I am writing to complain about how Axos Bank, doing business as XXXX XXXX, acted in bad faith by not alerting me to important changes regarding the rate of return of my Savings account.
In XXXX of 2022, I opened a Savings account at XXXX XXXX. There was only XXXX savings account offered, and it was called XXXX XXXX. My online statement was simply labeled Savings, not XXXX XXXX. Even as I write this letter, nowhere on my online statement does XXXX XXXX appear just Savings.
As the XXXX started to raise interest rates, XXXX website continued to herald their increasing Savings account rate which, I assumed, my account was earning. But in an obvious slight-of-hand, at some point as rates were increasing, they changed the name of their XXXX account from XXXX XXXX to XXXX XXXX, which was the only savings account paying the advertised interest. I was never alerted to this and neither the name XXXX XXXX or XXXX XXXX appears on my statement just the word XXXX.
I had no way to know that even though the bank did not even offer XXXX XXXX accounts to new savings clients, they simply kept my account as a low-interest XXXX XXXX account, earning only a little over 2 % ( the rate when the account was opened XXXX months ago ) instead of the ever-increasing rates of return they offered on their newly named XXXX XXXX accounts over the last XXXX months. As rates have almost doubled in that timeframe and with almost {$250000.00} consistently in that XXXX XXXX account from the start -- the lost amount of interest I should have been paid is significant.
Changing the name of the savings account which paid the ever-higher interest rates without alerting me or making it obvious on their website is deception of the worst kind. It was both deceitful and unethical. The least they could have and should have done is to alert me to this change, and give me the opportunity to switch to the higher yielding XXXX XXXX.
When I recently discovered all of this, I demanded they retroactively pay me the interest I was entitled to and they refused. I believe Axos bank, XXXX XXXX XXXX, should be held accountable for their actions and ordered to pay me the interest my account rightfully should have earned.

On the early morning of XX/XX/XXXX I had my phone and wallet stolen. The person who had stolen it, used my credit and bank cards to spend throughout various places in XXXX and the XXXX. I immediately reported all of my items lost to the respective companies and reported all fraudulent charges as soon as possible ( roughly between XXXX XXXX on XX/XX/XXXX ).
My credit card companies immediately refunded the money spent fraudulently and conducted their own investigations. However, AXOS Bank who manages my checking account claimed I would be protected but after XXXX XXXX, I have had my claim for {$1600.00} rejected twice. Upon asking why this was the case and if i could have documentation, they have sent me to multiple different customer service representatives who were unaware of the situation. Further when I was finally able to speak to a supervisor, she told me the claim was denied " due to investigations made by upper management. '' I am now over XXXX XXXX since the initial investigation was conducted and denied and still have not been given any information as to why.

The folks at AXOS BANK aka XXXX XXXX XXXX have a deposit availablity policy in violation of regulation cc, my deposits are on hold for a minimum of 7 days and have been held for as much as 10 days with no explanation.
Regulation CC states when deposits of various types must be made available to your customers, measured in business days following the banking day on which the deposit is made. Business days are defined as Mondays through Fridays except federal holidays. A banking day is any business day ( up to the bank 's cut-off hour ) when your institution is open for substantially all of its banking activities. All references to the number of days to funds availability in this guide indicate maximum time limits for making funds available ; your institution may provide earlier availability of funds if it chooses and may extend the time when funds are available up to periods set by Regulation CC on a case-by-case basis.
The following types of deposits must be made available on the first business day following the banking day of deposit ( " next-day availability '' ) : Cash deposited in person to one of your employees.
Electronic payments received by your institution for deposit in an account -- An electronic payment ( a wire transfer or an ACH credit ) is considered received ( deposited ) when your institution has received both payment in collected funds and information on the account and the amount to be credited. ( Under other rules, funds for most electronic deposits are made available on the day of deposit. ) U.S. Treasury checks deposited in person to one of your employees or at an ATM owned by your institution ( a " proprietary '' ATM ) and into an account held by a payee of the check.
U.S. Postal Service money orders deposited in person to one of your employees and into an account held by a payee of the check.
XXXX XXXX XXXX and XXXX XXXX XXXX XXXX checks deposited in person to one of your employees and into an account held by a payee of the check.
State or local government checks deposited in person to one of your employees and into an account held by a payee of the check, if your institution is in the same state as the payor of the check. ( Note : If the customer desires next-day availability of funds from these checks, you may require use of a special deposit slip. ) Cashier 's, certified, or teller 's checks deposited in person to one of your employees and into an account held by a payee of the check. ( Note : If the customer desires next-day availability of funds from these checks, you may require use of a special deposit slip. ) Checks drawn on an account held by your institution ( " on-us checks '' ) deposited in person to one of your employees or at on-premises ATMs or night depositories.
The Expedited Funds Availability Act requires up to the first {$200.00} of a non- '' next-day '' check ( s ) to be made available the next day.
Exceptions : When deposits of types 1, 4, 5, 6, and 7 are not made in person ( for example, when they are made at one of your ATMs ), the funds must be made available by the second business day. Deposits, cash or check, made at an ATM that you do not own ( a " nonproprietary '' ATM ) must be made available by the fifth business day.
For checks of types not discussed above, funds generally must be made available in accordance with a schedule specified in Regulation CC. That schedule differentiates between " local '' or " nonlocal '' checks. Since there is now only one XXXX XXXX check-processing region, however, there are no longer any " nonlocal '' checks for purposes of Regulation CC.
Funds from local checks must be made available by the second business day following the day of deposit.
There are minor exceptions involving, for example, certain checks deposited outside the continental United States and cash withdrawals of the proceeds of certain checks. A detailed explanation can be found in section 229.12 of Regulation CC.
But remember, the Expedited Funds Availability Act requires the first {$200.00} of a deposit that is not already subject to next-day availability to be made available by the first business day following the day of deposit.
This does not apply to deposits at nonproprietary ATMs or to deposits subject to certain exception holds. Further explanation can be found in section 229.13 of Regulation CC.

