Im on XXXX XXXX member and a perk included is rescheduled payments. I used it on XX/XX/XXXX and rescheduled to XX/XX/XXXX. There are multiple issues : they charge a convenience fee for card payments, not when you use a bank, so i added bank and moving forward the payments were automatically deducted. Well on XX/XX/XXXX i payed ( rescheduled XX/XX/XXXX ) using bank to avoid convenience fee of {$1.00} - they did not disclose that they prefer bank payments or that it would take XXXX business days to process and that in that interim i would be blocked from using card with a false message that i had outstanding payments. Well it is XX/XX/XXXX and im unable to use app or request anything. Furthemore they sell a 30 day membership to sezzle anywhere im unable to use this product because i submitted a bank paymenti paid, on time, but because i used a bank it will be processing for XXXX business days- thats a week! they never disclosed that paying with a card is how you avoid processing times and what they actually prefer. Seems like payment discrimination and if i dont pay convenience fee it becomes an inconvenience to use the app. I have been blocked from using/requesting sezzle anywhere, but i paid 30 days of membership.. in their world i could go XXXX weeks being blocked from app and still charge XXXX membership because there are other loans issued and all will be payed through bank to avoid convenience fee therefore the account will always be processing payment very unfair practices- what agent says in screenshot is not actually posted anywhere as of XX/XX/XXXX when i made that payment. A payment is a payment, youre allowed to charge convenience fee but im not sure youre allowed to keep my account on hold or bad standing because i used bank. Id been using debit yet they charhed me XXXX each time, that adds up. Also, they dont allow you to turn off automatic payments, thats not an option.

Back in XXXX I purchased a wig from the XXXX when it arrived it wasn't as described. Hair was advertised as XXXX human hair and it came colored and processed. Made attempts to resolve it with the merchant They stopped responding I reached out to Sezzle and provided proof of what they were selling and what they gave. I had tried to return it and the mailer they gave me was not legitimate So I could not even send back. Sezzle kept referring me to the merchant who would not reply to me.
Secondly, on another purchase from XXXX, it was refunded and sezzle applied to wrong purchase so I have to continue paying on something that doesn't it exist and have separate payment dates as well. They refuse to allocate the funds correctly and insist that it was done correctly and even if it wasn't they said they have the right to do that. Also they are missing refunds I have sent them proof from both the merchant and XXXX who shows a process the refund. They offer me no recourse and they tell me that things have been escalated and to wait and definitely for a supervisor to Get a hold of me. I've asked several different times for information that was entitled to me. I just want information about what I can do They opened up an arbitrary dispute process for me then closed it Just to say they did it. They are growing increasingly more difficult to deal with and to get information out of. I have emails and documentation and all of that to prove the instances of consumer violations and regulations that they refuse to adhere to. It'd be one thing if it was just one agent or one representative I spoke to but it's all of them so this has to be a company practice I have all of the correspondences that we have and I record all the conversations now so if any other information is needed to further violate them and have them regulated I am more than willing to provide it.

