XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXX/XX/XXXX CHERRY TECHNOLOGIES IN XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Dear CHERRY TECHNOLOGIES IN Subject : Second Notice -Follow-Up on Charge-Off Dispute and Request for Documentation Regarding Account XXXX On XX/XX/XXXX, sent you a formal dispute letter regarding the reporting.of the charge-off account associated with XXXX XXXX my credit-report. In this letter ; l requested the following : XXXX. Authenticated double-entry accounting records-for the account.
2. Authenticated evidence, including original signed contracts.or agreements, verifying the legal right to collect and report the debt.
3. A.copy of the 1099-C form, if the debt has been canceled or settled XXXX for less than the full-balance.
I requested a response within 30 days of receipt of the letter, but l have yet to receive the requested documentation.or confirmation that the account has been deleted from my credit report. This lack of response constitutes a failure to meet your obligations under the Fair Credit Reporting Act ( FCRA ) and XXXX U.S.C. 1681i ( Reinvestigation of Disputed Information ), 9 as well as 15.U.S.C. 1681s-2 ( Responsibilities of Furnishers-off Information ). 9 Furthermore, in XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX proper investigation of disputes and verify the accuracy of information reported to credit bureaus. Your failure to respond and provide the requested documents is a violation of both your federal and state legal responsibilities.
In light of your failure to comply, I am sending this follow-up letter to request an immediate response. If I do not receive the requested information within 15 days, I will be forced to escalate the matter further, including : Filing a formal complaint with the Consumer Financial Protection Bureau ( CFPB ) for non-compliance with the FCRA.
Pursuing legal remedies, including statutory and actual damages, as permitted by law.
Reporting this matter to the IRS and submitting a Suspicious Activity Report ( SAR ) regarding any potential fraud, should you continue to report inaccurate or unverifiable information.
This will be my final attempt to resolve this matter directly with you. Please respond with the requested documents or confirm the deletion of this account from my credit report by 15 Days from the Date of This Letter Thank you for your immediate attention to this matter.

On XX/XX/XXXX I received financing for a surgical procedure in the amount of {$10000.00}. The receipt I received via email stated your " XXXX XXXX XXXX XXXX XXXX XXXX is confirmed '' Your contract reference is XXXX. Lender : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. Loan Servicer : Cherry Servicing , LLC XXXX XXXX XXXX XXXX XXXX XXXX XXXX Phone Number : XXXX. I made my first payment of {$260.00} on XX/XX/24 before I saw the surgeon. Once I saw the surgeon he declined to do the procedure. The surgeon is XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Phone number : XXXX. The procedure did not take place and I notified the servicing company in writing that I would not need the loan and to please cancel it. I did this immediately, the very next day. They responded to me in writing via email and stated " to request a refund, please contact the practice where you used Cherry to make a purchase. We defer to the refund policies put in place by our partner practices and can not initiate a refund without their approval ''. This is insane to me because I didn't have the surgery. The practice didn't take out the loan, I did. I feel as if they should have verified that the procedure was cancelled and then cancel the loan asap. The next payment is due to come out of my account on XX/XX/XXXX. This means I will be paying for a loan on a surgery that I never had. I want this loan canceled immediately and my money refunded.