I have been trying to log into my AXOS checking account to pay my mortgage since Saturday, XXXX/XXXX/2022. I recieved a message that they are performing scheduled system maintenance. I tried again unsuccessfully on Sunday, XXXX/XXXX/2022, so then I called the bank where I was told their servers were down but the expect the problem to be resolved within a couple of hours. I tried again today, Monday XXXX 2022, and I recieved the same message that they are performing scheduled systems maintenance. I took a screenshot in case you need to see. I called the bank and was told there is no problem, my account has been frozen until further review, which could take 24 to 48 hours. I asked to speak to someone with more information, perhaps her boss, and was told she can not transfer phone calls. Having received three different responses, I don't know what to believe, and I have NEVER been told I can not be transfered to someone that might be able to clarify the problem.

I transfer my monthly mortgage payment manually every month with an extra principle payment on time ( document attached ). XX/XX/XXXX, 3 mortgage payments were automatically transferred along with 3 additional principle payments. Only 1 mortgage and 1 principle payment was authorized by me. The two additional mortgage and principle payments were withdrawn without consent by Axos bank. This large debit pushed my checking account into an overdrawn status.
Multiple failed attempts to get their customer service on their provided number of XXXX have been unsuccessful. I have been put on hold for> 40 minutes at a time with an automatic disconnection terminating the call. This has been going on since XX/XX/XXXX. The only viable form of communication is through their internal messaging center with questions and solutions not being offered. ( copy of messages attached ).
I filed a dispute with XXXX which they reimbursed the unauthorized funds to my account. One partial payment was automatically applied of {$2100.00} by Axos into a suspense balance which I have requested a refund for. To date I have not received it. This would bring my next payment due on XX/XX/XXXX.
Today XX/XX/XXXX I got a past due notice form Axos. XXXX states this is a resolved case and I can not get any one from Axos on he phone to explain, correct, or to answer my internal message.
I still have not gotten an answer why this happened or how to avoid it from happening again. I now have a past due status on my account that I have paid three months in advance.
This is time consuming and frustrating. I do not want this to result in delinquency status on my credit. Please help

I opened an XXXX mobile account on XX/XX/2020. I made my first transfer of {$150.00} to the XXXX account from my primary XXXX XXXX account on XX/XX/2020. And a second transfer on the following day, XX/XX/2020, of {$82.00}. There was no historical record or transaction confirmation provided by XXXX regarding my transactions which made me distrustful as it is hard to monitor money in this way and it also did not meet my needs. I decided to transfer my money ( the {$150.00}. and the {$82.00} ) back to my XXXX XXXX account but I couldn't because XXXX did not have the feature or capability to give me my money back. I emailed XXXX to get my money and I was told I had to get the money in my XXXX account through my XXXX XXXX account. Really? I tried to do that but XXXX XXXX told me the only way I could do that was by opening a dispute. After months of investigation, I received an email from XXXX XXXX now stating they can not get the money back from XXXX because they claim I made the transfer. I did make the transfer and then, wanted my money back and XXXX did not allow it in any way possible.
It gets worse. Today, XX/XX/2020, after receiving the email from XXXX XXXX and speaking to them to no avail, I called XXXX and spoke to a representative named, XXXX, who stated my XXXX account was closed prematurely due to technical difficulties. XXXX continues to have my money ( {$150.00}. and {$82.00} ) in their possession and have not notified me of the account closing nor has contacted me to return my money. It is now, that I called that I find out all of these and have been given the option to have my money transferred back to my XXXX XXXX. This option is only available because my account was closed prematurely and I found XXXX out on their doing. WOW. Please investigate this institution as they have with confirmation committed fraud and potentially are committing fraud with hundreds of other accounts. They most not be operational.