It continues to appear as an active debt, despite it being written off and reported to the IRS as gross income, violating 15 USC 1681s-2 ( b ) and FDCPA 1692e. I WANT THIS ACCOUNT TO BE DELETE IMMEDIATELY NO CONSENT WAS GIVEN TO REPORT SUCH INFORMATION. I want to OPT-OUT OF SHARING. REMOVE ACCOUNT. Under IRS guidelines, once a debt has been charged off and reported on a 1099-C as gross income, it is no longer legally considered a collectible debt. Continuing to report such an account as charged-off or written-off, when the IRS has acknowledged it as income, violates 15 USC 1681s-2 ( b ) and constitutes false representation, as defined in XXXX 's XXXX XXXX. Furthermore, under Bankruptcy law, the debtors obligations are considered XXXX, and the debt should not be misrepresented as due or owing.
- FCRA ( Fair Credit Reporting Act ) 15 USC 1681s-2 ( a ) ( 1 ) ( A ) Prohibits reporting information that is known to be inaccurate or misleading. Reporting a charged-off account as an active debt violates this provision.
15 USC 1681e ( b ) Mandates credit reporting agencies to ensure maximum possible accuracy in consumer reports, which includes accurately reflecting a charged-off debt status.
15 USC 1681i ( a ) Requires proper investigation of disputed information and timely correction if inaccuracies are found.
FDCPA ( Fair Debt Collection Practices Act ) 15 USC 1692e ( 2 ) ( A ) Prohibits false representation of the character, amount, or legal status of any debt. Listing a charged-off account as active violates this clause.
15 USC 1692f Prohibits unfair or unconscionable means to collect or report a debt. Reporting a written-off debt as active is deceptive and harmful.
IRS Reporting Violations 26 USC 61 ( a ) ( 12 ) A charged-off amount reported to the IRS as gross income ( Form 1099-C ) indicates the debt has been forgiven. Continuing to report this as an active debt misrepresents the legal status of the account.
Key Points to Dispute Once a debt is charged off and reported to the IRS as gross income, the creditor acknowledges it as uncollectible. It can not legally remain an " active '' debt on the credit report.
Reporting this incorrectly inflates liabilities and damages the consumers creditworthiness, constituting unfair reporting practices.

Fair Debt Collection Practices Act ( FDCPA ) 15 USC 1692e ( 10 ) False or Deceptive Practices : Reporting a charged-off account inaccurately can be classified as a deceptive practice.

I purchased a XXXX costume from the merchant XXXX which totalled {$72.00} on XX/XX/23. To pay for the item, I used a third party Buy Now/Pay Later company called Sezzle. Sezzle issued me a XXXX card to pay for the item and I would pay Sezzle back in XXXX bi-weekly payments until the total is paid off. Unfortunately after receiving the item, I had to return it to the merchant. XXXX refunded me only {$53.00} because they charged me {$18.00} for a restocking fee which I don't have a problem with. The refund went back to Sezzle and they in turn would send me the refund. I made 3 payments to Sezzle totaling {$54.00} at the time the refund was issued to them. Sezzle refunded me {$35.00} and keeping {$18.00} which was the last and final payment I would have paid them had I not returned the item. I have been communicating with Sezzle by email requesting my full refund, but they refused to give me the remainder of my refund which is {$18.00}. Instead of them cancelling the last payment, they are charging me because they want to be compensated for the restocking that the merchant charged me. I feel I shouldn't pay for an item that has been returned and I would be paying the restocking fee twice. I've dealt with other 3rd party companies before in which I've returned items and gotten a full refund. Please help me get the rest of my money. Sezzle has probably done this kind of business to other customers and that's wrong.

I had a past due balance of {$210.00} with a company called Sezzle that extended credit to me. This past due balance of {$210.00} was showing up on my credit report. On XX/XX/year> I was able to save some money and pay off the debt, and was directed to send payment to the collection agency XXXX. XXXX does not own the debt nor do they report the debt to the credit bureaus, but are hired by Sezzle to collect on the debt on their behalf. Sezzle still owns and reports the debt. I paid the balance off and settled the account with XXXX on XX/XX/year> and they assured me that they will inform Sezzle that my balance is paid off. I waited almost 4 months for Sezzle to remove the debt off of my credit report on all 3 credit bureaus and they have not yet done so. The last time they reported to the credit bureaus was on XX/XX/year> when I did indeed still owe a {$210.00} balance. I have called and emailed with Sezzle and XXXX multiple times over the past 4 months to settle this, and have received XXXX support or sense of urgency to correct this issue. I even filed a dispute with XXXX and the dispute came back with absolutely no changes even though I attached screenshots of emails from XXXX confirming that the balance is paid off and that my debt isnt valid any longer. Sezzle needs to remove this from my credit report immediately as it has been almost 120 full days since theyve received payment from me and they are ruining my credit score.

