29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about 06/20/16, on a construction site at a house undergoing renovations at 90 Crosby Blvd., Amherst,NY: Employees engaged in construction work including demolition, roofing & siding work , and general renovation work were not trained to recognize potential hazards on this type of jobsite, including but not limited to falls from roofs, ladders, skylights, stairs & scaffolds, electrical hazards, unguarded tools/machines, fire hazards, and the need for personal protective equipment to protect them from various hazards. They also were not trained in the applicable OSHA regulations to control or eliminate these hazards. ABATEMENT CERTIFICATION REQUIRED |

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access: On or about 06/20/16, on a construction site at a house undergoing renovations at 90 Crosby Blvd., Amherst,NY. A ladder jack scaffold was erected with the brackets on the outside (street side) of the support ladders. The employee had to climb over the bracket to get on the pik which was approx. 13 ft. above the ground. A separate access ladder was not provided. NO ABATEMENT CERTIFICATION REQUIRED |

The pik extended over the end of the west support bracket by approx. 5 ft. and extended over the end of the east support bracket by approx. 1 ft. The employee was on the west cantlevered part of the pik when the scaffold collapsed and the employee fell approx. 13 ft. to the ground. NO ABATEMENT CERTIFICATION REQUIRED |
