Complaint What Happened XXXX XXXX of XXXX sold me a lemon car XX/XX/XXXX when I drove off there premises after waiting almost 2 weeks just to get I wanted my money back and couldnt they told me it would be even longer when I did it through my debit card XX/XX/XXXX I almost XXXX because the car completely went out on me Im XXXX XXXX XXXX now I got a police report and everything I informed everybody about the situation XXXX XXXX XXXX XXXX of XXXX which they never ever got back to me I had to keep calling them into the last call where it says one minute on my phone bill they financial manager said call my bank and dispute it with them then hung up on me now they telling my bank I never complaint which I have proof I did since day One and they kept giving me the run arounds they lied about the car the car mileage and everything to it soon as I got the car 2-3 weeks later ac wasnt working they told me to put XXXX in it myself I did and it went away probably like 2 weeks did it again and still it happened again I really try to switch and or give it up but they kept saying come back in 6 months did then they say I need to have the car for a year came back this year in XXXX they told me I need 6 more months like there no help at all Im XXXX and they there the only people. Thats stressing me out to the point I was XXXX XXXX because of them even my doctors know its my first car and they did me so wrong XXXX XXXX know everything but they keep Putin these miscellaneous charges on me when they know the situation and I havent had the car since XX/XX/XXXX I surrendered the car also sunbit XXXX tell them they paid for it when I paid for it my debit information have it where I paid them to fix something then 2 months later my car breaks down completely the whole alignment thats how bad the car was sunbit is tryin to work with me but Im explaining Im not goin to keep paying for something that I dont have and had issues with I really need help with all of them even XXXX XXXX of XXXX ruining my credit because they keep acting like everytime I came they was goin to give me or switch a car then to get the run arounds like I have to come back after a certain amount of months I want nothing to do with them I just want my money back that I put down on the deposit I have bank statements and phone bills I paid for it XX/XX/XXXX but didnt get the car to XX/XX/XXXX when they gave my XXXX XXXX which was also to high on pay and they also gave me miscellaneous charges after I closed them out before XXXX its becoming extremely messy I try to write the whole world for help and its like some people tryin to help and some cant because they dont get back to you at all the front desk lady transfer you to managers and you get a voicemail you leave one you still wont get a return this is the worst experience I ever had and again Im XXXX I could of XXXX in there car then what would of happened how would this outcome go because my mom and my XXXX XXXX XXXX daughter was with me my entire time every time I went even when I first got the car the mechanics said I should of tooken a man and everybody I spoke to thats so sad they do this to females I trusted them my first car and they didnt car at all they gave me what they wanted and it was late so I couldnt even be like no or nothing we was all tired being there day to night to there closing time to having to come back the next few days waiting to see if the car is ready I have so much proof in my phone it makes no sense and the way they lying is ridiculous its sad people have to tell me I should of tooken a man with to get my first car but I didnt know I was just so stoked on getting my car I need help please its also better if I say it then write because its just a lot please somebody help me!!!

Complaint What Happened On XX/XX/2023 I sent a legal notice to Sunbit Now, LLC ( " Sunbit '' ) rescinding my consumer credit transaction with them. There were several grounds enumerated such as : ( 1 ) failure to provide full disclosure of my right to rescind in accordance with the Truth in Lending Act ( TILA ) ( 15 U.S.C. 1635 ) and Regulation Z ( 12 C.F.R. 226.23 ) ; ( 2 ) transparency regarding the process of consumer credit application being the financial asset ( 12 C.F.R. 360.6 ( 2 ) ) as well as self-liquidating paper ( 17 C.F.R. 260.11b-6 ). There were also other TILA violations and I reserve the right to raise them -- both federal and state -- at arbitration and in federal/state court. By operation of law, upon receipt of the notice this transaction is void and Sunbit has twenty days from receipt to return all monies paid in connection with the transaction ( 15 U.S.C. 1605 ( a ) ). Yet, more than twenty days has past and Sunbit has not returned the monies owed. Additionally, they continue to perpetuate fraud and send harassing emails for payment on a loan ( " agreement '' ) that is void by operation of law. Moreover, Sunbit continues to report a balance owed on this voided loan to all three major credit reporting agencies in violation of the Fair Credit Reporting Act ( " FRCA '' ). Sunbit take notice that this action constitutes a violation of the FCRA and I will not hestitate to pursue remedy by means of arbitration and or by federal law suit. Moreover, I never gave Sunbit my permission to disclose nonpublic personal information. Any consent- whether verbal, non-verbal, written, implied, or otherwise is revoked. Additionally, Sunbit never informed me of my right to opt-out of disclosure as required by law. See 15 USC 6801, 1681b ( a ) ( 2 ) ; see also P.L. 90-321 ( 82 Stat. 146 ). 15 USC 1681C ( a ) ( 5 ) states " [ e ] xcept as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information : Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item ( which is not a record of convictions of crimes ) that Sunbit and XXXX are reporting without my permission. This is against the law. 15 U.S.C. 1681s2 ( a ) ( 1 ) ( A ) further states " [ a ] person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. ''