I tried contacting XXXX XXXX after receiving a letter in the mail in an attempt to collect a debt in which I sent an email as one of the methods indicated for the dispute in regards to dealing with a third-party app named Sezzle not working on my behalf to deal with a fraudulent merchant that they sponsored on their website. The email was sent on XX/XX/XXXX, and they have yet to respond to my dispute nor acknowledge that they received my dispute. A week following I sent a follow-up email which they also have not responded to. The amount requested is {$760.00} which I deny and do not accept as a charge being that the merchant whom I purchased from was not as described and was not up to the company 's promise or standards.
A quick background on the debt : I made a purchase in XXXX of XXXX and have dealt with negligence from the merchant from the very beginning. I have called and been strung along, emailed over and over, and even contacted Sezzle, the third-party payment app to contact the merchant as well. Sezzle denied after several attempts to handle the situation or contact the merchant after getting no response from them either. Sezzle began to get very upset with me for contacting my original payment card used to dispute the charge due to fraud and mislabeling from the merchant on top of negligence and stopped offering to help me. After months of requesting a refund and offering to return the item for my funds to be returned, the company changed their refund policy online and I was not able to retrieve my funds due to this being a new term they added after my purchase and after my complaints. XXXX also has deleted my warnings and reviews from their online websites and social media accounts and only keeps positive reviews. I have reported the merchant to the XXXX and I was informing Sezzle of this negligence and constant fraudulent behavior constantly and even requested that they would remove this merchant from their app as a form of punishment. Instead of helping me as a consumer, Sezzle wanted to keep the merchant happy and was instead asking me to handle the situation on my own after months of no response and being at a standstill they have reported my debt to XXXX XXXX who are requesting for me to pay them the full amount before XX/XX/XXXX.

I have disputed with consumer reporting agencies back in XX/XX/2022 and sezzle verified this debt as accurate, despite proof.
They continue to report a balance of {$150.00} when this has been paid of.
I have written to sezzle with no resolution.
Sezzle is reporting a balance owed when this account was sold to XXXX XXXX who collected the balance. I have submitted proof to sezzle in writing showing proof that this debt was paid in full. Sezzle has continued to blatantly disregard FCRA Laws by reporting inaccurate information even though they are aware and were given proof. Under the FCRA as a furnisher of information, they are responsible for the completeness and accuracy of the information that they're reporting. This is the " SECOND REQUEST '' with the CFPB as Sezzle has not responded to the first complaint in XXXX. I have disputed the inaccurate information with XXXX, XXXX, and XXXX and they have continued to repeatedly verify the erroneous information. They are in violation of FCRA, 15 U.S.C. 1681s-2.
Prohibition ( A ) Reporting information with actual knowledge of errors A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate.
( B ) Reporting information after notice and confirmation of errors A person shall not furnish information relating to a consumer to any consumer reporting agency if ( i ) the person has been notified by the consumer, at the address specified by the person for such notices, that specific information is inaccurate; and ( ii ) the information is, in fact, inaccurate.

