OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm: a) On or about 7/19/2016, at 960 Broadway, Albany, NY, employer failed to conduct a hazard assessment to determine whether hazards were present and in such quantities to necessitate the use of respiratory protection as personal protective equipment when assigning three employees to perform demolition at this location when there was reason to believe, under the circumstances of the situation, that hazards necessitating the need for respiratory equipment were present and that such equipment was not being provided by the host employer. Feasible means of abatement include, but are not limited to, documenting discussion with the client/host employer pertaining to the presence of asbestos or lead at the jobsite and absence of personal protective equipment being provided by the client/host employer. |