Complaint What Happened Consistent with Congressional policy, I have the right to ensure my private information is not shared without my consent. 15 USC 6801 states " [ i ] t is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' Sunbit Now, XXXX ( " Sunbit '' ) is a financial institution by definition under that title. See also 16 C.F.R. 314.15. 15 USC 1681 ( b ) ( 2 ) states that " [ i ] n general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' See also P.L 90-321 ( 82 Stat. 146 ). Sunbit does not have my consent to furnish this information and they surely do not have my written consent. This lack of consent is confirmed by the attached legal opt-out notice. Moreover, 5 U.S. Code 552a ( a ) ( 4 ) and 5 U.S. Code 552a ( b ) ( 12 ) ( hereinafter the Privacy Act ) protects my right to privacy. Under the Privacy Act, subsection ( a ) ( 4 ), the term records include a consumer report. The disclosure of a consumer report ( a record ) under the Privacy Act can not be furnished without the prior written instruction of the consumer ( the individual to whom it relates ). Sunbit does not have my written consent to publicly furnish these records nor can they produce the same as it was never given to them. Additionally, 15 USC 6802 ( b ) ( c ) states that [ a ] financial institution may not disclose nonpublic information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. Sunbit never informed me of my right to exercise my nondisclosure option. And per the enclosed notice, I revoked any consent - implied, express, verbal, or non-verbal- to which Sunbit may have been relying on is legally revoked indefinitely. 15 U.S.C. 1681s-2 ( A ) ( 1 ) states : [ a ] person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that information is inaccurate. Also, 12 CFR 1016.17 states that [ a ] consumer may exercise the right to opt-out at any time. I am opting out of Sunbit and XXXX 's reporting of this account. Accordingly, Sunbit has received lawful notice of my opt-out of their reporting of the following account to non-affiliated third parties- such as XXXX. Thus, Sunbit is not lawfully permitted to continue to reporting this account on my XXXX report.

Complaint What Happened I received the first notification by the Sunbit company of the past due payments of a purchase I have not made in the middle of XXXX. I thought is was a scam. I received another notice in the middle of XXXX at which time I attempted to contact Sunbit via the phone number on the letter but only received a recorded message ( offering a product ). I was notified by XXXX that I had a negative response reported by XXXX. A new acct was opened in my name with XXXX/Sunbit for the amt of {$1000.00} to be repayed in monthly installments and a different number was listed. I contacted Sunbit to tell them that is was not my debt and request a copy of the original purchase. They were unable to supply it but gave me the name ot the company that the acct was for ( XXXX XXXX ) and the date the acct was opened ( XX/XX/23 ). The acct was opened in my name with a new email and phone. I filed a dispute re : an inaccurate new account on XX/XX/23 with XXXX which they notified me today XX/XX/23 that they have verified the account as accurate. I placed a security freeze and a fraud alert with XXXX, XXXX, and XXXX today XX/XX/23. I attempted to file a complaint with FTC but was directed to CFPB for this type of complaint ( credit reports and debt collection ). After Documenting this report I am instucted to file a report with my local police dept. I will do that today.
