1. It is not only not ok but it also is their responsibility to update payment and terms correctly and accurately 2. They took me to court for XXXX XXXX XXXX in XXXX. Thats one agreement which was for a different monthly payment 3. They took me to court again XX/XX/XXXX for the same student loan with a different monthly payment agreement .. let the court documents show a factual reflection minus the incorrect control numbers that should be on a court document 4. On the new court document the XX/XX/XXXX date is written and stamped 5. So clearly its a different agreement if there is a different monthly payment amount for XXXX XXXX XXXX Now what I wont have is hearing one thing on the phone and one thing in writing so this is our new form of communication cfpb

I have already submitted an identity theft affidavit through the Federal Trade Commission and reached out to my local police department to report this crime.

Per the agreement.. the balance information is to reflect the actual balance. I also called months ago because on the legal agreement the control number is not even correct which is well obvious This is for the debt from the school I won a federal borrower defense against XXXX XXXX .. this is debt that Forster and garbus claims I owe national collegiate student loan on co-signed loans from XXXX XXXX who was on social security at the time and there lawyer took me to court after my XXXX treatment.
This information is to serve as a reminder as they serve so many students by taking them to queens county court that they may forget.
I called in XXXX and they said it will update and they gave me the correct control numbers They can at least update there payment website to reflect accurate information on the debt they state I owe the website amounts are totally incorrect and have been that way for months update the website PLEAse as I have made my payment today and notice again its not right and took a photo also how is XXXX supposed to keep an account of the payments if its not even on the website

Formal Complaint Against Forster & Garbus LLP, for Violation of Consumer Protection Laws Dear Sir/Madam, Forster & Garbus LLP XXXX accused me of owing debt with Asset Acceptance XXXX XXXX Bank XXXX I was unaware of this alleged debt, and I didnt have an opportunity to dispute this information, as Forster & Garbus LLP never provided me with the proper notification. My first knowledge of this alleged debt was when I received two certified letters from my Sheriffs Department with an Income Execution. This is a direct violation of 15 U.S. Code 1692g ( d ). This was the first time I ever heard of XXXX XXXX & their attorney Forster & Garbus LLP. This is a violation of FDCPA guidelines. After seeking legal guidance, I requested the Affidavits, I see there was a judgement filed XX/XX/XXXX. There is a huge gap between them filing the judgement against me back in XXXX without my prior knowledge and now submitting a complaint for Income Execution 16 years later. On XX/XX/XXXX I filed an Order to Show Cause but was denied for an unknown reason. On XX/XX/XXXX I filed a second Order to Show Cause ( XXXX XXXX ) with all attachments proving I was not residing at XXXX XXXX XXXX XXXX XX/XX/XXXX the Judge approved the Order to Show Cause and set a court date for XX/XX/XXXX in which Forster & Garbus LLP failed to appear. I appeared in court and the Judgement to vacate was granted because I was never served ( See attached Index # - XXXX XXXX ), I am waiting for another court date because I requested the case be restored back to the calendar. I am filing this complaint to save others from going through such a traumatic experience. Forster & Grabus LLP violated ( CPLR ) 308, -- -- I was not residing at neither of those addresses they claimed to have served me at ( see attached ) To have my employer involved for no reason is absurd. To date, I have not received anything explaining this debt and said accrued interest fees. I am demanding that they leave me alone. The court papers attached prove that this case is a result of bad service and my rights were violated. I am demanding monetary relief from this matter. I have declared myself a victim in concerns with Forster & Garbus actions and as mentioned above these violate the FDCPA guidelines concerning collecting with submission of ownership on a time-barred debt. I have missed a good number of hours of work over three months going back and forth to the courthouse paying for requested documents related to this case and parking. I also demand the money that has been garnished to date returned to me immediately and this case further investigated. This alleged debt has never been on my credit report nor was I notified that is charged-off and sold to a debt collector. Attached you will find the Original Order to Show Cause packet ( Exhibit A, 20 pages total ) with all documents submitted to the judge. I also attached a copy of my most recent paystub to show the amount to date paid on such garnishment. ( Exhibit B ) The status of the case showing in fact this judgement is vacated is also attached ( Exhibit C & D ). I also request that the Consumer Financial Protection Bureau impose a remedy of { {$1000.00} } per violation, as provided for Under 15 U.S.C. 1681n, on Forster & Garbus LLP to compensate me for the harm caused by these violations. In XX/XX/year>, I spoke with an employee at Forster and Garbus by the name of XXXX. I was able to work out a settlement agreement of {$690.00}, which I paid on XX/XX/XXXX. I was told that I would receive a stipulation of settlement agreement, but never received it. I called the company back in early XXXX to see why I never received the stipulation of settlement agreement or any information about receiving the settlement payment. I was told that someone would contact me, but they never did. In addition, this case is a lawsuit brought on by Forster and Garrys, which I already submitted an answer for.
In addition, the agent XXXX, asked for my place of employment on the phone. Also, he left a voicemail message that didnt explain what company he was from and that he was a debt collector.

They called so aggressively, I blocked several numbers after explaining I had no idea what they were talking about. They claimed to represent XXXX XXXX, which I have XXXX current cards with.
I was sent a legal notice early last year and requesting verification of the debt which I never received. Approximately XXXX month ago, I received a notice of trial in the mail.

I decided to just Pay what they claim I owe even though No One has Answers for me regarding the previous Payments Not Accounted for which is very confusing.
I completely PAID off the Judgment with the last Payment of {$970.00} which I made on XX/XX/XXXX through the Collection Agency FORSTER & GARBUS Website payfgny.com but I have still not received any notice in the mail nor has the County Clerk received a Satisfaction of Judgment. I have tried to call Forster & Garbus several different times, it is very complicated to get through but when I have, leaving voicemails as well as recently a secretary taking my callback info but I have still not heard back from anyone.

I have received a letter from Forster & Garbus LLP, a debt collector stating that I have to pay judgement due amount of {$42.00}, XXXX plus interest. They also sent a notice of garnishment from Marshal for total amount of {$63000.00}. They have been contacting my employer also. I do not know how they got judgment against me. I have not got any summon to appear in court. I took a student loan between the year XXXX from a private company to XXXX XXXX in XXXX XXXX. The company stopped paying the loan after one year and I could not pursue my study further. Probably, the loan company was closed or bankrupt. Because of incomplete study, I remained unemployed for many years. I do not remember the amount of loan, but it is far less than the debt collector asking for. In past, I received several letters from different debt collectors for asking different amount. I sent letters to few of them asking verification and copy of written agreement. I have not received any reply from them. I suspected inaccuracy and stopped responding the other debt collector afterward. I was afraid of scam.
I would like the following information : 1. The name, address, amount, and account number used by the original creditor. The creditor contact address and phone number.
2. Provide verification and documentation. Provide copy of written agreement created my original requirement to pay. Provide promissory note with my signature.
3. State when the creditor claims this debt became due and when it became delinquent.
4. Have you made a determination that debt is within the statue of limitations and applicable to it? When the statute of limitations expires for this debt, and how you determined that?
5. Send me proof of summon with signature of the receiver. Proof of registered post by court.
6. A copy of the last billing statement sent to me by the original creditor.
The court judgement in favor of creditor is biased or based on misleading information supplied to court. The judgement is one sided favoring the creditor. You have all legal tools and access ; it does not mean that you suppress the weak and take advantage.
After receiving the above-mentioned information, I would like to make an informed decision about your claim. I would like involve regulatory authority and appeal in the court in this matter.
