX XXXX customer service department, I was assured that I would not be responsible for any accrued late fees or charges while my application was in the active process status. Lakeview Loan Servicing , LLC has currently billed me each month for additional accrued late fees and other unknown charges, while the XXXX XXXX was actively processing my application. All arrears, unknown alleged charges, and fees have been satisfied through the XXXX XXXX XXXX.
I spoke with XXXX from Lakeview Loan Servicing , LLC on or about XX/XX/2022, regarding my concerns with the inconsistent fee overages added to my mortgage. She indicated that there was a possibility that the fees could be corporate fees, which implied that I, as the homeowner was not made aware are of such a fee. She informed me that she would fact check and research the matter and contact me back in a timely fashion. To date, I have not heard from her or anyone from the mortgage servicer.
Summary XXXX XXXX Award Assistance : XXXX ). I initially applied and was approved for the Homeowners Assistance Funding Program on or about XX/XX/2022, to assist me with mortgage arrears where XXXX caused my financial hardship. I received an Award Summary amount of {$31000.00} from the XXXX XXXX program, which was the amount agreed upon to bring my mortgage arrears, late fees, and other charges current.
XXXX ). I requested and received an additional 6 months of mortgage assistance from the XXXX XXXX program on or around XXXX of XXXX, because of my ongoing XXXX financial burdens and was approved for an Award amount of {$5300.00}. This funding was received by Lakeview Loan Servicing , LLC on XX/XX/2022, which should have satisfied any outstanding arrears, and current monthly mortgage payments.
I am requesting that this matter regarding Lakeview Loan Servicing LLCs shady business practices, be thoroughly investigated by your office. I feel they have certainly taken advantage of the XXXX XXXX XXXX program, which has greatly aided me during these financially burdensome times.

I am the trustee of a living irrevocable trust that my parents home is a part of. This mortgage company is trying to include the taxes on this home in my debt to income ratio.
I told them that this is incorrect and they should not include this, because as a trustee, I have no ownership or interest in my parents home.
I even showed them the tax bill stating that my parents pay the taxes.

My mortgage was in Forbearance due to Covid- I worked with the NY Housing Assistance Program to get caught up - which I did. I on multiple occasions requested a forbearance when I again got behind on my mortgage which was denied every time I requested. The entire time I was requesting a forbearance- I was again working with the NY Housing Assistance Program for funding. NY HAP was in regular communication with XXXX regarding my application for the program funding and in XX/XX/XXXX XXXX still put my home in foreclosure status and started charging my account tons of Attorney Fees & FC Expenses & Late Fees. At the beginning of 2023 I opened a savings account so that I could use it specifically for my mortgage payment and nothing else. Prior to opening the account, my partner and I were using his savings account but I wanted to have an account that was just for the mortgage, and I opened my savings. Unfortunately, I had gotten my savings account number and my partners confused and our mortgage payment kept bouncing. I had discussed these happenings with the service handler, which is Lakeview Loan Servicing, which is a subservice of XXXX and we tried to figure out why we were seeing returns, because it wasn't showing up in my bank account til my partner realized I had HIS bank account listed in our online, XXXX Lakeview account. Needless to say we corrected it right away and we made all the payments again, that had not been applied to our mortgage account. However, since we have corrected the error and made the payments, Lakeview says WE NEVER MADE THE PAYMENTS. This is false. We made the new payments and they had gone through my bank without a problem. Lakeview repeatedly tells us they were returned to the bank for insufficient funds. The payments were not returned to our bank. When we called them, they repeatedly and intentionally put us on hold and never came back. This was done several times to us and as I type this, the rep named XXXX has put me on hold on purpose and has not come back, after 30 minutes waiting, a rep by the name of XXXX took the call. She says the payments that Lakeview physically had in their possession, were returned for insufficient funds. How does that work exactly?
Other reps denied that there was any money available to apply to my mortgage. I feel as if they are intentionally trying to make us late so they can start a foreclosure. I'm actually frightened. All I want is a mortgage servicer that I can trust and is not shady. How can I switch mortgage handlers? - XXXX XXXX

Back around XXXX I refinance my mortgage. Besides looking for a lower rate, i wanted to get away from my current lender Lakeview. I feel they are shady. My first payment due with XXXX XXXX was XXXX. I made my first payment of {$3000.00} on or around XX/XX/XXXX. This payment would be for XXXX A week or two later i was notified that my loan with XXXX XXXX was taken over by Lakeview , I received a statement from Lakeview , made a {$3000.00} payment in XXXX around the last week of XXXX, which that would be for XXXX. I noticed the statement did not show my first payment made. I reached out to XXXX XXXX, they informed me once the loan transfer was completed Lakeview would up date their records. On XX/XX/XXXX around XXXX XXXX, i believe her name was XXXX , from Lake view said she did not see the first payment made in XXXX with XXXX XXXX and was notifying another department and i was to call back around the XXXX of XXXX. I asked her ; if they would notify me directly and she said she was not sure, i should reach back out. Really, so unprofessional. XX/XX/XXXX, XXXX, I believe the persons name was XXXX was not helpful at all. She said my next payment was due for XXXX, did not see a documentation of my pervious call etc.. Last week of XXXX, i made another payment of {$3000.00} and to date my statements are incorrect. 1 ) i should be a month ahead, 2 ) should reflect 4 payment received 3 ) i told them twice, i am unable to log in to the site to see my account. I was told my tech dept i needed to wait for an email approval. Guess what, its be two months no email.
Last week i received a statement my acct is short- {$18.00}, there fore my payments are going up. not even the option to pay the difference to keep my present payment. If someone pays the difference, their payments should not increase. This is a constant issue i have with LakeView in the past.
I want to know where my first payment is. This loan company is so shady someone really needs to look in to this deeply. From their Customer Service to their Tech Dept. no one knows what they are doing.

I was put on a forbearance plan until XX/XX/2020. When I tried to make a payment on XX/XX/2020 the representative who took my information told me he was unable to reprocess the payment due to an error on his end and put me on a deferment without my consent. I am in the middle of refinancing my property and the deferment they put me on is stopping me from doing so. Ive reached out to several departments including their loss mitigation department and no one is willing to assist me. I keep getting a run around and being told that someone will call me back, and nobody has called me back. I need to resolve this issue so Im order to refinance and not have to pay penalties or extra points
