OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Location: 29 Wells Ave Yonkers NY 10701 - Movie Studio a) On or about November 24, 2021, the employer did not ensure employees remain on the platform ground - an employee was elevated by a Genie GS-4069DC Scissor Lift, approximately 30ft, above the ground while standing on wooden planks that were placed on the guardrails and were used as a platform without any fall protection. Planks are not allowed to be placed on the guardrails inside a powered industrial truck for employees to use as a working platform. b) On or about November 24, 2021, the employer did not ensure employees remain on the platform ground - two employees were elevated by a JLG LE-4069 Scissor Lift, approximately 30ft, above the ground while standing on wooden planks that were used as a platform without any fall protection. Planks are not allowed to be placed on the guardrails inside a powered industrial truck for employees to use as a working platform. c) On or about November 24, 2021, the employer did not ensure any modifications or alterations to a powered industrial truck (JLG LE-4069 Scissor Lift) that may affect the safe operation of the truck were not made without the prior written approval of the original truck manufacturer or its successor thereof. When the truck manufacturer or its successor approves a modification or alteration, appropriate changes shall be made to capacity plates, decals, tags, and operation and maintenance manuals. The employer installed a plank platform on the guardrail of the power industrial truck. |
