1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system, or were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b). The employer does not require the use of fall protection during construction work activities. These violations were most recently observed at: 809 Oswego Road, Liverpool, NY 13088, as described below: a)West end of home, addition, on or about 4-18-12: Two employees were staging roofing materials on a roof , without fall protection, exposing the employees to a fall hazard of 10 feet. b)West of home, garage, on or about 4-18-12: Five employees were stripping shingles from a roof without fall protection, exposing the employees to a fall hazard of 8 feet. To abate this violation, the employer must ensure that its employees engaged in construction work are protected from falls, and that no employee is allowed to work on a walking/working surface with an unprotected side or edged which is six feet above a lower level without adeuate Pursuant to 29CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from fall hazards. 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards. The employer does not provide fall training for employees conducting construction work activities who are exposed to fall hazards. These violations were most recently observed at: 809 Oswego Road, Liverpool, NY 13088, as described below: a) Entire worksite, on or about 4-18-10: Five employees were performing roofing tasks without the training necessary to recognize the hazards associated with their work. To abate this violation, the employer must ensure that it its employees engaged in construction work are trained in the hazards from falls, and that no employee is allowed to work on a walking/working surface with an unprotected side or edge which is six (6) feet above a lower level without adequate training. These violations were most recently observed at: 809 Oswego Road, Liverpool, NY a) East side of garage, on or about 4-18-12: Employees were using a portable ladder for access/egress to a roof which was not extended 3 feet above the landing surface, exposing the employee to a fall hazard of 17 feet 3 inches. To abate this violation, the employer must ensure that all ladders that are used to access an upper landing surface have the side rails extend at least 3 feet above the upper landing surface being accessed.