XXXX. Sezzle INCXXXX Account XXXX Please correct this inaccurate information on my credit report. I recently pulled my credit report from your Bureau and my attorneys and I had a chance to go over my credit report and in amazement, that you have decided to report me 30 days late on this account in XX/XX/XXXX.
I immediately disputed this information with Sezzle INC. and the results of the investigation came back " verified ''. Not only was I never late on this account, but according to the Fair Credit Reporting Act ( FCRA ), the information furnisher is required to notify me of the insertion of negative listings. Since I have disputed the lates with the creditor, and you obviously " verified '' them, I am very curious as to what kinds of " records '' you may have for this alleged account. I am very confident that you are in violation of the ( FCRA ) and ( FCBA ) sections ( 1666, 1666a. 1666b., and 1666c. ) as stated below : 1666. Correction of billing errors ( b ) Billing error ( 4 ) The creditor 's failure to reflect properly on a statement, a payment made by the obligor or a credit issued to the obligor. ( 5 ) A computation error or similar error of an accounting nature of the creditor on a statement. ( 6 ) Failure to transmit the statement required under section 1637 ( b ) of this title to the last address of the obligor which has been disclosed to the creditor, unless that address was furnished less than twenty days before the end of the billing cycle for which the statement is required. ( 7 ) Any other error described in regulations of the Bureau. 1666a. Regulation of credit reports ( a ) Reports by creditor on obligor 's failure to pay amount regarded as billing error After receiving a notice from an obligor as provided in section 1666 ( a ) of this title, a creditor or his agent may not directly or indirectly threaten to report to any person adversely on the obligor 's credit rating or credit standing because of the obligor 's failure to pay the amount indicated by the obligor under section 1666 ( a ) ( 2 ) of this title, and such amount may not be reported as delinquent to any third party until the creditor has met the requirements of section 1666 of this title and has allowed the obligor the same number of days ( not less than ten ) thereafter to make payment as is provided under the credit agreement with the obligor for the payment of undisputed amounts. ( b ) Reports by creditor on delinquent amounts in dispute ; notification of obligor of parties notified of delinquency If a creditor receives a further written notice from an obligor that an amount is still in dispute within the time allowed for payment under subsection ( a ) of this section, a creditor may not report to any third party that the amount of the obligor is delinquent because the obligor has failed to pay an amount which he has indicated under section 1666 ( a ) ( 2 ) of this title, unless the creditor also reports that the amount is in dispute and, at the same time, notifies the obligor of the name and address of each party to whom the creditor is reporting information concerning the delinquency. ( c ) Reports by creditor of subsequent resolution of delinquent amounts A creditor shall report any subsequent resolution of any delinquencies reported pursuant to subsection ( b ) to the parties to whom such delinquencies were initially reported. 1666b. Timing of payments ( a ) Time to make payments A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. Because I take my credit very seriously, I contacted every name and account that was listed on the report. I was again very shocked by the multiple names, account numbers and figures. Included with this letter, is every letter written to those who have hampered my ability to obtain credit. I believe that any judge that looks over the report would agree that it is a violation of both the FCRA, CCPA and FACTA. The following accounts were listed on your report and I have demanded from them a full accounting and five years worth of records to see if their accounts were in violation of the FAIR CREDIT BILLING ACT ( FCBA ). We also demanded signed contracts, agreements or any legal paperwork that would tie us to the following accounts. Under the FCRA, you are required to conduct an investigation on this account if I request it. I DEMAND to see all 100 % verifiable proof that I was indeed Verifiably late on these accounts and the creditor fulfilled its obligations under ( FCBA 1666 ( a ) ( 2 ) ), As I was never notified of a billing delinquency on my accounts, which the creditor must do under section ( FCBA1666 ( b ) ( 6 ). I DEMAND to see proof that I was mailed my statement to the correct address notifying me of both payment due date and delinquency of payment on the account. If you can not provide 100 % Verifiable proof and proper documentation that the CREDITOR fulfilled its obligations under the ( FCBA ) and ( FCRA ), I therefore demand these late payments be removed from my account or I will be forced to be in contact with the Attorney General of my State and the Consumer Financial Protection Bureau. I therefore am submitting my written request to you to conduct an investigation. Per the FCRA, you have 30 days to conduct this investigation and respond to my request. If you do not respond within this time period, per the FCRA, you must remove this negative information. I contacted sezzle via email in XX/XX/2023, advising them that my charges off account was paid and that the credit bureaus would need to be updated. I received a response back from XXXX, XXXX ( Sezzle Shopper Support ) XX/XX/2023, XXXX XXXX CST Advising me : Thanks for contacting Sezzle Shopper Support.
We understand you are reaching out due to a recent inconsistency with your credit report.
We identified an issue with a recent report that required a correction. This correction first removed Sezzle from your report, which you likely recently noticed, and then a new report was quickly submitted to XXXX.
This correction should reflect on your credit soon if not already, depending on how frequently any credit reporting services you use. Don't worry, once applied, your credit report would reflect as if the inconsistency never occurred.

Best, XXXX Sezzle Shopper Support I disputed the balance with XXXX in XX/XX/2023 and lost the dispute despite providing evidence that my debt is paid in full. Sezzle needs to update XXXX, XXXX and XXXX that my debt is paid in full, I dont owe a balance, and havent in more than 6 months.
