29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks). (a) 3360 Milton Ave. Syracuse, NY 13219 on or about November 2, 2022, the employer provided 3M 6200 half-face respirators for employees to utilize voluntarily but did not implement elements of a respiratory program to ensure the employees were medically able to use that respirator. Abatement certification must be submitted. |

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met; specifically: 1) Labeling and other forms of warning; 2) SDS requirements for the hazardous materials known to be present at the jobsite; 3) Employee training and information. The written program must also include: (a) A list of all the chemicals used at the jobsite. (b) Methods to inform employees of hazards associated with non-routine tasks. (c) Methods the employer will use to inform any contractors employees of workplace hazards. (a) 3360 Milton Ave. Syracuse, NY 13219 on or about December 19, 2022, employee was exposed to chemicals while preforming work tasks. The employer did not develop and implement a comprehensive Hazard Communication Program for employee working with chemicals including, but not limited to, Prep-All Wax and Grease Remover, Evercoat Body Shop Pro Grade Fiberglass Resin, and Loctite Premium Construction Adhesive. Abatement certification must be submitted. |
