29 CFR 1910.146(c)(2):If the workplace contains permit spaces, the employer shall inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces. NOTE: A sign reading DANGER -- PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign. a) Worksite - On or about June 17, 2022, permit-required confined spaces, including but not limited to the drums, were not labeled as permit spaces. Periodically, employees open a hatch on the drum and add chemicals, check pH, remove skins, or (rarely) enter the drum to remove a knotted skin. Employees typically perform most work by using a stick to drag skins, or reaching in with their hands (and thus breaking the plane of the hatch opening). |

The written program shall be available for inspection by employees and their authorized representatives. a) Worksite - On or about June 17, 2022 the employer did develop and implement a written permit-required confined space program to address employees entering permit spaces. Periodically, employees open a hatch on the drum and add chemicals, check pH, remove skins, or (rarely) enter the drum to remove a knotted skin. 29 CFR 1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) Worksite - On or about June 17, 2022, the employer did not establish an energy control program to address the servicing and maintenance of equipment, including but not limited to: tanning drums. For example, when an employee enters a drum to remove a knotted skin, there need to be documented procedures to deenergize and prevent the drum from turning. These procedures need to address, in this example, stored electrical and mechanical energy. |
