29 CFR 1910.1001(j)(2): Installed Asbestos Containing Material. Employers and building owners are required to treat installed TSI and sprayed on and troweled-on surfacing materials as ACM in buildings constructed no later than 1980 for purposes of this standard. These materials are designated "presumed ACM or PACM", and are defined in paragraph (b) of this section. Asphalt and vinyl flooring material installed no later than 1980 also must be treated as asbestos-containing. The employer or building owner may demonstrate that PACM and flooring material do not contain asbestos by complying with paragraph (j)(8)(iii) of this section. a.) Facility - On or about 12/22/14, the facility was built in ~ 1962, and contains 9x9 flooring tiles (mastic) throughout the facility. The flooring is stripped and buffed on a periodic basis. The employer did not treat flooring installed prior to 1980 as asbestos containing material; and/or did not treat PACM and/or flooring installed prior to 1980 as asbestos containing material. Facility - On or about 12/22/14, the employer had not recorded all workplace injuries. The 2013 OSHA 300 log showed no injuries occurring in the calendar year 2013. 1.) On 7/7/13, a cook sustained a burn on right foot, resulting in 1 lost day. The injury had not been recorded on the log. 2.) On 8/5/13, an office Manager presented with tenosynovitis R wrist from 'continuous computer work' at the facility. The employee received medical treatment and was restricted form her typical work. The employer had not recorded the injury. |