XXXX Axos Bank, XXXX XXXX, CA XXXX. Our normal communication is by regular US postal mail or my regular email. CD account matured on XX/XX/2022 & requested to close the account on XX/XX/2022. I was told to send them a " confidential '' e-mail of the bank to close the account ( they refused to do it over the phone ).
Two weeks later, I heard no response. I called the bank & was told that they had sent me a response through the " confidential '' email. You have to dig deep into their web site to find this " confidential '' email. Essentially, they stated that they will send me a paper check which will cost me {$10.00} or by XXXX {$50.00} +. MY interest of the CD account is only about {$100.00}. Since I passed their Grace period there will be another penalty of {$60.00}. Since you have other account, I will waive the {$10.00} check fee but you still have to pay the {$60.00} penalty to close the account.
First of all, I did not start with Axos bank. I started with the XXXX XXXX XXXX which was bought by AXos. Their action is illegal and is an act of highway robbery. It makes one vry difficult to close a CD account which has the lowest rate in the country.

Please see the below timeline : XX/XX/XXXX : Initiated mortgage process with Axos Bank ( signed initial disclosures ). XXXX closing was in XXXX.
XX/XX/XXXX : Have had numerous delays up to this point simply because Axos employees forgot/failed to process the submitted documents. They simply don't read emails or pick up their phones. On this date, I sent a correction email to the bank because they made an error in the closing disclosures with regard to local tax escrow. This tax payment is due XX/XX/XXXX, and should have been part of the prepaid portion of the mortgage. Email communications are available at your request.
XX/XX/XXXX : Mortgage was funded.
XX/XX/XXXX : I received a letter from the XXXX XXXX XXXX that the property taxes were not made.
XX/XX/XXXX : I tried calling several numbers/sending secured message via Axos website/using online chatting services on the website. No response received.
First, I do not want to bear late fees, because it was a failure by the bank. They should bear this fee and resolve this issue ASAP. Second, I do not want to escrow insurance and tax payments. I did not have other options because they said that rates will be higher if I opt out from escrow. Now that I see they are incapable of servicing loans, I do not wish to take my chances. LASTLY, I want the CFPB to take measures so that the bank will have capable employees to respond to these types of issues. I should not have to make complaints to the CFPB in the first place. My experience has been horrible and I do not wish anyone else to go through this.

My XX/XX/2021 mortgage payment was 2 weeks late and I paid it on XX/XX/2021 together with a late fee and I included XX/XX/2021 payment as well. Axos maintains that it was paid, for some reason put it a separate account and advised me that they would take care of it and mark it paid. Instead, I received a foreclosure notice, and another bill this month showing that the mortgage was not paid. My credit score dropped XXXX points and continues to spiral downward because they refuse to acknowledge the payment. I called repeatedly and am assured I would receive an email by the end of the business day that they notified and corrected the information wrongly sent to the credit agencies to no avail. I have the receipt that payment was made to Axos from my bank on XX/XX/2021.

On Saturday XX/XX/year> I made a mobile deposit with a check from the United States treasury. ( That is my daughters XXXX with both her name and my name, as well as both of our names on the checking account. ) I reached out to customer service to speak with a supervisor to ask some questions about the mobile deposit and was told I would have to wait 5 to 10 business days to get a call back from a supervisor. At XXXX Axos sent an email stating that the check was rejected. And now Im not able to cash it at the check cashing because in the back of the check I was told I had to write for mobile deposit only. So I was told by the check cashing place that I have to wait another 7 business days. Then Axos sends me a message on the Axos app at XXXX stating that the check was accepted, but I checked my account and there is absolutely nothing pending. And there has yet to be a supervisor to give me a call back to confirm or assist in the issue

I followed up with customer service who advised : Taking a look into your investment account, I do see you funded the account on XX/XX/XXXX. I followed up a 2nd time and Axos advised they would not be paying the bonus.

to whom it may concern i applied for auto refinance through XXXX XXXX XXXX loans i was approved, they matched me with axos bank before they lowered my monthly payments it XXXX for a XXXX XXXX elantra that i purchased in XXXX im on a fixed income i get my check once a month XXXX before the XXXX because of the account that i have with chimes bank which pays you XXXX before the due date # XXXX the didnt take that much off # XXXX they keep applying these late fees i have asked them severals times if they can lower my payments from XXXX to now paying XXXX a month is not helping me i'm not able to work due to arthrtis of the knees i only get XXXX from ssa a month after i pay my bills i have nothing left! i get calls for collections i get calls that my car is up for repo i asked them to please change my due date they tell me when i'm current on payments thats not going to happen because i pay on the XXXX or the XXXX then after the XXXX of the month it goe from the XXXX until the XXXX XXXX pass due then here comes the late fees i even tried to refinance my car again through the axos bank itself DENIED! THIS THE WORST BANK I EVER DELT WITH PLEASE CAN YOU LOOK INTO THIS MATTER I NEED MY CAR I HAVE MEDICAL ISSUES, THEY KNOW OF THIS, THIS BANK HAS NO EMPATHY FOR NO ONE IN THESE TRYING TIMES! ... ...
